    WASHINGTON, April 2 (Reuters) – Federal funding ​for the U.S. Department of Homeland Security remained ‌in limbo on Thursday despite the Senate clearing the way for the House of Representatives to pass legislation that would end a nearly seven-week ​partial shutdown.

    The measure provides no additional funding for ​immigration law enforcement activities that already are robustly ⁠funded.

    The House held a brief session without acting upon the ​legislation that was passed by the Senate late last week.

    The House ​is next scheduled to meet on Monday.

    House Speaker Mike Johnson was scheduled to hold a call with his rank-and-file later on Thursday ​to discuss next steps.

    Senate Majority Leader John Thune, speaking ​to a near-empty chamber, cleared the way for progress on ending ‌the ⁠DHS funding fight by killing a 60-day, stopgap bill that had been passed by the House but had no chance of getting enough support to pass the Senate.

    The Senate ​ignored that ​bill on ⁠Friday and began a recess that telegraphed its opposition to the measure.

    Meantime, Senate and House Republican ​leaders announced on Wednesday that they had ​reached ⁠a deal to finally end the DHS shutdown. But it was unclear whether House Republican rank-and-file would support that agreement.

    House ⁠passage ​of the Senate bill would send ​it to President Donald Trump for signing into law.

    Former National Counterterrorism Center Director Joe Kent — who quit his government role last month over his opposition to the Iran war — suggested in a Wednesday night post on X that President Donald Trump will only be able to declare victory in Iran if he “restrains” Israel.

    “The purpose of POTUS’s speech this evening was to show that we can declare victory when we choose. This is only possible if POTUS restrains the Israelis 1st. Israel needs us committed indefinitely, we are seeking a quick end to the war. We have drastically different goals than Israel & must act accordingly,” Kent asserted in the post.

    Kent made the comments after Trump — who launched the controversial U.S. war against Iran last month in conjunction with Israel — delivered an address to the nation about the ongoing conflict on Wednesday night.

    “Thanks to the progress we’ve made, I can say tonight that we are on track to complete all of America’s military objectives shortly, very shortly. We are going to hit them extremely hard over the next two to three weeks. We are going to bring them back to the stone ages where they belong. In the meantime, discussions are ongoing,” he said.

    “Because of the actions we have taken, we are on the cusp of ending Iran’s sinister threat to America and the world. And I’ll tell you, the world is watching.     When Chief Justice John Roberts and the eight associate justices took the Supreme Court bench on Wednesday for a fundamental debate over American identity, they did not acknowledge the presence of Donald Trump in the courtroom.

    That was not unexpected: Wednesday marked the first time in modern history that the president of the United States attended an oral argument. But Trump was there as a litigant and spectator, not in any formal role.

    Then, in a move that was surprising, Roberts showed his hand.

    The chief justice can be cagey during arguments. In high-profile cases, he often sends mixed signals and keeps his options open.

    But during the momentous session, Roberts made plain his skepticism for the Trump position that would upend more than a century of constitutional history and tradition. The chief justice cast doubt on the Trump administration’s alternative view of the reach of the 14th Amendment’s birthright citizenship guarantee.

    Roberts particularly dismissed US Solicitor General John Sauer’s contention that contemporary immigration problems require a revision of the understanding that virtually all children born on US soil become American citizens, irrespective of their parents’ immigration status.

    Echoing Trump assertions, Sauer argued that “a sprawling industry of birth tourism” has led to “uncounted thousands of foreigners from potentially hostile nations” arriving in the US to have their children here.

    “We’re in a new world now,” Sauer told Roberts, “where 8 billion people are one plane ride away from having a child who’s a US citizen.”

    “Well, it’s a new world,” Roberts rejoined. “It’s the same Constitution.”

    The tone was especially biting for a chief justice known for his measured public comments. He was aware that the case was drawing inordinate interest. Television and radio networks aired the arguments live. All the courtroom seats, and extra chairs in the alcoves, were filled. Among the people in a special section reserved for spouses and guests of the nine justices was actor Robert De Niro, a Trump critic.

    All told, over more than two hours of arguments, there appeared to be no majority among the justices to reinterpret the established view of the 14th Amendment, which dictates, “all persons born or naturalized in the United Sates, and subject to the jurisdiction thereof, are citizens of the United States.” Historically, only a few, specific categories of children were exempt, such as those born to foreign ambassadors or invading armies.

