    Mollie Hemingway’s book ‘Alito’ details the confrontation as conservative justices faced assassination threats in 2022

    FIRST ON FOX:** Justice Elena Kagan’s frustrations boiled over in the aftermath of the Dobbs opinion leak in 2022, leading her to allegedly scream “so loudly” at Justice Stephen Breyer that the “wall was shaking,” observers said, according to a new book.

    Conservative author and Fox News contributor Mollie Hemingway’s forthcoming book “Alito,” reviewed by Fox News Digital and set for release Tuesday, details the incident and other heated moments surrounding the leak, which spurred waves of protests and death threats against the five conservative justices expected to overturn Roe that year.

    The Supreme Court’s deep division on abortion was clear at the time, but the book reveals that a typically unified liberal bloc was also fractured.

    Hemingway wrote that Kagan, an Obama appointee, angrily confronted Breyer, a Clinton appointee, in May 2022 behind closed doors after at least one justice, Samuel Alito, had asked his liberal colleagues to speed up writing their dissent because of security threats. Breyer was most likely to agree to Alito’s request, Hemingway wrote.

    “Though he had not said he would accommodate the justices whose lives were at risk by getting out a dissent, [Breyer] was the member of the liberal bloc most willing to do so,” Hemingway wrote. “Fiercely liberal in his jurisprudence and in strong disagreement with the majority decision, he nevertheless was a gentleman and a friend to all on the Court. Kagan remonstrated with Breyer not to accommodate the majority, screaming so loudly, observers noted, that the ‘wall was shaking.’”

    Fox News Digital reached out to representatives for Breyer as well as the Supreme Court’s press office for comment on the book.

    The security threats at the time were severe, as protesters who supported access to abortion frequently showed up at conservative justices’ homes. Shortly after the leak, Attorney General Merrick Garland ordered the U.S. Marshals Service to provide full-time security for all the justices, but he drew criticism because authorities did not arrest protesters despite a law that prohibits “picketing or parading” near a federal judge’s home to influence a court decision.

    In June 2022, before the Supreme Court issued its decision, a suspect armed with a pistol, knife and burglary tools was arrested near Justice Brett Kavanaugh’s home. Nicholas Roske, who now goes by Sophie, later pleaded guilty to attempting to murder a Supreme Court justice and received a controversial sentence of eight years in prison, which the Department of Justice is appealing.

    “As the protests continued, the Alitos were moved to a secure location,” Hemingway wrote. “Justice Barrett had to put on a bulletproof vest in front of her children, most of whom still lived at home.”

    Kagan’s contentious interaction with Breyer, who was set to retire in June 2022, came after a May 12 conference meeting, according to the book. Only the nine justices attend conference meetings, which are held periodically. Hemingway, who wrote the book based on interviews with the justices and dozens of others, said at this point the majority opinion had been ready for months and only the dissents were outstanding.

    Hemingway did not name the justices she interviewed because they spoke on background, but she told Fox News Digital she spoke with most of them.

    “Alito asked the dissenters to make the completion of their dissents their priority because delay of the decision was a security threat,” Hemingway wrote. “Abortion supporters had an incentive to kill one or more of the justices in the majority to change the outcome. The dissenters demurred. [Justice Neil] Gorsuch spoke up, asking for a date by which they might be done. They would not give a date.”

    The landmark opinion, overturning Roe 5-4 and upholding a Mississippi law 6-3 that banned most abortions after 15 weeks of pregnancy, was released June 24, 2022. An investigative report by the New York Times detailed an internal effort spearheaded by Chief Justice John Roberts, the lone conservative to object to dismantling Roe, and Breyer to flip one conservative in the months leading up to the decision. Breyer had been eyeing Justice Brett Kavanaugh, the outlet reported.

    Hemingway’s book sheds new light on those internal deliberations, which came against the backdrop of heightened polarization over the decades-long fight over Roe.

    “Everyone knew that the leak posed a serious security risk for justices. Since decisions do not take effect until issued officially from the bench, the death of a justice before then could alter the result. The threat of assassination increased dramatically.”

    The Supreme Court’s draft opinion, authored by Alito, was published May 2 in Politico, representing a stunning breach of the high court’s rules. The leaker’s identity remains unknown to this day.

