    Trump lashes out at his own Supreme Court picks over tariff ruling: “An embarrassment to their families”

    Washington — Hours after the Supreme Court struck down President Trump’s sweeping global tariffs, the president directed his ire at the six justices who ruled against him — including a pair of conservative jurists who were nominated to the bench by Mr. Trump.

    Mr. Trump told reporters he’s “ashamed of certain members of the court.” He criticized the three liberal members, calling them an “automatic no,” but appeared especially frustrated with the three conservatives who concluded that the International Emergency Economic Powers Act, or IEEPA, doesn’t give the president the power to unilaterally impose tariffs.

    “You can’t knock their loyalty,” Mr. Trump said of the liberal justices. “That’s one thing you can do with some of our people.”

    The three conservatives who ruled against the administration’s tariff strategy were George W. Bush-appointed Chief Justice John Roberts, and two justices who were appointed in Mr. Trump’s first term: Neil Gorsuch and Amy Coney Barrett.

    Asked if he regrets nominating Gorsuch and Barrett, Mr. Trump declined to answer, but called the decision “an embarrassment to their families.”

    He also alleged — without evidence — that the court has been “swayed by foreign interests,” and said the justices in the majority were “fools and lap dogs for the RINOs and the radical left Democrats.” RINOs is short for “Republicans in name only.”

    Mr. Trump heaped praise on his third nominee to the court, Justice Brett Kavanaugh, who penned the principal dissenting opinion, arguing that the president’s power under IEEPA encompasses tariffs. Kavanaugh also laid out a menu of other laws that could be invoked to potentially justify levies, some of which the president indicated he would use. Mr. Trump called him a “genius” and said his stock is on the rise.

    The ruling could make for a strange dynamic during Mr. Trump’s State of the Union address on Tuesday, which some Supreme Court justices usually attend. The president told reporters Friday the justices are still invited, but the six who ruled against him are “barely invited,” while the three dissenting justices are “happily invited.”

    “I couldn’t care less if they come,” Mr. Trump said.

    A spokesperson for the Supreme Court did not immediately return a request for comment.

    Prior presidents have criticized the Supreme Court for decisions they disagree with, though not as sharply as Mr. Trump did Friday or through personal attacks. After the high court in June 2023 struck down former President Joe Biden’s plan to forgive $400 billion in student-loan debt, Biden called the decision “a mistake” and “wrong,” and said the majority “misinterpreted the Constitution.”

    Then, after the Supreme Court ruled in July 2024 that presidents have immunity from federal prosecution for official actions taken while in office, Biden said the decision was a “terrible disservice to the people of this nation” and a continuation of what he said was the court’s attack “on a wide range of long-established principles.”

    During his State of the Union address in 2010, then-President Barack Obama criticized the Supreme Court’s decision in the landmark campaign finance case Citizens United v. Federal Election Commission, warning it would “open the floodgates for special interests, including foreign corporations, to spend without limit” in federal elections.

    Justice Samuel Alito, sitting alongside his Supreme Court colleagues, shook his head and appeared to mouth “not true” in response to Obama’s comments. He has not attended a State of the Union since.

    Mr. Trump has criticized the Supreme Court in the past for ruling against him. After the court declined to take a longshot lawsuit from the state of Texas to halt the certification of his 2020 election loss, the president said the court “really let us down. No Wisdom, No Courage!”

    And in a 2023 speech, while Mr. Trump was out of office, he called his nominees “outstanding people” and “great scholars” who have “done a great job” — “except for me,” he joked.

    “They don’t help me much, I’ve got to tell you that,” the president said. “They vote against me too much, but one of those little things in life, right?”

    Mr. Trump’s three appointments to the Supreme Court shifted the court to the right. In the years since Barrett was confirmed to replace the late Justice Ruth Bader Ginsburg in 2020, which expanded its conservative majority to 6-3, the Supreme Court has overturned Roe v. Wade, which established the constitutional right to abortion, ended affirmative action in higher education and curtailed the regulatory power of federal agencies.

    The court’s conservative majority also expanded gun rights in 2022, recognizing for the first time that the Second Amendment protects the right to carry a firearm in public.

    One influential adviser who helped Mr. Trump shape the judiciary in his first term was Leonard Leo, a former Federalist Society leader who advised the president on Supreme Court picks.

    Since then, Mr. Trump has had a falling-out with the powerful legal activist. After an appellate court ruled against his tariffs last year, Mr. Trump publicly blamed Leo, whom he called a “sleazebag” and a “bad person” who “probably hates America.”

    “We will get back to the same tariff level for the countries. It will just be in a less direct and slightly more convoluted manner,” he said.

    Trump reacted to the court’s ruling on Friday by saying he would invoke other laws to collect tariffs, and announced a blanket 10% tariff on imports from all other countries.

    Bessent said he believed every country was going to honor the trade agreements made with the Trump administration over the last year.

    “He (Trump) has a right to a complete embargo, he can just cut countries off … or he can cut whole product lines off. We can’t receive any money. So, I would call on all countries to honor their agreements and move forward,” Bessent added.

    Will Americans get refunds after Trump’s tariffs were overturned by the Supreme Court?

    Businesses are pressing the Trump administration to issue tariff refunds after the Supreme Court ruled Friday that President Trump unlawfully imposed levies under the International Emergency Economic Powers Act, or IEEPA. Yet that process faces potential legal and political roadblocks, with experts saying it could drag out for years.

    Economists and trade experts told CBS News they expect the issue to be litigated in court, while no government mechanism is currently set up for businesses to file for or collect a tariff refund.