    Appealing the widespread sentiment of lower court judges against the administration, Sauer latched onto the phrase “subject to the jurisdiction” and contended that anyone on US soil unlawfully or temporarily, such as on a student visa, is not sufficiently subject to US jurisdiction.

    Roberts and other key conservative justices challenged that constitutional rationale as well as the practicalities of a position that would require delving into children’s parentage.

    “What would you do with what the common law called ‘foundlings,’” asked Justice Amy Coney Barrett. “The thing about this is then you have to adjudicate, if you’re looking at parents and if you’re looking at parents’ domicile, then you have to adjudicate both residence and intent to stay. What if you don’t know who the parents are?” (A concern for children who might be abandoned at birth arose in some of the religiously tinged briefs submitted in the case.)

    “I think there are marginal cases,” Sauer said, as Barrett posed a series of difficult hypothetical scenarios.

    Shifting around and leaving early

    Trump’s presence on Wednesday lent him little special deference, from his seat in the courtroom to the apparent consensus on the bench.

    When Trump arrived, about 10 minutes before the session was to begin, he was quietly escorted to the public section of the courtroom, behind the area reserved for members of the Supreme Court bar. Trump and his entourage, which included Attorney General Pam Bondi and Commerce Secretary Howard Lutnick, were seated in the first row of the general public section. The courtroom is typically hushed, but spectators began buzzing and craned their necks as Trump, in a dark suit and signature red tie, took his place.

    He wasn’t quite settled. He switched seats, from one end of the row, to the other, perhaps for a better view of the bench. As he waited for the session to begin, Trump looked around, seemingly taking in the elaborate setting, with its ornate rosette-patterned ceiling and intricate marble friezes of Moses, Solomon and other depicted “great lawgivers of history.”

    Trump’s policies and personal conduct have been subject to major lawsuits since his first term in office, beginning with Trump v. Hawaii, early in his first term, involving his travel ban on certain majority-Muslim countries; Trump v. United States, testing his personal claim of immunity from criminal prosecution; then Trump v. Casa, regarding when lower court judges can issue wide-reaching injunctions against his challenged policies. (Trump won those cases.)

    He did not witness any of those oral arguments, and while Trump had declared last November that he would attend the dispute over his sweeping tariffs on foreign goods, he decided against it at the last minute. (Trump lost that case.)

    It was after February’s tariff decision that Trump fired off another set of public denunciations against the justices. “I’m ashamed of certain members of the court, absolutely ashamed for not having the courage to do what’s right for the country.”

    Regarding Barrett and Justice Neil Gorsuch, two of his appointees who voted with the majority against him, Trump said they were an “embarrassment to their families.”

    The birthright citizenship case may mean even more to Trump. He signed the order limiting the right on his first day back in office, in January 2025, and his presence at the court demonstrated his commitment to it.

    The order represents the boldest move of his anti-immigrant agenda, striking at the core of American identity and recalling the era of Dred Scott v. Sandford, the infamous 1857 ruling that said Black people could not be citizens.

    Trump remained in his seat for all of Sauer’s presentation, which lasted just over an hour. He then stayed for an early portion of the arguments by lawyer Cecillia Wang, of the American Civil Liberties Union, representing the challengers.

    About seven minutes in, Trump abruptly stood up and began heading out of the courtroom. The justices continued addressing Wang and did not appear distracted.

    Debate over ‘domiciled’

    Before he left, Trump would have heard Roberts’ opening question to Wang, which involved the landmark Supreme Court precedent from 1898, United States v. Wong Kim Ark. In that case, the court found that a man born of Chinese nationals who were living in the US was an American citizen. That decision has long stood as an affirmation of the breadth of the 14th Amendment citizenship guarantee.

    Sauer, however, had argued that an important element of the holding was that Wong Kim Ark’s parents were essentially permanent residents of the United States, that is, “domiciled,” or subject to the jurisdiction of the US. Sauer differentiated the situation to that of today’s temporary residents or people living in the US unlawfully.

    Roberts followed up on that line of argument with Wang.

    “We’ve heard a lot of talk about Wong Kim Ark, and you dismiss the use of the word ‘domicile’ in it,” Roberts began. “It appears in the opinion 20 different times and including in the question presented and in the actual legal holding. … Isn’t it at least something to be concerned about to say that since it’s discussed 20 different times and has that significant role in the opinion that you can just dismiss it as irrelevant?”

    Wang urged Roberts and the other justices to consider the majority opinion in its entirety, including to understand the 14th Amendment’s “subject to the jurisdiction” phrasing.