    “In the ensuing weeks, hundreds of pregnancy centers, churches, and pro-life organizations would be vandalized, some even set ablaze,” Hemingway wrote of the fallout.

    An interesting result of President Donald Trump’s strange and mostly one-sided feud with the pope is that there is something of a debate, through the lens of Catholic theology, about whether the US and Israel’s war on Iran is a “just war.”

    Without restating the minutiae of Trump’s direct attacks on Pope Leo XIV and Leo’s discussion of whether God listens to the prayers of those who make war, suffice to say they are at odds.

    Vance invites a conversation

    “I like that the pope is an advocate for peace, I think that’s certainly one of his roles,” said Vice President JD Vance during an appearance at a Turning Point USA event at the University of Georgia this week.

    Rather than attacking the pope, Vance said that he likes for the pope to talk about “matters of war and peace” because “at the very least, it invites a conversation.”

    It is an after-the-fact conversation because rather than make a public case for war and build international support, the US launched attacks on Iran while nuclear talks were ongoing.

    Vance, a convert to Catholicism, has a book coming out on his faith journey. He also met last year with Pope Leo and said he likes the man.

    But, “How can you say that God is never on the side of those who wield the sword?” Vance said at the University of Georgia event. “Was God on the side of the Americans who liberated France from the Nazis? Was God on the side of the Americans who liberated Holocaust camps… ?”

    Vance, in between being heckled by an audience member, added this:

    “When the pope says that God is never on the side of those who wield the sword — there is more than a thousand-year tradition of just war theory, OK? Now we can of course have disagreements about whether this or that conflict is just, but I think that it’s important in the same way that it’s important for the vice president of the United States to be careful when I talk about matters of public policy, I think it’s very, very important for the pope to be careful when he talks about matters of theology.”

    Vance has been criticized for the last part of that quote — presuming to tell a pope to be careful about theology — but the comment needs its full context.

    It’s also worth noting here that the concept of just war theory has undergone a lot of changes in the intervening thousand years, but it traces back to St. Augustine. Pope Leo comes from the Augustinian order and likely knows a bit about this.

    Other Republicans have echoed what Vance said about just war theory.

    House Speaker Mike Johnson, an evangelical Christian, implied the war on Iran is a “just war.”

    “It is a very well-settled matter of Christian theology. There’s something called the just war doctrine,” Johnson said. “There’s a time to every purpose under heaven. I think what the president’s comments, what the vice president’s comments, reflect is their understanding, deep in the SCIF and the classified briefings, of the stakes that are so high in the situation that we’re facing,” Johnson said.

    The US Conference of Catholic Bishops takes a different view of whether the war is just, and it issued a clarification of Pope Leo’s comments Wednesday.

    “For over a thousand years, the Catholic Church has taught just war theory, and it is that long tradition the Holy Father carefully references in his comments on war,” according to the bishops’ statement.

    The bishops added:

    “A constant tenet of that thousand-year tradition is a nation can only legitimately take up the sword ‘in self-defense, once all peace efforts have failed’ … That is, to be a just war it must be a defense against another who actively wages war, which is what the Holy Father actually said: ‘He does not listen to the prayers of those who wage war.’”

    The Trump administration has made a point of distancing the US military from the concept of “defense.” It has added “Department of War” as the secondary name of the Pentagon, changing signs and business cards to lean in to the concept of “warfighting.”

    Trump and Secretary of Defense Pete Hegseth, who goes by the secondary title of secretary of war, said they made the change to hark back to an era when the US won wars.

    So there is something definitely offensive — as in the opposite of defensive — about how they have used the US military.

    The ‘proportionality’ requirement

    CNN’s Vatican Correspondent Christopher Lamb wrote about how Leo, the first American pope, has become increasingly vocal about the perils of war.

    He noted that the Vatican has pointed out that a key principle of just war theory is the idea of “proportionality” — that the destruction caused by military action does not outweigh the good that is intended.

    Cardinal Blase Cupich, archbishop of Chicago, told CNN’s Christiane Amanpour it was a bit shocking to hear Vance equate US involvement in World War II with the US and Israel’s war with Iran, which he said is a “war of choice.”

    When Amanpour asked whether the war on Iran is a “just war,” Cupich said, “No, it is not just.”

