Rep. Kevin Kiley leaves GOP, further shrinking Speaker Johnson’s majority

During a news conference, Kiley said he will continue to caucus with House Republicans “for the remainder of this term” but pledged to be “an independent voice.”

Rep. Kevin Kiley (California) said Monday that he is immediately changing his party affiliation on the House’s official roster from Republican to independent, further complicating the ability of Speaker Mike Johnson (R-Louisiana) to manage the Republican Conference. Last week, Kiley said he would seek reelection as an independent.

During a news conference, Kiley said he will continue to caucus with House Republicans “for the remainder of this term” but pledged to be “an independent voice.” It remains to be seen what practical effect his move will have, but it narrows the number of registered Republicans in the chamber to 217. Democrats hold 214 seats, and there are three vacancies. Kiley will be the only independent.

The two-term congressman attributed his decision to redistricting efforts in California, which resulted in his district becoming more blue. Because of redistricting, Rep. Ami Bera (D), who currently represents California’s 6th District, will run for reelection in the 3rd District against Kiley.

“I reached a decision that, since gerrymandering seeks to elevate partisanship above everything else in our politics and governance, seeks to make it the sum and substance of our politics, then the best way to counter gerrymandering and its insidious impacts on democracy is simply to take partisanship out of the equation,” Kiley said.

Kiley, a moderate, has occasionally broken with Johnson on key matters, making him an unreliable vote for a speaker struggling with a razor-thin majority.

Last month, for example, Kiley was among six Republicans who voted with Democrats to end President Donald Trump’s stepped-up tariffs on Canada, rebuking the president in the first of what could be several congressional challenges to his trade policies.

Spokespeople for Johnson did not immediately respond to a request for comment on Kiley’s decision.

Speaking to reporters Monday, Kiley noted that he did not give House GOP leaders a heads-up before ending his party membership.

Though he will be identified as an independent from California, Kiley said he will continue caucusing with Republicans because of “administrative purposes.” Committee assignments in the House run through party leadership. To remain in his committees, Kiley must be attached to one of the two parties.

Kiley told reporters, however, that his new designation “reflects the way that I have always approached my role as a representative.”

“I’ve always said I’ll be an independent voice for our district,” he said.

Raw oysters and clams recalled in 9 U.S. states over possible norovirus contamination

    March 9, 2026 / 4:32 PM EDT / CBS News

Federal officials on Monday issued a recall for clams and raw oysters distributed in at least nine states due to concerns that they may be contaminated with norovirus, a contagious infection commonly known as the “stomach flu.”

According to a notice from the Food and Drug Administration (FDA), the recalled clams were harvested by the Lummi Indian Business Council and were distributed to restaurants and food retailers in Arizona, California, Florida, Georgia, Illinois, Nevada, New York, Oregon and Washington. Other states also may have received the clams.

The oysters, which were harvested by Drayton Harbor Oyster Company, were distributed to consumers in Washington. Both products were harvested between February 13 and March 3 in Drayton Harbor, Washington.

“The FDA is issuing this alert advising restaurants and food retailers not to serve or sell and consumers not to eat certain raw oysters harvested by Drayton Harbor Oyster Company, and Manila clams harvested by Lummi Indian Business Council….” the FDA said.

Products may “look, smell and taste normal”

The FDA warns that food containing norovirus may “look, smell and taste normal” but can cause serious illness if consumed.

Common norovirus symptoms include diarrhea, vomiting, nausea and stomach pain. The illness, which causes inflammation of the stomach or intestines, can be more severe for people who are immunocompromised. It typically takes 12 to 48 hours for someone to start developing symptoms of norovirus and up to three days to recover.

According to the Centers for Disease Control and Prevention, norovirus is highly contagious and can spread through direct contact with an infected person or through contaminated food, water and objects.

Consumers who are experiencing norovirus symptoms should contact their health care provider, the FDA said Monday.

The judge said ICE processing center conditions violate the Fifth Amendment and due process protection under the US Constitution

By Breanne Deppisch | Fox News

    Published March 9, 2026 6:27pm EDT

The Department of Homeland Security on Monday blasted a federal judge’s order requiring it to immediately improve conditions at its ICE processing facility in Baltimore — including reducing the number of detainees held there at one time, and improving access to food, hygiene, and medical care — telling Fox News Digital that the court’s determination of any “subprime” conditions or overcrowding are “false.”