    She said the Wong Kim Ark decision “starts with a premise that in construing the 14th Amendment Citizenship Clause, we look to the English common law. … Under English common law, if you are born in the dominions of the sovereign, you owe natural allegiance, and those who are present in the dominions of the sovereign owe temporary allegiance for as long as they’re present.”

    She acknowledged the few historic exceptions, such as for children of foreign ambassadors, and stressed, “The purpose of the 14th Amendment was to embrace that universal rule of birthright citizenship.”

    Roberts did not go further with Wang, and his apparent satisfaction stood in contrast to his response to Sauer as the solicitor general contended the Trump administration could expand on the specific categories of foreigners exempted from birthright citizenship.

    “You obviously put a lot of weight on ‘subject to the jurisdiction thereof,’ but the examples you give to support that strike me as very quirky,” Roberts told Sauer. “You know, children of ambassadors, children of enemies during a hostile invasion, children on warships. And then you expand it to a whole class of illegal aliens are here in the country.”

    “I’m not quite sure how you can get to that big group from such tiny and sort of idiosyncratic examples,” Roberts added.

    While in the courtroom, Trump was unable to say anything, as spectators are prohibited from bringing in phones or other electronic devices. But about an hour after leaving, he seemed to want the final word.

    He repeated a prior false claim and said in a Truth Social post, “We are the only Country in the World STUPID enough to allow ‘Birthright’ Citizenship!”

    About 30 other countries, in fact, also allow birthright citizenship. Most are in the Western Hemisphere, in North, South, and Central America.

    Hospice where staggering 97% of terminal patients survive is accused of defrauding Medicare for $7.45 million

    The FBI arrested a married couple Thursday accused of fraudulently billing Medicare for $7.45 million while running a hospice with a survival rate reported to be more than 97% after five years. They were the first in a series of arrests planned Thursday, federal officials told CBS News.

    A high survival rate at a hospice provider is one of a series of red flags identified by state auditors for fraud because most people enter hospice care in the final stages of a terminal illness. In past cases of fraud, operators were found to be using false or stolen identities to collect federal reimbursements for palliative care.

    The targets of the early-morning operation were Gladwin and Amelou Gill, a doctor and psychologist who co-own 626 Hospice, which does business as St. Francis Palliative Care, according to the FBI.

    The FBI raid took place in the residential neighborhood of San Dimas, California, as FBI SWAT personnel announced over a loud speaker they have an arrest warrant. CBS News was at the Southern California location when the FBI agents executed the first early morning arrests. Also on the scene was Dr. Mehmet Oz, the Trump-appointed official who oversees the federal medicare system.

    Hospice fraud in California has become a major focus of Republicans in Washington, who have been highlighting the problem in political attacks on prominent Democratic state leaders. Vice President JD Vance was recently placed in charge of an anti-fraud initiative.

    California officials have told CBS News the issue of hospice fraud is a problem nationwide, but that state law enforcement agents have been investigating the issue and conducting their own enforcement actions over the past several years.

    Bill Essayli, United States Attorney for the Central District of California, joined Oz from the scene as the FBI made these arrests. In response to questions about the politics surrounding the fraud issue, Essayli noted Thursday’s law enforcement actions were approved by a federal judge who signed arrest warrants in the case.

    Essayli told CBS News that officials are announcing 15 defendants, with more than half of them accused of hospice fraud. Some of those people are in prison and working with people on the outside to commit the fraud, Essayli said.

    Red flags for fraud in hundreds of hospices

    CBS News has been investigating fraud in the hospice industry in Los Angeles County for months. The investigation examined business and financial records of every hospice currently operating in LA County to identify operators that showed the warning signs that a 2022 state audit identified as potential indicators of fraud.

    Over 700 of the roughly 1,800 hospices in LA County triggered multiple red flags for fraud as defined by the state, the CBS News analysis revealed. Those key warning signs include low patient counts, excessive billing, staff shared across multiple companies, and supposedly terminally ill patients who were later discharged alive.

    Another red flag: multiple hospices clustered in one building, including one office plaza with 89 registered hospices, which patient advocate Sheila Clark called “ground zero” for Medicare hospice fraud.

    Medicare fraud has been an acute issue in Southern California, but it’s a nationwide problem. The Department of Health and Human Services’ Office of the Inspector General reported in 2023 that suspected hospice fraud totaled an estimated $198.1 million. Americans pay into the taxpayer-funded health care for the elderly and disabled through paychecks and premiums.

