Operation Epic Fury survives Senate challenge as Republicans close ranks behind Trump

Tim Kaine’s war powers resolution fails as Trump admin lobbying convinces fence-sitting Republicans to support continued strikes

Senate Republicans closed ranks Wednesday, handing President Donald Trump a win on his use of force in Iran, despite lingering questions about America’s involvement in the Middle East.

The Senate shot down a resolution from Sen. Tim Kaine, D-Va., aimed at limiting Trump’s military actions in Iran on Wednesday, following days of speculation about whether Republicans would cross the aisle — as they have done before — to reprimand the president.

The administration pushed hard to lobby support for Operation Epic Fury, holding several briefings with Congress to make its case. It appeared to work, at least for now, convincing some Republicans on the fence to back continued military action in Iran.

Only Sen. Rand Paul, R-Ky., voted in favor of the resolution, while Sen. Jon Fetterman, D-Pa., was the lone Democrat to cross the aisle in support.

Democrats argued that Trump’s actions were another instance of him disregarding Congress’ authority to use military force, that they lacked a clear strategy going forward and, further, that they were yet another campaign promise he had broken.

“It’s time for the president to keep promises, not break them,” Kaine said ahead of the vote. “That’s why I’m so glad that we’re going to put everybody on the record … Nobody gets to hide and give the president an easy pass or an end run around the Constitution.”

Democrats also seized on the administration’s refusal to rule out sending U.S. troops into Iran.

“They refuse to take off the table the insertion of ground troops,” said Sen. Chris Murphy, D-Conn., warning the conflict could expand beyond air and naval operations. “This is going to make the operations in Libya look like child’s play.”

Sen. Josh Hawley, R-Mo., who previously supported a resolution to rein in Trump’s war powers in Venezuela, said he would oppose the latest effort.

But like last time, he said a ground operation would require congressional approval.

“I’ve always said that committing ground troops would be something I think would require immediate congressional authorization, but that doesn’t appear to be on the immediate horizon,” Hawley said.

Senate Minority Leader Chuck Schumer, D-N.Y., argued that the goalposts kept moving for the administration, which he said was a clear sign that “a strategy is missing.”

Republicans countered that the president acted within his constitutional authority as commander in chief. Sen. Lindsey Graham, R-S.C., called the War Powers Act “an unconstitutional shift of authority from the president,” arguing Congress retains the ability to restrict funding if it disagrees with military action.

“We don’t need 535 commanders in chief,” said Sen. Markwayne Mullin, R-Okla., arguing against the legislation.

There was also fatigue among some in the GOP over Kaine’s repeated efforts to reassert congressional authority in conflicts.

Republicans privately huddled Tuesday to discuss the strikes and the upcoming war powers vote ahead of their briefing with Secretary of State Marco Rubio, CIA Director John Ratcliffe, Joint Chiefs of Staff Chair Gen. Dan “Raizin” Caine and Secretary of War Pete Hegseth.

A source familiar with the closed-door discussion told Fox News Digital that Republicans who may have been swayed were frustrated with Kaine’s repeated use of the Senate floor to push resolutions limiting Trump’s war authorities.

Senate Majority Whip John Barrasso, R-Wyo., noted that it was Kaine’s fifth resolution to rein in Trump’s war powers since he returned to office last year, which accounts for nearly half of all war powers resolutions put forward in U.S. history.

“These resolutions have been used only 11 times in 50 years,” Barrasso said. “The senator from Virginia alone accounts for nearly half of them. Yet Senator Kaine introduced zero war powers resolutions when Barack Obama and Joe Biden were president.”

Rubio told reporters after a briefing with every senator on Tuesday that the administration had complied with the War Powers Act, though it believes the law is unconstitutional and noted that congressional leaders had been notified ahead of the strikes.

Rubio had previously suggested that the U.S. carried out Operation Epic Fury after it became clear that Israel intended to strike Iran first, a point he later walked back.

“If you tell the President of the United States that if we don’t go first, we’re going to have more people killed and more people injured, the president is going to go first,” Rubio said. “That’s what he did. That’s what the president will always do.”

Meanwhile, U.S. forces have now struck more than 2,000 targets in Iran, largely focusing on taking out the regime’s air defenses and missile capacity. Six U.S. service members have been killed in the operation, as have nearly 50 top Iranian leaders.

The Iranian government claims at least 1,045 people have been killed throughout Iran during the operation.

    Image 48: placeholder

The White House said Wednesday that U.S. munitions stockpiles are sufficient to carry out Operation Epic Fury, and go “much further,” but the Trump administration is still pressing top defense contractors to ramp up production – and quickly.

