    WASHINGTON, Feb 13 (Reuters) – Two Democratic members of the U.S. Senate Banking Committee on Friday asked Treasury Secretary Scott Bessent to examine the potential national security implications of a reported purchase of a $500 million stake in the Trump family’s cryptocurrency venture by the United Arab Emirates’ national security adviser.

    Senators Elizabeth Warren and Andy Kim asked Bessent, who heads the Committee on Foreign Investment in the United States, to determine whether a CFIUS review is required of the 49% UAE stake in World Liberty Financial and, if so, to conduct a comprehensive, thorough and unbiased investigation.

    White House files most detailed plans yet for Trump ballroom, East Wing renovation

    The White House this week presented its most detailed plans yet for the East Wing renovation, moving one step closer to fulfilling President Trump’s wish for a nearly 90,000-square-foot addition to the executive mansion. The National Capital Planning Commission will evaluate those plans at a hearing in early March.

    The submission includes new renderings of the neoclassical structure, relative to other buildings close to the ballroom and from vantage points near the U.S. Capitol, Jefferson Memorial and points around the White House campus. The East Wing, which will house a ballroom, office space and a two-story colonnade, will be built to roughly the same height as the existing executive residence and will be slightly taller than the adjacent Treasury building.

    In a 9-page letter to the commission, director of White House management and administration Josh Fisher said experts studied the existing East Wing structure before concluding demolition was the only way forward. Its structural limitations did not allow for modifications, Fisher wrote.

    “Demolition of the existing East Wing structure and reconstruction of a new East Wing provided the most effective solution to many longstanding issues affecting the White House and delivered the best long-term risk reduction,” Fisher said.

    The East Wing was razed in October. Fisher said heavy equipment has been kept at a distance from the White House mansion to avoid inadvertent damage, and he said that a portion of the building was removed by hand. Contractors monitored vibrations and cracks to protect the existing structure.

    Fisher wrote that the demolition was “methodical….rather than sudden catastrophic destruction,” even though the public was not notified prior to the East Wing’s destruction.

    The administration plans to upgrade park grounds surrounding the White House and replace the trailer that currently serves as a visitor security checkpoint.

    Fisher added a team has begun structural analysis of the West Wing colonnade to see if it could support a second story, bringing it into symmetry with the soon-to-built East colonnade. “No decision will be made regarding such a project until these aspects are fully studied and analyzed.”

    “On Feb. 13, at the direction of #SOUTHCOM commander Gen. Francis L. Donovan, Joint Task Force Southern Spear conducted a lethal kinetic strike on a vessel operated by Designated Terrorist Organizations,” SOUTHCOM wrote on X, adding that no US military personnel were harmed in the strike.

    The statement did not specify where the strike took place but said “Intelligence confirmed the vessel was transiting along known narco-trafficking routes in the Caribbean and was engaged in narco-trafficking operations.”

    At least 124 people have now been killed in strikes on suspected drug boats as part of Operation Southern Spear, a campaign the Trump administration says is aimed at curtailing narcotics trafficking.

    The administration has labeled those killed as “unlawful combatants” and claimed the ability to engage in lethal strikes without judicial review due to a classified Justice Department finding.

    Friday’s boat strike is the fourth publicly known attack of the year. A strike earlier this week killed two people and left one survivor, with the US Coast Guard providing technical support for search and rescue operations coordinated by Maritime Rescue Coordination Center Ecuador.

    The administration has publicly presented little evidence that those killed in Operation Southern Spear are affiliated with drug cartels, or that each of the vessels had drugs on them.

    The legality of the strikes has also come under intense scrutiny in Congress since the operations began in September. There is particular interest in the first attack on September 2, which included a follow-up strike that killed two crew members who had initially survived. Multiple current and former military lawyers previously told CNN the strikes do not appear lawful.

    Trump ousts judge-installed prosecutor; constitutional expert says Article II leaves no doubt

    Legal expert says president has constitutional removal power despite federal law allowing judges to fill prosecutor vacancies

    President Donald Trump has the constitutional authority to fire court-appointed U.S. attorneys, even if judges legally appointed them, according to former Justice Department official John Yoo, who said the Constitution gives the president broad removal power over executive branch officers.

