    SAN FRANCISCO, Feb 11 (Reuters) – Some pharmaceutical companies not targeted by President Donald Trump for agreements to lower their U.S. drug pricing are looking to craft their own deals in an attempt to avoid potentially onerous tariffs and new price-setting schemes, according to six industry sources.

    Two lobbyists and other industry sources say that companies have begun reaching out to contacts at the White House and the Centers for Medicare & Medicaid Services to try to create their own deals. They did not disclose the names of those companies.

    “The Trump administration of course wants to negotiate deals that meaningfully lower drug prices for American patients with every pharmaceutical company,” White House spokesman Kush Desai said in an email.

    The administration has not communicated to companies how they can potentially proceed if they did not receive a letter from Trump, one industry source said.

    Companies are concerned in particular about new pilot programs that could set prices for Medicare drugs in large parts of the country, industry sources said. Those programs would require manufacturer rebates for drugs paid for by the Medicare health plan for millions of Americans age 65 and over if U.S. prices exceed international levels.

    COMPANIES THAT DID NOT STRIKE DEALS


    So far, 16 of the largest drugmakers including Pfizer (PFE.N), opens new tab and Eli Lilly (LLY.N), opens new tab have already struck deals with the government after receiving directive letters from the Trump administration instructing them to cut prices. But many companies, including around half of those represented by the largest pharmaceutical lobby group, PhRMA, have not yet been contacted.

    Bayer (BAYGn.DE), opens new tab Global Head of Pharmaceuticals Stefan Oelrich said in an interview that he expects companies like his that did not receive letters from Trump will be given the opportunity to strike similar deals to their competitors.

    “Otherwise that would be very odd, that only because you have size that you would get different treatment,” he said.

    Some smaller companies have formed their own industry lobby group called the Midsized Biotech Alliance of America in part to advocate against the new price-setting schemes. The 11 companies that have joined that organization include Alkermes (ALKS.O), opens new tab, BioMarin (BMRN.O), opens new tab, Incyte (INCY.O), opens new tab and Alnylam (ALNY.O), opens new tab.

    “There’s a large group of companies that don’t have a deal and what are they left with?” Sanofi (SASY.PA), opens new tab CEO Paul Hudson told reporters at the JP Morgan Healthcare Conference in San Francisco in January.

    According to Hudson, the nature of the deals, which some companies have said exempt them from future government price-setting initiatives, could make it hard for the government to offer similar options to smaller companies.

    “It’s very difficult to deliver 30, 50, 80 deals from here. There may just be a sort of catch-all offer from the government or something to try and manage it a certain way,” said Hudson, who is set to take over as chairman of PhRMA later this year.

    AVOIDING PRICE SETTING IN MEDICARE


    U.S. patients currently pay by far the most for prescription medicines, often nearly three times more than in other developed nations.

    The deals that the large drugmakers signed committed them to lowering prices on drugs sold in the U.S. Medicaid program for low-income Americans. Analysts have noted that the impact will be mitigated by the fact that Medicaid accounts for only 10% of U.S. drug spending and has price discounts exceeding 80% in some cases.

    But drugmakers that do not have deals would be subject to Medicare pilots – called GLOBE and GUARD – that would introduce most-favored-nation-style pricing in the much larger Medicare program, bringing those prices in line with the lower prices paid outside the U.S.

    One concern is that some smaller drugmakers have licensed their drugs to international companies for sale overseas, where partners have no incentive to raise their prices, potentially forcing the U.S. companies to slash prices for Medicare.

    Another concern of mid-sized drugmakers is that they have fewer products to make deals with compared to larger companies, meaning that they may not have lower-revenue drugs to sacrifice.

    “A lot of them are very worried that… they’re going to get stuck with what the bigger guys did that works for them and doesn’t work for the mid-sized guys,” one pharmaceutical industry lobbyist said.

    Cardi B’s Super Bowl halftime show cameo ignites a prediction market dispute

    Cardi B’s appearance during Bad Bunny’s Super Bowl halftime show has stirred debate among prediction market users, raising questions about whether she actually “performed.”

    Prediction markets users placed divergent bets on whether the rapper would perform at the halftime show, which the NFL says drew approximately 128 million viewers.

    When Cardi B took the stage on Sunday, the Grammy winner danced alongside celebrities including Karol G, Young Miko, Jessica Alba and Pedro Pascal on a pink porch set. But it was unclear if the artist was singing, creating a murky situation for the nation’s most prominent prediction markets.