“President Trump has rightfully been calling on defense contractors in this country to rapidly and aggressively produce American-made weapons because they are the best in the world,” White House press secretary Karoline Leavitt said on Wednesday.

“And the president always likes to get things done as quickly as possible, and so he’s been quite vocal in his efforts to try to speed up our defense industry, to protect our homeland,” she said.

Leavitt’s comments came amid the White House’s first briefing since the start of the U.S. and Israel’s joint-military operation in Iran — Operation Epic Fury – on Saturday.

As the battle continues in Iran, a White House official told Fox News that top executives from U.S. defense contractors are set to visit the White House on Friday to discuss ramping up weapons production. Fox News Digital reached out to the White House Wednesday afternoon for additional details on the stockpile and Friday meeting with defense contractors.

Leavitt continued from the podium that the U.S. weapons stockpile is more than sufficient to execute the mission in Iran.

“Under this president, we have significantly increased our defense budget, which is a good thing for the United States, for our national security and for protecting our homeland with respect to munitions, ammunition, weapons, stockpiles,” she said.

“The United States of America has more than enough capability to not only successfully execute Operation Epic Fury, but to go much further and we have weapons, stockpiles, in places that many people in this world don’t even know about,” she continued.

Leavitt was asked about the stockpile status after President Donald Trump’s Truth Social post on Monday, in which he said the munitions stockpiles have “never been higher or better,” but said the U.S. is “not where we want to be.”

    Image 48: placeholder

“The United States Munitions Stockpiles have, at the medium and upper medium grade, never been higher or better,” he posted. “As was stated to me today, we have a virtually unlimited supply of these weapons. Wars can be fought ‘forever,’ and very successfully, using just these supplies (which are better than other countries’ finest arms!).”

He added: “At the highest end, we have a good supply, but are not where we want to be. Much additional high-grade weaponry is stored for us in outlying countries.”

“The United States is stocked and ready to WIN BIG!!!” Trump posted.

Leavitt, on Wednesday, said Trump, in his post, “was pointing out that we had a very stupid and incompetent leader in this White House for four years who gave away many of our best weapons for nothing, for free, to another country very far away by the name of Ukraine.”

(Morgan Phillips)
(Fox News)

Rep. Bill Foster says administration presented no plan to secure Iran’s enriched uranium stockpile during classified briefing

A House Democrat with a background in physics is sounding the alarm over what he views as a lack of a plan to deal with Iran’s nuclear sites during the U.S. offensive campaign.

After a classified briefing Tuesday with top administration officials, Rep. Bill Foster, D-Ill., said lawmakers were not presented with a clear plan to secure or neutralize Iran’s stockpile of enriched uranium.

“We have heard that they never had a plan for that nuclear stockpile of enriched uranium — to destroy that, to seize it or to put it under international inspection,” he said.

The U.S. intervention was publicly justified by the Trump administration as a necessary step to stop Iran from developing a nuclear weapon.

U.S. forces have struck more than 1,700 targets across Iran, including ballistic missile launch sites, air defenses, naval assets and command centers. Core nuclear facilities, however, have not been among the primary targets.

“Until that happens, Iran will be very, very close to making — as many observers have pointed out in a nonclassified situation — Iran can use that material to make a handful of Hiroshima-style nuclear devices,” Foster told Fox News Digital. “Not the sort you can put on a missile, but the sort you can deliver by a number of other ways and are very hard to stop.”

Foster was referring to Iran’s stockpile of highly enriched uranium, material that, if weaponized, could be used to build a nuclear explosive device.

Experts note that building a compact warhead that fits on a ballistic missile is technically complex and requires advanced engineering. But a simpler, larger nuclear device — similar in basic concept to the bomb the U.S. dropped on Hiroshima, Japan, in 1945 — would not need to be miniaturized to fit on a missile. Such a device could not be delivered by long-range rocket but could theoretically be transported by other means.

Foster argued that containing Iran’s nuclear materials, most of which are buried deep underground, would likely require U.S. forces to enter Iran.

Recent satellite imagery shows damage to support buildings and access points at Iran’s Natanz enrichment site, though the deepest underground infrastructure at key nuclear facilities has not been confirmed as a primary target in the current campaign.

U.S. and international officials previously have acknowledged that while strikes can damage enrichment infrastructure, stockpiled enriched uranium stored underground may remain intact and potentially retrievable unless physically secured or removed.

“You have to go in there with boots on the ground and grab a bunch of equipment,” Foster said. “You have to go underground into those facilities and lose a lot of soldiers’ lives doing that.

“They’re unwilling to do that, or they’ve decided not to or they’ve decided it’s impossible. In any case, they did not present to us any plan that would actually get the material under control.”

