    President Donald Trump has considered the possibility that conservative Justice Samuel Alito might step down later this year, giving him the ability to nominate a fourth justice to the Supreme Court.

    Trump said he has a list of potential candidates in mind if a seat opens on the nine-justice bench this year. And when asked about the importance of the possibility of Alito stepping down while Republicans are in control of the Senate, Trump pointed to how Justice Ruth Bader Ginsburg’s death in 2020 shifted the court.

    “Ginsburg could not do it, and she really hurt herself within the Democrat Party,” Trump told Fox Business’ Maria Bartiromo in an interview that aired on Wednesday. “People are very angry at her, because I got to appoint people instead of Biden.”

    Trump was referencing Ginsburg’s decision to remain on the court during the Obama administration. When Ginsburg died in September 2020 at the age of 87, the vacancy allowed Trump to quickly nominate and the GOP-led Senate to confirm Justice Amy Coney Barrett – solidifying a 6-3 conservative majority.

    “She decided that she was going to live forever, and about two minutes after the election, she went out, and I got to appoint somebody,” Trump said.

    Trump said he didn’t know whether Alito or Justice Clarence Thomas would actually step down. Supreme Court justices are appointed for life, and their decisions about retirement are often personal and shrouded in secrecy. Neither justice has indicated their plans.

    Alito did not respond to a request for comment.

    Alito, 76, is the second-oldest justice on the court next to Thomas, 77 – another reliable conservative. There’s been speculation for months over whether Alito will retire in time for Trump to appoint a replacement and for a Republican Senate to confirm a new justice to guarantee the seat is not blocked by Democrats and filled by a potential Democratic president in 2029.

    Trump said on Wednesday he didn’t know whether there would be a vacancy by the end of the year but that Alito was in “very good physical health.” CNN reported this month that Alito was taken to a hospital after becoming ill recently at a dinner in Philadelphia. The court said Alito was treated for dehydration and he has been active participant in oral arguments since then.

    “Justice Alito is an unbelievable justice and a brilliant judge as justice, and he gets the country, you know, he does what’s right for the country,” Trump said.

    Trump named three justices to the Supreme Court during his first term – Neil Gorsuch, Brett Kavanaugh and Barrett. The 6-3 conservative-liberal balance of the court would not likely change if Trump had an opportunity to replace Alito or Thomas, but it would allow the president to appoint someone with their ideology who presumably would be on the bench for generations. Both have been frequent votes in favor of Trump’s policies on immigration, transgender issues and executive power.

    Both Alito and Thomas, for instance, dissented from the court’s decision in February that shut down Trump’s emergency global tariffs – a decision that has prompted fiery recriminations from the president ever since. Two of his nominees – Kavanaugh and Barrett – supported that ruling.

    In the interview Wednesday, Trump repeated his criticism of the court’s conservative majority even though those justices have handed the president a series of high-profile wins in recent years on the emergency docket and in major merits appeals, including the decision to grant former presidents immunity from criminal prosecution for official actions.

    “And the liberals do stick together. There’s one thing about those justices, they stick together like glue, not like the Republicans,” he said.

Four years ago, Alito drew national attention for writing the majority opinion in Dobbs v. Jackson Women’s Health Organization that overturned decades-long precedent establishing the right to have an abortion called Roe v. Wade.

    The Supreme Court is turning to its busiest time of the year, with the justices drafting decisions in the most significant cases of the term – many of which involve Trump’s policies. The court is currently considering Trump’s power to fire the leaders of independent agencies, including the Federal Reserve, as well as his effort to end automatic birthright citizenship.

    Washington — A key surveillance authority, the spy tool known as Section 702 of the Foreign Intelligence Surveillance Act, faces major obstacles in the House ahead of its expiration next Monday.

    Proponents of its renewal stress that it’s imperative that the surveillance tool not be allowed to lapse as the war with Iran continues. National security officials have long argued Section 702 is essential for preventing terrorist attacks. But opponents from both parties worry that it allows federal authorities to look at Americans’ communications without a search warrant.

    House GOP leaders pushed off a floor vote until days before the April 20 deadline as several factions in the lower chamber oppose its renewal without additional reforms, making its passage uncertain.

    Section 702 was last renewed for two years in 2024 after a series of abuses by the FBI led it to the brink of expiration. The provision was first authorized in 2008 and allows the government to collect the communications of noncitizens located outside the U.S. without a warrant, though it can also sweep up the data of Americans who are in contact with targeted foreigners.