    Congressional Oversight Committee launches investigation

    Last month, House Republicans announced that Congress mounted an investigation into “rampant hospice fraud,” alleging that tens of millions in taxpayer funds may have been lost in improper payments to Southern California companies. In a letter to Gavin Newsom, California’s Democratic governor, the committee cited the recent CBS News investigation.

    The Republican-led House Oversight Committee, which has the authority to investigate, wrote to Newsom, asking for documents related to the state’s “oversight and internal controls to detect and prevent fraud for its federally funded hospice programs.”

    “Recent reporting has revealed alarming evidence of fraudulent activity in California’s hospice programs, including agencies overbilling Medicare and fraudulently enrolling beneficiaries without their knowledge,” committee members wrote.

    California attorney general’s action to combat hospice fraud

    State attorney general Rob Bonta says his office has brought criminal fraud cases against more than 100 defendants in the hospice industry and has filed about two dozen civil cases. But he acknowledged that more needs to be done.

    “We need to be responsive to the red flags and react to them, not just count them,” said Bonta, a Democrat. “Our main lane is the accountability side, the criminal investigations, the civil investigations. That’s after the damage is done though, unfortunately.”

    A moratorium on issuing new hospice licenses in the state was recently extended through January 2027 because the state missed its deadline to enact new emergency regulations for hospices. Public health officials said they are balancing public feedback to vet new applicants and hold hospices accountable.

    Bonta said multiple agencies are working on a task force to target the problem.

    “So to the citizens that remain frustrated, I understand, I share your frustration, please know that we have increased our efforts,” he said. “We’re working overtime on prevention and accountability, and we will continue until hospice fraud in California is rooted out.”

    As a Homeland Security shutdown drags on, the top Senate Republican says Democrats are getting “zero” of the reforms they demanded.

    Congressional Democrats have taken victory laps, viewing the outcome as a key win in their push for reforms to Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP). They have also accused congressional Republicans of caving to their demands.

    While the Senate’s Department of Homeland Security (DHS) deal includes funding for ICE and much of CBP, it does not include the structural reforms Democrats spent the last 48 days pushing.

    SENATE PASSES BILL TO FUND MOST OF DHS AFTER HOUSE GOP CAVES

    When asked whether Republicans gave in, Senate Majority Leader John Thune, R-S.D., told Fox News’ “America’s Newsroom,” “No, we didn’t cave.”

    “I mean, ultimately, what the Democrats did, you could say … this was all about ‘reforms,’ restrictions on ICE and CBP agents and what they could or couldn’t do,” Thune said. “They got none of that. They got zero of the reforms they were advocating for.”

    Thune was responding to accusations from Senate Minority Leader Chuck Schumer, D-N.Y., who argued that “House Republicans caved” after backing down from their push for a 60-day funding extension for the agency.

    Schumer argued that divisions in the GOP “derailed a bipartisan agreement” and said Democrats were clear in their objectives to “fund critical security, protect Americans, and provide no blank check for reckless ICE and Border Patrol enforcement.”

    “We were united, held the line, and refused to let Republican chaos win,” Schumer said.

    Thune countered, “In the end, this was all about their left-wing base demanding that no funding be provided.”

    “The good news for us is we saw this coming, and we pre-funded this last summer, so ICE and CBP are funded through the end of the fiscal year. Then we’ll add to those accounts and make sure they’re funded in future years,” Thune said.

    Republicans, now with the backing of President Donald Trump, are eyeing the budget reconciliation process to fund immigration enforcement operations for the foreseeable future. It’s a tricky maneuver that would require full buy-in from Senate Republicans.

    Trump lauded Republicans, including Thune and House Speaker Mike Johnson, R-La., who originally torpedoed the Senate deal, for coming together to reopen most of DHS. He also noted that he would soon sign an executive order to pay, “ALL of the incredible employees at the Department of Homeland Security,” which comes as the funding plan currently wouldn’t pay immigration enforcement support staff.

    “Republicans are UNIFIED, and moving forward on a plan that will reload funding for our FANTASTIC Border Patrol and Immigration Enforcement Officers,” Trump said on Truth Social.

    In the meantime, the shutdown is still ongoing. The Senate’s redo of its funding plan Thursday morning sets up another vote in the House, where there is still significant resistance among some hardline Republicans, and the House is not expected to return to Washington, D.C., until April 13.