    “We anticipate another long legal fight over those refunds,” Paul Ashworth, chief North America economist with Capital Economics, said in a note to investors.

    Will Americans get tariff refunds after the Supreme Court ruling?


    The Supreme Court did not indicate in its ruling whether businesses that paid billions of dollars in IEEPA tariffs must be reimbursed, effectively punting the question to lower courts.

    In a press conference on Friday after the Supreme Court ruling, Mr. Trump demurred on whether his administration will issue refunds, but suggested the process is likely to be drawn out — possibly for years.

    “They take months and months to write an opinion, and they don’t even discuss that point,” he said. “What happens to all the money we took in? It wasn’t discussed.”

    “I guess it has to get litigated for the next two years,” he added.

    The Penn Wharton Budget Model, a nonpartisan research initiative focused on public policy analysis, estimated Friday that businesses could be owed up to $165 billion in tariff refunds.

    How would a tariff refund work?


    Currently, no procedures are in place to automatically refund businesses for the IEEPA tariffs they paid; similarly, no portal exists that would enable businesses to apply for reimbursement.

    Wayne Winegarden, a senior fellow in economics at Pacific Research Institute, a nonpartisan think tank that supports free-market principles, told CBS News that processing billions of dollars in tariff refunds would be an “unprecedented” move by the federal government.

    “Certainly, the administration is not going to volunteer refunds, and companies will have to ask for them,” he said. “The bottom line is that the government didn’t have the authority to levy the tax, so they are entitled to refunds.”

    Although Winegarden said businesses will likely have to jump through various hoops to claim a refund, he suspects some companies will opt against filing for compensation out of concern that it could anger Mr. Trump.

    “It’s a complicated mess. For businesses, it’s a crapshoot, and he’s a punitive person, so that will keep them from asking,” Winegarden told CBS News.

    Which tariffs would qualify for a tariff refund?


    The Supreme Court struck down country-based tariffs imposed under IEEPA. Those levies account for roughly 60% of the U.S. tariff revenue collected each month, according to the Penn Wharton Budget Model.

    At a speech at the Economic Club of Dallas on Friday, U.S. Treasury Secretary Scott Bessent suggested it is unclear if the federal government must provide tariff refunds to businesses, saying the issue is “in dispute.”

    “The Supreme Court did not rule on that today — they pushed it back down to the International Tax and Trade Court. And you know, my sense is that could be dragged out for weeks, months, years,” he said.

    Meanwhile, the Trump administration has said it is working to replace the IEEPA tariffs through other powers.

    “We can use other of the statutes, other of the tariff authorities, which have also been confirmed and are fully allowed,” Mr. Trump said Friday. To that end, he announced he would impose a 10% global tariff under Section 122 of the 1974 Trade Act.

    The president also indicated that his administration would seek to expand other existing tariffs, such as levies imposed under Section 301 of the Trade Act.

    Who has called for tariff refunds?


    Alex Jacquez, chief of policy and advocacy at Groundwork Collective, a progressive economic think tank, said that businesses have filed more than 1,000 claims for tariff refunds with the Court of International Trade. He expects that number to soar following Friday’s high court ruling.

    Those cases “have been stayed since the Supreme Court decided they would take this on — now they will all go forward,” he said. “There will be a massive number of cases.”

    Shawn Phetteplace, national campaigns director for Main Street Alliance, a small business advocacy group that opposes Mr. Trump’s tariffs, urged the White House to swiftly provide refunds.

    “We are going to work really hard to get the money back, because it’s the kind of money that can make a business unsustainable,” he said, noting that some small business owners have closed permanently because of higher tariff costs.

    “If tariffs are deemed illegal, then the money should be paid back, and you would hope they follow the law and the ruling,” Phetteplace added.

    Following the Supreme Court decision, some state political leaders also called on Mr. Trump to issue refunds to U.S. consumers.

    “Trump took hard-earned money from the pockets of working families and the American people. Time to pay up,” California Gov. Gavin Newsom said in a posted on social media.

    In a memo on Friday, Illinois Gov. JB Pritzker also demanded that the Trump administration pay every household in the state $1,700 each — a total of $8 billion. That is the amount Democratic lawmakers on the Joint Economic Committee recently estimated that U.S. families have paid in tariff costs.

    WASHINGTON, Feb 20 (Reuters) – President Donald Trump lashed out on Friday at the U.S. Supreme Court and the six justices who struck down his signature global tariffs – including two he appointed – in remarkably personal terms while hailing the three justices who backed him.

    Although previous presidents have sharply criticized Supreme Court rulings against them, Trump’s lengthy tirade to reporters at the White House stood out for its contemptuous tone, as well as the personal nature of his scorn and praise.

    It represented a remarkable attack by a sitting president on the top U.S. judicial body, even after Trump and other senior officials in his administration over the past year have assailed lower-court judges for rulings impeding his policies since he returned to office in January 2025.

    The Supreme Court, which has a 6-3 conservative majority, had over the past year permitted Trump’s expansive assertion of executive power, with few exceptions, in a series of decisions issued on an emergency basis.

    But Friday’s ruling delivered Trump a stinging defeat. It was authored by Chief Justice John Roberts and joined by two fellow conservatives who Trump appointed during his first term in office – Neil Gorsuch and Amy Coney Barrett – as well as the three liberal justices.

    特朗普此前表示期待习近平在今年晚些时候访问华盛顿,预计习近平将出席在佛罗里达州举行的二十国集团(G20)会议。