    The Trump administration is pushing an 18-month reauthorization of the law without any changes. President Trump on Tuesday urged Republican unity to help propel the clean extension through a party-line procedural vote that was initially expected Wednesday.

    The president met with some skeptical GOP lawmakers Tuesday night. A White House official told CBS News it was a “productive discussion and we look forward to additional conversations.” CIA Director John Ratcliffe attended a House Republican Conference meeting Wednesday morning as the administration continues to advocate for a clean renewal.

    GOP Rep. Andy Harris of Maryland, the chairman of the conservative House Freedom Caucus, said he expects the procedural vote to fail.

    “If it’s clean … it doesn’t have the votes,” Harris said Tuesday.

    House Speaker Mike Johnson, a Louisiana Republican, said Tuesday that amendment votes would not be allowed because “it jeopardizes its passage.”

    “It’s far too important right now,” Johnson said.

    But Johnson appeared open to an extension shorter than 18 months, telling reporters “the timing is not as important to me.”

    Mr. Trump’s request came hours before a House Rules Committee meeting, where GOP Rep. Jim Jordan of Ohio, the chairman of the House Judiciary Committee who was once a leading voice for FISA reforms, defended a clean extension. Jordan said the dozens of reforms that were enacted in 2024 have cut down drastically on abuses.

    “It’s a different program today,” Jordan said, pointing to the reforms that included more oversight of FBI queries and approval requirements before running a query on a U.S. citizen.

    Conservatives on the Rules Committee ultimately allowed the measure to advance out of the committee late Tuesday, teeing it up for floor consideration.

    The renewal still faces opposition from members on both sides of the aisle who have cited a number of reasons that they cannot support it, with warrantless surveillance of Americans at the top of the list. GOP Rep. Lauren Boebert’s stance on the renewal is “warrants or bust” — she and other lawmakers are calling for judicial warrants if intelligence officials want to search Americans’ messages.

    Ratcliffe told the House Intelligence Committee during a March hearing that “some reforms” of the law “should be considered,” but “a warrant isn’t one of them.”

    “A warrant won’t work,” Ratcliffe said. “You have to make decisions very quickly, and sometimes in a matter of hours.”

    Some Democrats are also hesitant to renew the statute without additional guardrails on the Trump administration. Rep. Jamie Raskin of Maryland, the top Democrat on the House Judiciary Committee, said Tuesday that it would be “moronic” to trust the Trump administration to uphold the law as intended and he would not vote to renew it without reforms.

    Republican Rep. Anna Paulina Luna of Florida has called for an elections-related bill known as the SAVE America Act to be attached to the reauthorization to gain her support.

    Lawmakers across the political spectrum also want to prohibit intelligence agencies from purchasing Americans’ data from third-party brokers without a warrant. Rep. Jim Himes of Connecticut, the top Democrat of the House Intelligence Committee, said Tuesday that the issue is “really important” for Congress to debate, but said it “has absolutely nothing to do with FISA 702.”

    “FISA 702 does not authorize any purchase of any commercially available data,” he said.

    Himes added that it was critical for Congress to reauthorize the program, which he said was the “most important intelligence authority.”

    “There is simply no alternative to Section 702 and allowing it to expire would be devastating,” he said.

    President Donald Trump’s pick to lead the Federal Reserve is headed to the Senate next week, but Trump is worried that one Senate Republican could doom the confirmation process.

    Kevin Warsh is scheduled for his confirmation hearing before the Senate Banking Committee after his initial hearing set for this week was canceled. But his odds of moving to the next — and final — step of the process are low, given that Sen. Thom Tillis, R-N.C., plans to block him.

    And Trump isn’t happy about it.

    When asked by Fox Business’ Maria Bartiromo about Warsh’s chances in the Senate, Trump said, “We’re going to have to find out.”

    “He might not, but that’s why Thom Tillis is no longer a senator,” Trump said. “He quit.”

    Tillis, despite announcing plans to retire from Congress at the end of his term this year, is still an active U.S. Senator and would have full voting rights if Warsh’s confirmation comes up for a vote before January 2027.

    Fox News Digital reached out to Tillis’ office for comment on the president’s latest comments.

    The North Carolina senator has repeatedly clashed with the Trump administration ever since Tillis bucked his fellow Republicans in their pursuit of steep Medicaid cuts last year during the creation of the “One Big Beautiful Bill.”

    That rebellious streak has continued as the Department of Justice probe into current Federal Reserve Chair Jerome Powell has progressed.