    Polymarket is scheduled to issue a final decision on Wednesday, while Kalshi is facing a backlash after choosing not to declare a winner, citing ambiguity in whether Cardi B sang during her halftime appearance.

    Kalshi instead settled the market at the last traded price before it was paused — paying 74 cents per contract to “No” holders and 26 cents to “Yes” holders — effectively issuing partial payouts.

    That decision prompted one Kalshi user to file a complaint with the Commodity Futures Trading Commission, the independent U.S. agency that regulates prediction markets.

    Millions wagered on the halftime show


    Prediction markets allow users to wager on the outcome of future events, typically by responding to “yes” or “no” questions — called event contracts — and putting down a buy-in amount.

    Leading up to the Super Bowl, Kalshi and Polymarket hosted event contracts revolving around whether Cardi B, among other artists, would perform, which racked up $47.3 million and $10 million in trade volume, respectively.

    Some Polymarket users hashed out the debate in the comments section of the event contract, with some claiming they were scammed.

    “There’s no way that you would count a cameo as a performance,” one person wrote. Another argued that a “performance” does not exclusively mean singing.

    Polymarket did not immediately respond to a request for comment.

    Kalshi also faced a backlash from some users over the halftime show. In the complaint with the CFTC, one user — who purchased a “yes” contract — said that as a result of Kalshi’s decision to settle the market price at the mid-trading value, they received $1,300 instead of $5,000. The user is seeking $3,700 in reparations.

    In response, one user filed a complaint with the Commodity Futures Trading Commission (CFTC), first reported by the Event Horizon newsletter and posted by Front Office Sports. The user, who purchased a “yes” contract, claims that as a result of Kalshi’s decision to settle the market price at the mid-trading value, they received $1,300 instead of $5,000. The user is seeking $3,700 in compensation.

    CFTC did not immediately respond to a request for comment.

    “The rules were clear. Under the full rules, singing and dancing counted as a performance, but just dancing in the background did not,” a Kalshi spokesperson said in an email to CBS News. “In the as-broadcast performance, Cardi B was dancing and mouthing words to the song, but it was unclear if she was ‘singing’.”

    On the day of the Super Bowl, Kalshi reported a daily record high of more than $1 billion in trading across its site, up 2,700% from last year.

    Wagering on sports events has faced some pushback from states including Connecticut, which is arguing that platforms offering “sports events contracts” are illegal.

    Some regulators, however, appear to be shifting their stances. In late January, CFTC Chair Michael Selig directed the agency to withdraw a 2024 rule proposal that sought to prohibit political and sports-related contracts. Selig said the advisory “contributed to uncertainty in our markets.”

    [Senate Democrats] aren’t budging on their Homeland Security demands, and appear ready to again thrust the government into a partial shutdown as Republicans scramble to keep the lights on.

    Senate Minority Leader [Chuck Schumer], D-N.Y., announced that he and Senate Democrats were prepared to reject a short-term funding extension, known as a continuing resolution (CR), for the Department of Homeland Security (DHS) just days ahead of the funding deadline.

    “We’re 3 days away from a [DHS shutdown], and Republicans have not gotten serious about negotiating a solution that reins in [Immigration and Customs Enforcement] and stops the violence,” Schumer said on X. “Democrats will not support a CR to extend the status quo.”

    Congress has until Friday at midnight to fund the agency, and as the days go by, the odds of doing so are becoming increasingly slim.

    Schumer’s edict comes as both sides of the aisle continue negotiations behind the scenes on a compromise bill to fund the agency.

    Senate Democrats unveiled the legislative text of their 10-point proposal over the weekend, and for a time, Republicans were optimistic that talks were moving in a positive direction.

    Now, [Schumer and his caucus] are at an impasse with Republicans and the White House. While President Donald Trump and his administration presented a counteroffer earlier this week, Democrats say it’s not enough.

    Senate Majority Leader [John Thune], R-S.D., teed up the original DHS funding bill for another vote on Tuesday. That bill could be modified to be a CR, and Republicans are leaning toward a four-week extension to keep the agency open.

    And he noted that the legislative text from the White House could be coming on Wednesday.

    “There’s going to be the legislative text coming over from the White House today,” Thune told reporters. “But I think it’s, like I said, the White House is operating in good faith.”

    Still, Democrats have dubbed the GOP’s counter, which has been kept under strict lock and key, “sophomoric talking points.” However, several items from their proposal, like requiring [Immigration and Customs Enforcement (ICE) agents] to obtain judicial warrants, demask, and have identification, are red lines for the White House and Republicans.