“Illegal aliens in custody are provided food, water, blankets, and hygiene products,” a spokesperson for DHS said Monday, alleging that ICE “has higher detention standards than most U.S. prisons that hold actual U.S. citizens,” including access to “comprehensive” medical care.

The characterization comes hours after a federal judge in Maryland issued a preliminary injunction Monday ordering ICE to either drastically improve conditions at its Baltimore processing center or find a new facility to “humanely” and legally hold the migrants before transferring them to a longer-term detention center.

BIDEN-APPOINTED FEDERAL JUDGE RULES TRUMP’S ‘THIRD COUNTRY’ DEPORTATION POLICY IS UNCONSTITUTIONAL

U.S. District Judge Julie Rubin, a Biden appointee, sided with plaintiffs Monday in ruling that Baltimore’s holding center conditions are “unhygienic, unsanitary,” and ultimately, unconstitutional.

Rubin used a 67-page preliminary injunction to carefully tick through a long list of egregious conditions alleged by lawyers for plaintiffs over the last 10 months, including allegations of squalid, unsanitary holding, severe overcrowding, and a lack of medical screening, access to medical care, and necessary treatment — which the judge noted could lead to liability issues, or “in the worst-case scenario, fatalities.”

“The debated issue here is not defendants’ legitimate governmental interest; it is that defendants apparently dispense with even rudimentary decent, humane treatment of civil detainees, and so too their constitutional rights as a result,” Rubin said in the preliminary injunction, which applies to all current and future detainees at the holding facility operated by Baltimore’s ICE Field Office.

She sided with plaintiffs in ruling that the conditions in Baltimore are “unlawfully punitive” and reflect a “deliberate indifference to the health, safety, and medical needs” on behalf of the government, in violation of the Fifth Amendment and due process protections granted under the U.S. Constitution.

Rubin also rejected the notion that ICE detainees and illegal immigrants are not entitled to due process, citing the Supreme Court precedent under Zadvydas v. Davis, which holds that such protections apply to “all ‘persons’” within the U.S. “including [noncitizens], whether their presence here is lawful, unlawful, temporary, or permanent.”

A DHS spokesperson told Fox News Digital that migrants detained at the ICE holding center in Baltimore are granted “comprehensive” health care, including “medical, dental, and mental health services as available, and access to medical appointments and 24-hour emergency care,” and rejected claims made by plaintiffs and the judge.

“This is the best healthcare tha[t] many aliens have received in their entire lives,” the spokesperson added.

Rubin, in the court order, does not appear to back that contention.

“This is not a case of a prisoner lacking access to a clean toilet for a period of days, nor is it a case where a pretrial detainee cannot shower and is not provided with hygiene items …” Rubin said in the preliminary injunction, which comes after one year of status hearings, amended complaints, and declarations provided to the court from Trump administration officials and others.

“Rather, the conditions here are compounded: civilly detained people are stuffed into unclean cells by the dozens, without basic hygiene essentials, while exposed to a virtually open unclean toilet (and those detained making use of same),” Rubin said.

“These conditions woefully fail to comport with ‘contemporary standards of decency,” she continued.

DHS also rejected claims of inadequate medical care, including complaints from plaintiffs’ lawyers and cited by the court in which individuals with serious medical conditions such as diabetes, high blood pressure, HIV, leukemia, and broken bones were denied medications or medical attention.

Government records cited by the judge show that between February and September 2025, just eight out of 3,250 detainees held at the Baltimore ICE facility had been transported to a hospital for medical needs.

Rubin is not the first federal judge to order U.S. immigration officials to immediately improve conditions at ICE processing centers or “holding” centers across the country during Trump’s second presidential term.

FEDERAL JUDGES IN NEW YORK AND TEXAS BLOCK TRUMP DEPORTATIONS AFTER SCOTUS RULING

The Department of Homeland Security (DHS) logo is seen in a federal building.(Andrew Harrer/Bloomberg via Getty Images)

In August, U.S. District Judge Lewis Kaplan issued an emergency order requiring ICE to swiftly address allegations of filthy, overcrowded cells and prolonged stays at an ICE processing facility in New York City. The following month, he slapped ICE with a more lasting preliminary injunction seeking to codify those changes.