    Tillis’ beef isn’t with Warsh specifically — a point he has reiterated on several occasions — but with the DOJ’s investigation into Powell’s testimony last year about the Fed’s renovation of its two historic main buildings on the National Mall.

    “I love the candidate. I won’t spend my five minutes in committee asking him about his credentials, because he has them,” Tillis said. “I’ll spend five minutes talking about a bogus investigation that’s going to cause me to vote no, unless they end the investigation.”

    “There’s no way to sugarcoat this,” he continued. “There’s one way out of the box, canyon, and they’ve got to decide whether or not they’re going to do it.”

    Prosecutors from U.S. District Attorney Jeanine Pirro’s office reportedly visited the Federal Reserve’s headquarters unannounced on Tuesday.

    Senate Majority Leader John Thune, R-S.D., has spoken with the White House about halting the investigation.

    “I think, at some point, they’re gonna have to deal with the committee, they’re gonna have to deal with Tillis,” Thune said. “And I think it’s in everybody’s best interest to wrap up the investigation.”

    Meanwhile, given the uncertainty surrounding his predecessor, Powell said he would stay on temporarily until a replacement is confirmed. But Trump said he would fire Powell if he wasn’t out by next month.

    Trump charged that Tillis wouldn’t “want the legacy of stopping a great person who could be great.”

    “I think Kevin Warsh is going to be great. He doesn’t want the legacy of having an incompetent guy stay there for longer than is necessary,” Trump said. “I know Thom Tillis. He’s a good man. I don’t think he’s going to hurt — I know he said what he said, and maybe it’s true, in which case I’ll have to live with it.”

    Tillis is working to make sure that, until the investigation is dropped, there’s no way Warsh makes it out of committee.

    “I don’t think there’s any mechanism where he gets reported out of committee, but I’m already working to make sure votes will be held on the floor until we have a definitive answer,” he said.

    At one of the United States’ best-known Catholic institutions, students were siding with Pope Leo XIV over President Donald Trump in the wake of Trump’s clash with the pontiff over the Iran war and raising concerns about his recent social media post seemingly depicting himself as Jesus.

    “I found it incredibly disrespectful — especially the AI image of him portraying himself as Jesus,” said Sarah Jones, an undergraduate student from North Carolina who considers herself a moderate independent.

    Jones said it was “weird” that Trump deleted the post and claimed he thought the image portrayed him as a doctor. Even stranger, she said, was Trump targeting Pope Leo “just for being for peace.” Just weeks ago, Jones noted, the president had praised Notre Dame as he mourned the Catholic university’s legendary football coach, Lou Holtz, who was an outspoken Trump supporter.

    “It’s a complete 180,” she said. “What is going on in your head that would make you say these things, or like, do any of this?”

    Trump has clashed in recent days with Pope Leo who has become increasingly vocal in criticizing the administration’s approach to the war with Iran — bringing bipartisan condemnation in the United States and even prompting Iran to come to the pontiff’s defense. Similarly, in more than a dozen interviews on Notre Dame’s campus this week, Catholics in both parties expressed surprise and dismay at seeing the president treat the pope like a political rival.

    The feud began on Sunday when Trump called Leo “weak on crime” and “terrible for foreign policy,” and took credit for Leo’s selection as the first American pontiff.

    “Leo should get his act together as Pope, use Common Sense, stop catering to the Radical Left, and focus on being a Great Pope, not a Politician,” he wrote on social media.

    The pope responded that he had “no fear of the Trump administration” and said he would continue to advocate for peace.

    A key voting bloc

    Catholics make up perhaps the largest swing voting bloc in the country, comprising between one-fourth and one-fifth of the electorate in recent presidential elections.

    Trump won 59% of Catholics, compared to 39% for former Vice President Kamala Harris, in the 2024 presidential election, CNN’s exit poll found. It was a huge shift from former President Joe Biden — himself a Catholic — narrowly winning Catholics, 52% to Trump’s 47%, in the 2020 election, according to CNN’s exit poll.

    Catholics are a large share of the electorate in two presidential swing states, Pennsylvania and Wisconsin. And they are also a pivotal group in some battleground congressional districts — particularly Latino-heavy districts throughout the Southwest that will play an important role in determining whether Republicans can hold onto their slim majority in November’s midterm elections.

    Broadly, many Catholics have taken issue with Trump’s attacks on Pope Leo. Archbishop Paul S. Coakley, the president of the U.S. Conference of Catholic Bishops, said in a statement he was “disheartened that the President chose to write such disparaging words about the Holy Father.”