    “Otherwise, you could have U.S. attorneys who are enforcing federal law differently than the president would, and it’s the president who all of us in the country elect and to whom the president is accountable,” Yoo told Fox News Digital in an interview.

    Trump exercised that power this week by terminating Donald Kinsella just hours after federal judges in the Northern District of New York voted to install him to fill the vacancy left by Trump appointee John Sarcone, whose temporary term had expired.

    Deputy Attorney General Todd Blanche revealed the move in a fiery social media post, declaring that judges “don’t pick” U.S. attorneys and thrusting the fight deeper into a constitutional dispute over who ultimately controls them.

    At the center of the most recent dispute is a law that allows federal courts to appoint temporary U.S. attorneys when a presidential nominee has not been confirmed by the Senate and an acting official’s term has expired. Blanche suggested the court’s move to fill a U.S. attorney vacancy was unconstitutional, a comment that comes as the DOJ appeals Judge Lorna Schofield’s decision last month to disqualify Sarcone over his expired tenure.

    But Yoo, a law professor at University of California, Berkeley, said both that the judges’ actions were legal due to a “quirk” in the law and that the president still has authority to fire Kinsella.

    “No matter how an executive officer is appointed … none of these positions under the Constitution have any specific way to remove the officers, and so the president can remove all officers in the executive branch, particularly all officers in the Justice Department,” Yoo said.

    Yoo said the Constitution lays out detailed processes for appointing U.S. attorneys but is “silent” on how they are removed.

    “It has elaborate procedures … about how you appoint them to office. It doesn’t actually discuss at all how you remove them from office,” Yoo said, referencing the complex federal vacancy laws that govern how interim and acting U.S. attorneys are appointed.

    He noted that existing law and Supreme Court precedent have long given the president the ultimate power to fire inferior officers in the executive branch, meaning an official like the attorney general cannot remove the appointees chosen by the courts, such as Kinsella, but Trump can.

    Kinsella did not respond to a request for comment on his termination.

    Under the law, U.S. attorneys are nominated by the president and confirmed by the Senate. But if the Senate does not act, the president can install a temporary U.S. attorney for a limited period, typically 120 days. If that term expires without confirmation of a nominee, the law gives the district court’s judges the power to appoint a replacement to avoid a vacancy in the office.

    Trump, for his part, has struggled to secure Senate confirmations of his U.S. attorney nominees in blue states, where the upper chamber’s blue slip tradition has meant that home state senators must greenlight his nominees.

    His interim appointees in these states, including New York, California, Nevada, New Jersey and Virginia, have faced legal setbacks as federal judges have uniformly found that Trump cannot repeatedly reappoint the same person to consecutive temporary terms.

    Senate Minority Leader Chuck Schumer, D-N.Y., has ruled out approving any of Trump’s nominees in New York, for example. After Trump fired Kinsella, a veteran federal prosecutor, Schumer said in a statement the president wanted an unqualified “political loyalist” in office.

    “Everyone knows Trump only cares about one quality in a U.S. Attorney — complete political subservience,” Schumer said.

    In New Jersey, Trump quickly fired a court-appointed U.S. attorney after a lower court found Alina Habba’s temporary term had expired. The U.S. Court of Appeals for the 3rd Circuit upheld the lower court’s finding that Habba was unlawfully serving.

    In the Eastern District of Virginia, the top prosecutor’s role also remains in limbo as the DOJ appeals a judge’s decision to disqualify Lindsey Halligan, who brought high-profile indictments against New York Attorney General Letitia James and former FBI Director James Comey. The judge tossed those cases, finding Halligan was improperly appointed.

    The Trump DOJ used a variety of loopholes in the law to install Sarcone, Habba, Halligan and others, and has argued in appeals that the judges disqualifying them — and replacing them with U.S. attorneys of the court’s choosing — were misreading the law.

    “It is important that a DOJ component is overseen by someone who has the support of the Executive Branch, and that a U.S. Attorney’s Office can continue to function even when there is no Senate-confirmed or interim U.S. Attorney,” DOJ attorneys wrote in court papers in Habba’s case.

    Yoo signaled that the courts were right to honor the statutory time constraints on acting and interm tenures, but he reiterated that Trump had sole removal power.

    From the founding, he said, officers who enforce federal law have been removable at will by the president under Article II of the Constitution and the take care clause, the duty to “take care that the laws be faithfully executed.”