    Whether the GOP can siphon off enough votes to avert a partial shutdown remains an open question, given the unified front Schumer and his caucus are presenting. And they will have a math problem of their own to contend with in trying to break the 60-vote filibuster.

    Sen. [Mitch McConnell], R-Ky., who was discharged from the hospital on Tuesday, “will be working from home this week,” his office said in a statement.

    Russia will continue to observe the limits set under the recently-expired New START nuclear arms reduction treaty if the United States does the same, Russian Foreign Minister Sergey Lavrov said Wednesday.

    “We proceed from the fact that this moratorium, on our part, which was announced by our president, will remain in effect, but only as long as the United States does not exceed the aforementioned limits,” Lavrov said, addressing the lower house of Russia’s parliament.

    The New Strategic Arms Reduction Treaty (New START) was signed in 2010 between the U.S. and Russia. It limited the number of strategic nuclear warheads that both countries could have deployed to 1,550, and included verification measures such as on-site inspections and data exchanges designed to ensure compliance.

    The pact was originally set to expire in February 2021, but it was extended for five years by former President Joe Biden, keeping it in force until February 2026.

    President Vladimir Putin said last year that Russia was prepared to continue abiding by the treaty’s core limits if the U.S. did the same, and Lavrov’s latest remarks reaffirm that position in the wake of the pact’s expiry.

    According to The Associated Press, Kremlin spokesman Dmitry Peskov also said last week that Russia would “retain its responsible, thorough approach to stability when it comes to nuclear weapons. And, of course, it will be guided primarily by its national interests.”

    Debate continues in the U.S. over the future of strategic arms control.

    President Trump has previously argued that any nuclear agreement should include China, which has expanded its nuclear arsenal in recent years. Beijing has repeatedly rejected calls to join trilateral nuclear arms control talks, however, noting that its weapons stockpile is significantly smaller than those of the U.S. and Russia.

    A White House official told CBS News in January that the president would decide a path forward on nuclear arms control “which he will clarify on his own timeline.”

    Last week, the U.S. and Russia agreed to reestablish formal, high-level military communications that were suspended in late 2021, prior to Russia’s full-scale invasion of Ukraine.

    But there has been no indication of progress toward a new agreement to regulate the arsenals of the world’s two biggest nuclear powers.

    Mr. Trump directed the Pentagon in October to resume testing of nuclear weapons “on an equal basis” with other countries’ tests, a move which could end a U.S. pause that stretches back to the end of the Cold War.

    “Because of other countries’ testing programs, I have instructed the Department of War to start testing our Nuclear Weapons on an equal basis,” the president wrote on Truth Social, using his administration’s preferred term for the Defense Department. “That process will begin immediately.”

    Days later, Putin instructed his government to submit proposals on the possible resumption of nuclear weapons testing in Russia.

    During a meeting with his Security Council, Putin said Russia had adhered to the international Comprehensive Nuclear-Test-Ban Treaty, which prohibits nuclear test explosions, but he said, “if the United States or any other state party to the Treaty was to conduct such tests, Russia would be under obligation to take reciprocal measures.”

    [Lindsey Vonn] says she underwent a third round of surgery Wednesday and is making “slow” progress as she recovers from a crash that broke her leg during her downhill Olympic race on Sunday.

    The surgery was successful, she said in a post on Instagram. She also shared photos of herself in her hospital bed with a metal frame attached to her leg.

    “Success today has a completely different meaning than it did a few days ago,” she posted. “I’m making progress and while it is slow, I know I’ll be ok.”

    She said she is thankful for the incredible medical staff, family and friends who have been by her side and for “the beautiful outpouring of love and support from people around the world.”

    “Also, huge congrats to my teammates and all of the Team USA athletes who are out there inspiring me and giving me something to cheer for,” she posted.

    [Vonn]crashed seconds into her race after deciding to compete despite rupturing her left ACL in a prior crash during a World Cup event in the Swiss Alps a week before.

    The 41-year-old American came out of retirement to compete in the[2026 Winter Olympics]and had said she felt confident she could still complete the race with the help of a knee brace.

    A Senate Republican known for breaking with the Trump administration praised a grand jury’s decision not to indict several congressional Democrats who urged service members to refuse what they described as “illegal orders.”

    Sen. Thom Tillis, R-N.C., applauded a Washington, D.C., grand jury’s decision to reject an indictment against six congressional Democrats who last year called on service members to refuse what they characterized as illegal orders under the Trump administration.

    “Political lawfare waged by either side undermines America’s criminal justice system, which is the gold standard of the world,” Tillis said in a post on X. “Thankfully in this instance, a jury saw the attempted indictments for what they really were. Political lawfare is not normal, not acceptable, and needs to stop.”