And in Minnesota, a federal judge last month issued a temporary restraining order requiring ICE to grant detainees at its Whipple Federal Building holding center access to counsel, attorney-client visits, and a 72-hour notice period before transferring detainees out of the state.

The administration has not yet indicated whether it will appeal the judge’s ruling. Still, DHS officials sharply rejected the allegations of improper treatment, telling Fox News Digital that being in detention “is a choice.”

“If not, you will be arrested and deported without a chance to return,” they added.

Alexander brothers found guilty on all charges in sex trafficking trial

    2026-03-09T17:58:00-0400 / CBS News

Jurors in New York City have found the Alexander brothers guilty on all counts in their federal trial on sex trafficking charges.

The verdict Monday capped four weeks of testimony from women who accused the three wealthy brothers — Tal, 39, and 38-year-old twins Oren and Alon — of sexually assaulting them. The brothers were accused of teaming up to drug and rape dozens of women and girls over more than a decade, and Assistant U.S. Attorney Andrew Jones referenced the distressing accounts of 11 victims during the trial.

The brothers faced 10 counts including conspiracy to commit sex trafficking and multiple charges of sex trafficking by force, fraud or coercion.

They had pleaded not guilty to the charges, which were brought against them in waves following their arrest in December 2024 in Miami, where they lived. The trial took place in New York City, one of several locations where victims said they were assaulted.

Prior to the arrests, Oren and Tal Alexander were known for their luxury real estate business, which earned them the nickname “The A Team” as they brokered high-end properties in New York, Miami and Los Angeles. Alon graduated from law school and went on to hold an executive position at their family’s private security firm.

Oren Alexander shook his head softly as the forewoman read out the guilty verdict. Tal Alexander also put his head down. Their parents were present and faced forward in court, while at one point a family friend rubbed their mother’s back.

Sentencing has been scheduled for Aug. 6.

Prosecutors said during the trial that the three brothers used their money, power and status to lure and then take advantage of the women they assaulted, including, they alleged, two teenage girls. An indictment accused them of drugging victims and sexually abusing them once they were incapacitated, in some cases taking video or photos.

The brothers’ defense lawyers argued that the encounters were consensual and that their sometimes “obnoxious” or inappropriate banter “doesn’t constitute a crime.”

    Burlap & Barrel

Small businesses mount legal challenge to Trump latest global tariffs

NEW YORK, March 9 (Reuters) – Two small businesses on Monday sued the Trump administration over its latest round of tariffs, saying that the president cannot simply use a different law ‌to reimpose a global 10-percent tax on imported goods after the U.S. Supreme Court struck down the administration’s previous tariffs.

The lawsuit, filed by spice importer Burlap & Barrel, Inc. and toy company Basic Fun Inc., mirrors arguments made last week by a coalition of 24 U.S. states, saying that Republican President Donald Trump is imposing the new tariffs based on a misreading of an archaic trade law that was meant to address historical monetary concerns rather than routine trade deficits.

Ethan Frisch, co-founder of Burlap & Barrel, said in a statement that the tariffs mostly hurt small U.S. importers like his company and American consumers, rather than foreign governments.

“Sudden global tariffs make it harder for us ‌to operate, harder for our partners to sell their crops, and more expensive for American families,” Frisch said. “We joined this case because trade policy shouldn’t be made by inventing an economic crisis.”

The lawsuit, filed by the legal nonprofit Liberty Justice Center, is the first private lawsuit to challenge the new tariffs.

Trump has made tariffs a central pillar of his foreign policy, using them as leverage to negotiate trade deals around the globe. But the U.S. Supreme Court ruled on February 20 that most of Trump’s tariffs were illegal, invalidating tariffs that he had imposed under the International Emergency Economic Powers Act, a law that had previously never been used to impose tariffs.

(Anna Moneymaker/Getty Images)

FIRST ON FOX: Nearly 50 House Republicans are writing to President Donald Trump backing Sen. Markwayne Mullin, R-Okla., to lead the Department of Homeland Security (DHS) after Kristi Noem’s ouster.