    “Pope Leo is not his rival; nor is the Pope a politician. He is the Vicar of Christ who speaks from the truth of the Gospel and for the care of souls,” Coakley said.

    Notre Dame’s president, Rev. Robert A. Dowd, issued a statement Monday in support of Pope Leo, although he did not mention Trump. He said the pope’s message “transcends partisan political divisions in this or any country and I’m deeply grateful for Pope Leo’s inspiring example.”

    Trump has disagreed with popes in the past. Francis, Leo’s predecessor, sharply criticized Trump’s handling of immigration enforcement and Trump responded in turn during a brief spat. But the president’s repeated assailing of the pontiff this week could have a more significant impact with the Catholic community, as Trump simultaneously faces criticism over posting an AI-generated image depicting him as a Christ-like figure.

    While Trump backed down and deleted the post after bipartisan backlash, he’s standing by his dispute with Pope Leo and refused on Monday to apologize to the pontiff.

    “We believe strongly in law and order, and he seemed to have a problem with that, so there’s nothing to apologize for,” he told reporters.

    Vice President JD Vance, who converted to Catholicism in 2019 and met with Pope Leo at the Vatican last May, also poked at the pontiff at a Turning Point USA event in Georgia on Tuesday night, saying Leo should “be careful” when discussing matters of theology and war.

    “How can you say that God is never on the side of those who wield the sword?” Vance said. “Was God on the side of the Americans who liberated France from the Nazis? Was God on the side of the Americans who liberated Holocaust camps and liberated those innocent people from those who had survived the Holocaust? I certainly think the answer is yes.”

    Trump, despite backlash over the imagery he had posted earlier in the week, on Wednesday posted another image on Truth Social— this one depicting Jesus with his arms around Trump’s shoulders. Included with it was another social media user’s comment that “God might be playing his Trump card!”

    In his post, Trump said: “The Radical Left Lunatics might not like this, but I think it is quite nice!!!”

    ‘Textbook blasphemy’

    At Notre Dame, even conservatives took issue with Trump’s actions this week.

    The Notre Dame College Republicans — who in the past had criticized some of Pope Leo’s comments about the war with Iran — lambasted Trump’s attack on the pontiff, saying that the president’s post “was both incoherent and imprudent.”

    However, the College Republicans said: “The Trump Administration has badly miscalculated with the war in Iran, which was not in American interests. The Pope is right to push for peace and we support him in this endeavor.”

    Lochlan Shinnick, an undergraduate student from California who said he is conservative, said the image Trump posted of himself him as a Christ-like figure could be considered “textbook blasphemy.”

    On campus, he said, “there’s a lot of charged opinions about it, which a lot of people here have, and I think I kind of echo some of those, which is definitely that he shouldn’t have done it.”

    He said he’s heard others defend Trump, arguing his social media is “comedic.” However, he said one friend who is a Trump supporter told him he finds it hard to defend Trump after those posts.

    “I don’t think it’s like entirely black or white, because I don’t believe that Catholicism can be grafted to a certain political ideology,” Shinnick said.

    Trump’s ‘true colors’?

    Brendan Franklin, a 27-year-old insurance salesman who graduated from nearby Holy Cross College and visits the Notre Dame campus to pray at the Grotto of Our Lady of Lourdes, said he hadn’t seem the meme Trump posted.

    But when CNN showed it to him, Franklin said: “I think that’s kind of pushing it too far.”

    “I think he’s just maybe trying to be too powerful,” he said. “I feel like it’s kind of wrong to do that, honestly.”

    Nick Bifone, a senior from New York who said he considers himself an independent, said he didn’t believe Trump’s claim he thought he was being portrayed as a doctor.

    He said he believes Catholics tend to align with Republicans, but “in this instance, you kind of see a separation of that.”

    “I kind of align with the pope, I t hink,” Bifone said. “Especially because I feel like also, the pope always argues for peace.”

    Trump won nearly half of independent voters in 2024, but recent approval polls have shown his support collapsing with the group: only 26% approved of his job performance, while 73% disapproved, a CNN poll conducted by SSRS in late March found.

    Sarah Williams, an undergraduate student from Connecticut who said she is an independent but has not supported Trump in the past, said the president’s attacks on Pope Leo reminded her of a 2018 commencement address in which actress Mindy Kaling told Dartmouth College students that “you have to have insane confidence in yourself.”

    Trump, she said, “is sort of a testament to how far you can get by just believing in yourself.”

    “And I think some of his more recent actions, particularly with the pope, have helped show his true colors to people,” she said.