    It’s not the first time Tillis has bucked the administration. He has placed holds on future Homeland Security nominees, pledged to block President Donald Trump’s pick to replace outgoing Federal Reserve Chair Jerome Powell, and has been a vocal critic of the president’s advisors, including White House deputy chief of staff Stephen Miller.

    Meanwhile, U.S. Attorney Jeanine Pirro, the top federal prosecutor in the nation’s capital, sought to bring criminal charges against Sens. Elissa Slotkin, D-Mich., and Mark Kelly, D-Ariz., along with Reps. Maggie Goodlander, D-N.H., Jason Crow, D-Colo., Chris Deluzio, D-Pa., and Chrissy Houlahan, D-Pa.

    The group of Democrats — all of whom previously served in the military or as intelligence officers — last year said service members could “refuse illegal orders” and “must refuse illegal orders,” arguing that troops are not required to carry out commands they believe violate the Constitution.

    Service members are obligated to follow lawful orders from their superiors, but they may refuse orders deemed illegal, according to the Uniform Code of Military Justice, the military justice system enacted in 1951.

    Their video prompted Trump to accuse the group of seditious behavior “PUNISHABLE BY DEATH” in a fiery Truth Social post.

    After the grand jury declined to indict them, the lawmakers praised the decision.

    “Donald Trump wants every American to be too scared to speak out against him,” Kelly said in a statement. “The most patriotic thing any of us can do is not back down.”

    Slotkin added that no matter what comes next from the administration in its pursuit of legal recourse, “tonight we can score one for the Constitution, our freedom of speech, and the rule of law.”

    A former FBI agent believes the person who was caught on video outside Nancy Guthrie’s home is “not a career criminal.”

    “However, they have to have a criminal mindset in order to commit a heinous crime like this,” Lance Leising, a retired supervisory special agent with the FBI, told “CBS Mornings” on Wednesday.

    Nancy Guthrie, the mother of “Today” show host Savannah Guthrie, was reported missing 10 days ago after she missed church, and officials believe she was abducted overnight from her Tucson home.

    Leising has drawn clues from video and images that were released by authorities on Tuesday, showing a masked individual outside Nancy Guthrie’s home the night she disappeared. The person is wearing gloves, a backpack and what appears to be a weapon.

    Leising called the person’s actions “extremely amateurish.”

    “If you look at the two still photos and the videos that Kash Patel released, one of them, the subject is not even wearing the backpack or the weapon, potential weapon,” Leising said. “So what that says to me is he approached that door and turned around and got the backpack and got the weapon and then came back.”

    He also said the apparent weapon was held in “an unusual way” and “it does not look very professional, it looks very amateur.”

    Leising also analyzed how the person approached Nancy Guthrie’s door, noting that their head was down as if they expected a surveillance camera above them.

    “They almost feel surprised that there is a doorbell camera there, which anyone who has done any reconnaissance would know that’s there,” he said.

    “Then they take some irrational step to grab a bush or a weed from the front yard and then put that in front as they try to take it off,” he noted.

    He also highlighted the gloves the person was wearing, describing them as “oversized, maybe multiple layers,” which would make it difficult to use the apparent weapon he was carrying.

    “I do think that it gives investigators hope that if they’re amateur at the door, they’ve made other mistakes, and they’re looking for that break,” Leising added.

    Jason Pack, a retired FBI special agent, also noted that the video shows where an apparent weapon is located and the person’s gait, adding “he doesn’t appear to be moving very quickly.”

    “All of those things will tell profilers certain things that they’re gonna look for and kind of narrow that timeline down,” he said.

    Authorities release detained man


    Authorities said they detained a person in connection with the Guthrie case on Tuesday during a traffic stop. A man, who only wanted to be identified as Carlos, later told reporters that he had been detained and released, and that “I didn’t do anything. … I’m innocent.” Law enforcement has not confirmed if Carlos was the person they said they had detained.

    Leising said “a lot of times you’re going to detain people, bring them in for questioning and they may not be the suspect but they might have a piece, and hopefully the investigators got that piece.”

    California congressman running for governor confronts Acting Director Todd Lyons during House hearing over mass deportation operations

    Acting ICE Director Todd Lyons refused to resign under pressure from Rep. Eric Swalwell, D-Calif., who offered him the ultimatum to do so, or “side with the killers.”

    The heated exchange during Tuesday’s House Homeland Security Committee hearing isn’t the first time Swalwell has confronted ICE over its mass deportation operations. He previously co-authored the “ICE OUT Act” with fellow committee member Rep. Daniel Goldman, D-N.Y., which would strip qualified immunity from federal immigration agents.