The pragmatist GOP Main Street Caucus is taking a formal stance, endorsing Mullin on Monday, as well as backing a targeted crackdown on illegal immigrant criminals in the U.S.

It’s a rare formal statement by the House Republican group, led by both Chairman Mike Flood, R-Neb., and Rep. Nick LaLota, R-N.Y., and signed by 47 other GOP lawmakers.

“Senator Mullin has demonstrated a steadfast commitment to border security. His familiarity with the legislative process and his longstanding support for pro-America policies make him well-suited to lead DHS at this critical moment,” the letter said. “We are confident he will bring the focus and discipline necessary to further our shared priorities.”

Trump tapped Mullin to lead the department last week while announcing that Noem would no longer serve in his Cabinet. He instead established a new role for her as special envoy at a new Trump-created initiative called Shield of the Americas.

The vast majority of Republican lawmakers immediately hailed Mullin’s nomination, particularly as criticism was steadily growing of Noem’s handling of DHS.

Among the most volatile chapters in her tenure occurred during Trump’s immigration operation in Minneapolis, which inspired bipartisan calls for restraint amid city-wide protests over the federal agent-involved killing of two U.S. citizens.

[MULLIN PROMISES TO EARN DEM VOTES AS GOP COLLEAGUES POUNCE ON HIS SEAT]

Trump responded to the uproar by upending federal leadership there, replacing Noem-empowered Greg Bovino of Customs and Border Patrol (CBP) with border czar Tom Homan.

The Main Street Caucus letter revealed that more than two dozen lawmakers in the group met with Trump’s Homan last week while praising his handling of immigration enforcement across the country.

“As members of the Republican Main Street Caucus, a group of more than 85 House conservatives focused on governing and producing legislative results, we write to express our strong support for the work of Tom Homan and his efforts to strengthen our nation’s immigration enforcement in his role as White House Border Czar,” the letter said.

“Last week, approximately two dozen members of our caucus met with Mr. Homan to discuss the current state of immigration enforcement and the steps necessary to strengthen public safety while restoring confidence in federal immigration law.”

Among the agreed-upon initiatives, the letter said, was keeping Trump’s immigration crackdown focused on people who commit crimes within the U.S.

“First, enforcement efforts should remain focused on the worst criminal offenders. Prioritizing the removal of individuals who pose the greatest threats to public safety ensures that federal resources are used effectively while protecting American families and communities,” they wrote.

[TEAMSTERS BOSS PRAISES MULLIN DHS NOMINATION DESPITE PAST HEATED HEARINGS]

It’s a notable point given past criticism of DHS, from both sides of the aisle, about indiscriminate targeting of undocumented people in places like federal courthouses during routine immigration appointments.

They also called for the repeal of policies in sanctuary jurisdictions that “undermine public safety and hinder lawful immigration enforcement” and giving federal authorities “access to local jails before criminal aliens are released.”

“Finally, we agreed there should be clear communication from ICE to the American people and to Congress regarding its success in deporting the worst criminal offenders—individuals with records of assault, battery, rape, DUI, and other serious crimes,” the letter said.

The lawmakers added that “Homan’s approach reflects those principles, and we believe his leadership will continue to strengthen the federal government’s ability to enforce immigration laws in a targeted and effective manner.”

Trump says Iran war will end “very soon” at Florida news conference

    March 9, 2026 / 6:53 PM EDT / CBS News

Washington— President Trump said he expects the war in Iran to end “very soon,” but also called it “the beginning of building a new country,” as the administration offers different characterizations for how long the operation will last.

He also warned that Iran could pay an “incalculable” price if its military disrupts oil tankers, as oil importers grapple with higher prices since the war began.

Speaking to reporters at his Miami-area golf club in his first formal news conference since the U.S. and Israel began strikes on Iran, the president said he doesn’t expect the war to end next week, but “soon.”

“We’re very proud to be involved in this and it’s going to be ended soon,” he said. “And if it starts up again, … they’ll be hit even harder.”

Mr. Trump said the U.S. is achieving “major strides toward completing our military objective.”