    “Any subordinates who are carrying out federal law have to be accountable to him,” Yoo said.

    The DOJ has not at this stage elevated any of the U.S. attorney cases to the Supreme Court. Habba’s case is the furthest along, and a spokesperson did not respond to a request for comment on whether the DOJ would appeal that decision.

    Why is the U.S. government exploring using high-energy lasers near the southern border?

    The unexpected and ultimately short-lived flight ban near El Paso this week stemmed from disagreements within the federal government over the use of a high-energy laser weapon system to take down drones, multiple sources told CBS News.

    After training by the U.S. military, Customs and Border Protection used a palletized high-energy laser system earlier this week, even though the Federal Aviation Administration still has safety concerns, according to sources who were granted anonymity because they are not authorized to speak on the matter.

    The system CBP used has been deployed overseas, according to two of the sources, but had not been considered for regular domestic use until recently. The system works by detecting an aerial threat, emitting a laser beam that can quickly zero in on the target, like a drone, and the beam’s heat damages or disables the object.

    High-energy lasers are one of several systems the government could use to counter drones.

    “The laser, of course, is essentially instantaneous, and so it’s relatively easy for something that’s doing the speed of light to hit exactly the point on the object that it wants to do,” said Tom Karako, a senior fellow and the director of the Missile Defense Project at the Center for International and Strategic Studies.

    After Wednesday’s flight restriction was lifted, Transportation Secretary Sean Duffy said “the threat has been neutralized” by the FAA and praised the Pentagon, which he said “acted swiftly to address a cartel incursion.” But the Pentagon said it had nothing to add when asked when or how the threat was eliminated.

    While CBP thought it was targeting foreign drones with the high-energy laser, it turned out to have taken down at least one party balloon, multiple sources told CBS News.

    Drones near the border are not new and have been a steady problem over several years, particularly those used by cartels.

    “The cartel drone problem is pervasive across the U.S. southern border,” according to Austin Doctor, who is an associate professor at the University of Nebraska at Omaha and the director of strategic initiatives at the National Counterterrorism Innovation, Technology, and Education Center.

    The cartels and affiliates are primarily using drones for surveillance purposes “to support their other illegal criminal activities, including smuggling of narcotics, smuggling of persons, firearms, and other illicit goods,” Doctor told CBS News.

    They have not used weaponized drones inside the U.S., he said, but are using them inside of Mexico to target rival cartels, prompting fears they could eventually start to use the drones to threaten U.S. personnel or infrastructure.

    The activity near the border, combined with the mysterious sightings near military installations, like Joint Base Langley-Eustis in Virginia in 2023 and Joint Base McGuire-Dix-Lakehurst in New Jersey in 2024, contributed to the Pentagon’s establishment of a joint task force to counter drones.

    The task force coordinates between federal agencies on what authorities to use in specific scenarios and how to mitigate any threat from drones.

    The task force is “doing great things,” said retired Air Force Gen. Glen VanHerck, who served as the commander of U.S. Northern Command and NORAD from 2020 to 2024.

    “But there’s so much more to be done,” VanHerck said in a phone interview. “They need to be empowered to get the right policy in place for who defends what specific critical infrastructure with what specific capability,” he said. “And the challenges become ensuring you’re able to defend while also maintaining safety of flight for general and aviation aircraft and the public in general, depending on what capability you utilize to engage the threat.”

    There are a variety of capabilities “but no silver bullet for countering drones,” VanHerck added.

    He favors a layered system of defense with a foundation of radio frequency cyber techniques that can disrupt and take over the drone to bring it down safely. According to VanHerck, field experience from around the world shows that over 80% of drones encountered are commercial and can be brought down with this type of technology.

    Other layers would rely on different systems that could include high-energy lasers.

    Karako of CSIS said defending the southern border from drones is one piece of the larger puzzle that President Trump’s Golden Dome initiative is about — to defend the homeland from all air and missile threats.

    “Maybe the lesson here ought to be that this big effort, this big initiative coming down the pipe that is called Golden Dome will require and force us out of necessity to have better communication and better coordination between the very necessary FAA function for air traffic control and air traffic management, the coordination between the FAA function and the DOD national security function,” Karako said.