    Near the close of his questioning, Swalwell told Lyons that continuing to lead ICE is a “choice” and highlighted his preceding decorated military and law enforcement career.

    “You are what I would call ‘otherwise employable’. I think most people would agree this is not the only job that you can get. But since you’ve been on this job, women have been dragged by their hair through streets. A 6-year-old child battling stage-four cancer [has been deported]. And it turns out he was a U.S. citizen,” Swalwell claimed.

    The Alameda lawmaker, who is also running for governor, said people are fleeing ICE “through the fields where they work” and that “disgraceful” statements from DHS brass should convince Lyons to find a new job.

    “Will you stand with the kids who you’re supposed to protect, or will you side with the killers bringing terror to our streets? Mr. Lyons, will you resign from ICE?” Swalwell asked, as a poster of a child appeared behind him.

    Lyons replied, “No sir, I won’t,” and then took issue with the poster Swalwell’s staff had produced.

    That child that you’re showing right there, the men and women of ICE took care of him when his father abandoned him and ran from law enforcement,” Lyons said, referencing the case of Adrian A.C. Arias, an Ecuadorian national targeted by ICE.

    Arias “abandoned” his 5-year-old child to flee authorities, leading Democrats and some in the press to claim that [DHS had targeted the child], who went into their custody.

    “For the child’s safety, one of our ICE officers remained with the child while the other officers apprehended Conejo Arias,” a DHS official said of the situation. “ICE did not target a child.”

    Swalwell also pressed Lyons on comments made at a Border Security Expo suggesting immigration enforcement and deportation operations be as efficient as Amazon Prime delivery.

    “Mr. Lyons how many times has Amazon Prime shot a mom three times in the face?” Swalwell asked — appearing to reference the [shooting of Renee Good in Minneapolis].

    “None,” Lyons said.

    “It’s the square root of zero, that’s right,” Swalwell shot back, before Lyons countered that his Amazon comment had come in the context of remarks made on [improving the technology] around DHS’s work, including efficiency and artificial intelligence areas.

    “I did say at the end of it, but we deal with human beings, so we can’t be like them. That’s the key part that you’re leaving out,” Lyons said.

    At the end of Swalwell’s remarks, [Chairman Andrew Garbarino, R-N.Y.], ceded the floor to Rep. Michael Guest, R-Miss., who offered a friendlier exchange with Lyons.

    US to participate in meeting on influenza vaccine composition, WHO official says

    Feb 11 (Reuters) – The United States will take part in a World Health Organization meeting at the end of the month to determine the composition of upcoming influenza vaccines, the agency’s official said at a press conference on Wednesday.

    Washington officially left the WHO in January after a year of warnings that doing so would hurt public health in the U.S. and globally, saying its decision reflected failures in the U.N. health agency’s management of the COVID-19 pandemic.

    It has been unclear how much the country would work with the WHO following the departure, and the collaboration on flu vaccines is a sign of an ongoing link.

    Maria Van Kerkhove, the WHO’s director for epidemic and pandemic preparedness, said the global influenza surveillance and response network — a system of more than 150 laboratories across 130 countries — plays a central role in tracking seasonal and zoonotic influenza viruses and updates vaccine recommendations every six months.

    There are seven collaborating centers, including facilities in the U.S., the UK and Australia.

    Van Kerkhove said there had also been “a slight dip” in the global circulation of influenza virus samples after funding challenges, but shipments had now resumed.

    GUINEA-BISSAU VACCINE STUDY ‘UNETHICAL’ – TEDROS

    At the same press conference, WHO Director General Tedros Adhanom Ghebreyesus said a planned U.S.-funded research in Guinea-Bissau to study the effects of hepatitis B vaccines on newborns, which has drawn significant criticism, is unethical.

    “As far as WHO’s position is concerned, it’s unethical to proceed with this study,” Tedros said, but added that it was ultimately a domestic decision.

    African health officials in January said the study has not been canceled, but will undergo further ethical review.

    Scientists have opposed the study because some of the newborns involved would not get the vaccine, which is known to be safe and save lives, in a country with high rates of hepatitis B. The disease transmits commonly from mother to child during birth and can cause liver failure and cancer.

    The study’s researchers say the project is ethical because the vaccine is not yet administered at birth in Guinea-Bissau, where the first dose is given at six weeks.

    The research was due to investigate potential “non-specific effects” of the vaccine, including skin disorders and neuro-developmental disorders, such as autism.