    A four-part test

    The US Conference of Catholic Bishops linked to excerpts of the Catechism of the Catholic Church regarding “Safeguarding Peace” in its statement. The excerpts set out four conditions for “legitimate defense by military force” under “just war doctrine.”

    They include:

    • the damage inflicted by the aggressor on the nation or community of nations must be lasting, grave, and certain;
    • all other means of putting an end to it must have been shown to be impractical or ineffective;
    • there must be serious prospects of success;
    • the use of arms must not produce evils and disorders graver than the evil to be eliminated. The power of modern means of destruction weighs very heavily in evaluating this condition.

    Just war in an era of weapons of mass destruction

    Cupich referenced those conditions when he said modern weapons affect societies and endanger civilians in horrible ways. And he argued the Trump administration has not been clear about its ultimate objective.

    “We’ve seen so many comments about this particular war in which the objective is not clearly defined, because it jumps from one topic to the other,” Cupich said.

    The most commonly stated reason for the war from the Trump administration is that it was to keep Iran from obtaining nuclear weapons. Iran claimed its nuclear program was peaceful and for nuclear energy.

    Obama’s definition at his peace prize acceptance

    For another thoughtful view of what constitutes a “just war,” take a look at the speech then-President Barack Obama gave in Oslo, Norway, upon receiving the Nobel Peace Prize in the first year of his presidency.

    Obama laid out the importance of world order and the laws of war, concepts Trump and Hegseth have generally rejected. Hegseth, for instance, brags about throwing out rules of engagement in order to more effectively fight wars. Trump has complained repeatedly about the United Nations and threatened to pull the US out of NATO.

    Obama also said religion should be left out of war, sounding very different from the Bible-quoting Hegseth, who has a symbol tied to the Crusades tattooed on his body.

    OBAMA:“…The cruelties of the Crusades are amply recorded. But they remind us that no Holy War can ever be a just war. For if you truly believe that you are carrying out divine will, then there is no need for restraint — no need to spare the pregnant mother, or the medic, or the Red Cross worker, or even a person of one’s own faith. Such a warped view of religion is not just incompatible with the concept of peace, but I believe it’s incompatible with the very purpose of faith — for the one rule that lies at the heart of every major religion is that we do unto others as we would have them do unto us.”

    Obama also noted the oddity of receiving that award as commander in chief of the US military at a time when the US was mired in wars in Iraq and Afghanistan. The incongruity would only get more awkward as Obama frequently utilized the US military while in office and utilized drones to kill people — without, critics said, due process. At the same time, instead of waging war on Iran, he reached a deal to contain its nuclear program.

    Trump signs executive order to research psychedelics, including ibogaine, for mental health treatment

    President Trump has signed an executive order to ease research restrictions on psychedelics, including the drug ibogaine, which is used in some countries to treat post-traumatic stress disorder.

    Health officials, including Health and Human Services Secretary Robert F. Kennedy Jr., and podcaster Joe Rogan joined Mr. Trump in the Oval Office for the signing Saturday.

    Mr. Trump said the order will “dramatically accelerate access to new medical research and treatments based on psychedelic drugs,” which he said have shown “life-changing potential.”

    Mr. Trump said that the federal government will make a $50 million research investment into psychedelic research. He said the federal government was also opening a pathway for ibogaine to be administered to “desperately ill patients” under the Food and Drug Administration’s Right To Try rule.

    “Everybody is so strongly in favor of this. It’s for a lot of people, but it’s for our veterans in particular,” Mr. Trump said, highlighting veteran suicide rates.

    “If these turn out to be as good as people are saying it’s going to have a tremendous impact on this country and in other countries too,” Mr. Trump added.

    Food and Drug Administration commissioner Marty Makary said that three psychedelics would be added to the National Priority Voucher pilot program, which is a pathway meant to dramatically reduce review times for drug and biological products that align with U.S. national health priorities. The FDA will also begin the process to allow for researchers to conduct human trials into ibogaine’s use, he said.

    “This is an unmet public health need and there are potentially promising treatments,” Makary said. “That’s why there is a sense of urgency around this.”

    CBS News first reported that Mr. Trump was expected to sign the order earlier this week.

    Ibogaine is a naturally occurring compound found in a shrub native to Africa. It has been used to treat depression, anxiety, addiction, post-traumatic stress disorder and brain trauma. Researchers say ibogaine could eventually fill a gap in addiction treatment, particularly for opioid dependence, but more large-scale clinical trials are needed before it can be considered safe or effective for any condition.