“Some people could say they’re pretty well complete,” he said of U.S. military objectives. “We’ve wiped every single force in Iran out, very completely.”

Mr. Trump also said the U.S. has “left some of the most important targets for later,” saying those targets involve “electricity production and many other things.”

Trump calls it “the beginning of building a new nation”

Earlier Monday afternoon, the president told CBS News senior White House correspondent Weijia Jiang, “I think the war is very complete, pretty much.” The president made those remarks the same afternoon the Department of Defense posted on X, “We have Only Just Begun to Fight” and “no mercy.” The president was asked to explain those seeming discrepancies.

“Well I think you could say it both. The beginning, it’s the beginning of building a new country,” he said, before talking about how the U.S. has destroyed Iran’s navy.

Although the president has said he wants to approve Iran’s next leader, the Trump administration in the past has insisted it isn’t interested in nation-building like the U.S. tried in the Middle East in the wake of the Sept. 11, 2001, terrorist attacks.

On Sunday, Ayatollah Mojtaba Khamenei was named as Iran’s new supreme leader, a development the president has openly criticized. Khamenei is the son of the late leader killed on the first day of the U.S.-Israeli military operation.

Asked if the U.S. would take Khamenei out, the president said, “I don’t want to say that.” But he said he was “disappointed” in the selection, because it may lead to more of the same in Iran.

The president said he likes the idea of an internal selection to lead the country rather than an outsider, and doesn’t want to repeat the situation in Iraq, where U.S. forces effectively purged former dictator Saddam Hussein’s government after the 2003 invasion — a decision widely blamed for helping to destabilize the country.

He cited Venezuela as a “formula that’s been very good so far.” In that country, the U.S. captured former President Nicolas Maduro but has sought to work with his successor, a Maduro loyalist.

But Mr. Trump has noted that U.S. and Israeli strikes have taken out some potential leaders. He said last week that “most of the people we had in mind are dead,” and told reporters Monday that “we’ve taken out the leadership twice and maybe three times.”

President says he blamed Iran for elementary school bombing because he doesn’t “know enough about it”

The president was also asked about the bombing of an elementary school in Iran that killed 168 people, many of them children. A preliminary U.S. assessment found American forces are “likely” responsible for the deadly attack but did not intentionally target the school, CBS News has previously reported.

In the past, the president has claimed Iran was responsible for the bombing, something other administration and defense officials are not saying. He was asked Monday why he’s the only high-ranking government official offering that explanation.

“Because I just don’t know enough about it,” he said. “I think it’s something that I was told is under investigation.” The president said he’s “willing to live” with whatever the investigation reveals.

Trump warns of “much harder” strikes if Iran blocks Strait of Hormuz

The president said Iran will get hit “at a much, much harder level” if Iran does anything to stop the world’s oil supply, as oil prices soar and commercial traffic through the Strait of Hormuz nearly grinds to a halt due to the war and Iran’s retaliatory strikes.

“I will not allow a terrorist regime to hold the world hostage and attempt to stop the globe’s oil supply,” he said.

The president reiterated that the U.S. is offering political risk insurance to any tankers in the Persian Gulf, and the U.S. could escort tankers through the strait if needed.

“If they do anything, the price will be incalculable,” the president said of potential Iranian operations against oil tankers.

Markets are down since the war began over a week ago, and oil prices have jumped — though the price of crude oil dropped and major stock indexes closed in positive territory on Monday afternoon after Mr. Trump floated a takeover of the Strait of Hormuz in his interview with CBS News. Earlier in the day, oil prices had surged by double-digit margins.

So far, seven American service members have died in the U.S.-Iran war. The president was asked how many deaths of U.S. service members he’s willing to allow.

“Well as I said before, when you have conflicts like this, you always have death,” he said.

The president said the families he met at the dignified transfer for six of the deceased service members urged him to finish the job in Iran.

Mr. Trump, who has taken questions and a number of phone calls from reporters in the days since the war began, said on Truth Social he’s attending a fundraiser event for House Speaker Mike Johnson before the news conference. The Trump National Doral golf club is hosting the Republican Members Issues Conference, an annual retreat for congressional Republicans as they plot for the November midterm elections.