    The scientific evidence behind the drug so far consists mostly of small observational studies and open-label trials. Only one double-blind, placebo-controlled randomized clinical trial has been completed. More advanced trials have been started recently, and Texas Gov. Greg Abbott signed a bill approving $50 million for research last year. It is unclear how the federal government will help facilitate further research. Sources told CBS News that strategies were still being hammered out in internal discussions this week.

    As a Schedule I substance, ibogaine is currently grouped by the Drug Enforcement Administration alongside substances including heroin and ecstacy. Americans have traveled to unregulated clinics, often in Mexico or the Caribbean, to take the drug. Studies show that ibogaine can cause dangerous heart rhythm disturbances, which can be fatal. A 2023 review of 24 studies including 705 people called the risk of death from heart problems “worrying,” and showed that at least 27 people have died after taking ibogaine.

    建屋发展局星期六(4月18日)宣布,为后港、大巴窑、蔡厝港、武吉巴督等17个邻里,展开邻区更新计划(Neighbourhood Renewal Programme)。

    实龙岗一带的部分邻里也纳入本轮计划,涵盖建于1997年至1999年的实龙岗2道,以及实龙岗中通道的第232A、234A、236A、238A,以及第255至258座组屋。

    “当局也可增设更多连接组屋与周边设施的有盖走道,让居民,尤其是年长者出行更方便。”

    另一方面,建屋局也在第三轮乐龄翻新计划(Silver Upgrading Programme)下,选出宏茂桥、红山及女皇镇10个邻里进行翻新。

    其中,宏茂桥一带同时涉及两项计划:宏茂桥31街及32街一带组屋进行邻区更新,毗邻的宏茂桥1道第330座至337座组屋,则展开乐龄翻新计划。

    住在宏茂桥32街第350座组屋的林林忠(68岁,退休人士)在当地居住超过40年。他说,这批组屋虽属1999年搬入的重建单位,在区内算较新,但经过20多年,也逐渐显现老化迹象。

    他支持翻新计划,并认为附近组屋同步进行邻区更新,有助整体规划与衔接,让居民的生活环境更便利、完善。

    30岁的王家苓(仓库行政人员),在宏茂桥第353座组屋住了约20年。她说,随着区内年长者增加,应优先改善道路和步行通道设计。

    她也指出,居民已习惯现有生活环境,翻新应避免大幅改动,并多听取居民意见,确保各项改善确实提升便利,而不是“为了翻新而翻新”。

    退休者钟建波(72岁)则强调,组屋底层空间对年长者十分重要,希望翻新后相关设施不会减少。

    他住在宏茂桥第337座组屋已超过40年。他说:“楼下通风凉爽,方便邻里交流,每天都有很多人在这里聊天。很多人从巴刹走回来累了,会在这里坐一坐,这对长者很重要。”

    (北京讯)中国军队掀起反腐风暴,一份官方报告首度披露,包括五名上将在内的九名解放军高级将领,从公众视野中消失许久的原因是“涉嫌严重违纪违法”。另有三名军工央企高管也被指“涉嫌违纪违法”。

    中国全国人大常委会星期五(4月17日)公布今年第二号公报。根据这份公报中的报告,陆军原司令员李桥铭、海军原司令员沈金龙、海军原政委秦生祥、空军原政委于忠福、信息支援部队原政委李伟,这五名解放军上将全部涉嫌严重违纪违法,因此在今年2月被罢免全国人大代表职务。

    同样在2月被罢免全国人代职务的,还有中将、中央军委国防动员部政委王东海,三名少将中央军委政治工作部主任助理边瑞峰、陆军第73集团军军长丁来富和火箭军第64基地司令员杨光。他们也被指“涉嫌严重违纪违法”。

    报告还首次公开,沈金龙和杨光二人的最后职务分别是中共中央军委战略规划委员会专职委员和湖北省军区正职副司令员。

    报告同时披露,中国航空工业集团原董事长周新民、中核集团原总工程师罗琦和中国工程物理研究院原院长刘仓理,因涉嫌违纪违法,在2月被罢免全国人大代表职务。三人此前同样已缺席重要场合或因不明原因去职。