Without securing the nuclear material, he argued, military operations may push Iran closer to a nuclear weapon than diplomatic negotiations would have.

“The only positive thing about the ayatollah is that he had a fatwa against building nuclear weapons,” Foster said. “Who knows what the next generation of ayatollahs are going to feel? They’re going to be under a lot of pressure from the IRGC, which was not so much against having a nuclear weapon.”

Ayatollah Ali Khamenei, who was killed in the joint U.S.-Israeli operations, had previously issued a fatwa, a religious edict, opposing the pursuit of nuclear weapons. Analysts have long debated how binding or durable that ruling was.

At a White House briefing Wednesday, press secretary Karoline Leavitt said the administration believes Iran “wanted to build nuclear weapons to use against Americans and our allies,” framing the strikes as necessary to prevent Tehran from advancing its nuclear ambitions.

“The US military has more than enough munitions, ammo, and weapons stockpiles to achieve the goals of Operation Epic Fury laid out by President Trump — and beyond. Nevertheless, President Trump has always been intensely focused on strengthen our Armed Forces and he will continue to call on defense contractors to more speedily build American-made weapons, which are the best in the world,” she said in a follow up statement to Fox News Digital.

Missile suppression strategy faces ‘math problem’

Senior administration officials have emphasized that the current phase of the campaign is aimed at dismantling Iran’s ability to project force with missiles, drones and naval assets.

Defense Secretary Pete Hegseth has highlighted strikes on Iran’s ballistic missile systems, air defenses and naval capabilities, describing the effort as a push to degrade the conventional tools Tehran uses to threaten U.S. forces and regional allies.

Secretary of State Marco Rubio similarly has said the United States is working to “systematically take apart” Iran’s missile program, so it could not “hide behind” it to develop a nuclear weapon.

While the broader justification for intervention centered on preventing a nuclear-armed Iran, the most immediate threat facing U.S. troops and partners has been Iran’s ongoing missile and drone launches. Administration officials contend Iran’s missile buildup was meant to create a deterrent buffer, shielding its broader strategic ambitions, including its nuclear program, from outside attack.

Lawmakers emerging from classified briefings said the campaign has become, in part, a question of sustainability.

“We do not have an unlimited supply,” Sen. Mark Kelly, D-Ariz., said of U.S. and allied interceptor inventories. He warned the conflict could become a “math problem,” balancing launch volumes against finite air defense munitions and the ability to replenish them without weakening readiness in other theaters.

“At some point — and we’re probably already in this — this becomes a math problem,” Kelly added.

He said he pressed defense officials on how interceptor stocks are being replenished and whether diverting munitions to the Middle East could strain U.S. readiness elsewhere.

“How can we resupply air defense munitions? Where are they going to come from? How does that affect other theaters?” he said. “The math on this currently seems to be an issue.”

Sen. Andy Kim, D-N.J., said he also sought clarity on interceptor inventories but did not receive detailed answers.

“I am very concerned about that,” Kim said. “I did not get any specificity today. … Something akin to ‘trust us’ is not good enough for me.”

Republicans, however, pushed back on the notion that interceptor supplies are strained.

Sen. Markwayne Mullin, R-Okla., said officials told lawmakers U.S. forces are “in great shape,” dismissing concerns about shortages.

Ehud Eilam, a former Israeli defense official and national security analyst, said that while a nuclear weapon remains the most serious long-term threat, missile and drone systems pose the most immediate danger if intelligence assessments conclude Iran is not on the verge of assembling a device.

“As long as it is estimated Iran cannot produce a nuclear weapon soon, then the focus moves to missiles and drones,” Eilam said, noting that ballistic missiles would ultimately be required to deliver any future nuclear warhead. Suppressing mobile launchers, crews and command networks can reduce Iran’s firing tempo, conserving interceptor supplies while degrading Tehran’s broader military capacity, he said.

    The concern is not theoretical.

During the intense June 2025 Iran–Israel conflict, U.S. forces reportedly fired more than 150 Terminal High Altitude Area Defense interceptors, roughly a quarter of the global inventory, along with large numbers of ship-based Standard Missile interceptors to shield allies.

Analysts note that replenishing high-end air defense systems such as Patriot, THAAD and SM-3 interceptors could take more than a year under current production rates.

The Pentagon also is balancing competing demands. The same missile defense systems used to protect U.S. bases and Gulf partners are being supplied to Ukraine to defend against Russian cruise missile attacks, creating what some analysts describe as a “zero-sum” competition for inventory between Europe and the Middle East.

“There is a limit to how many THAAD missiles can be used,” Eilam said. “These are not systems you can reproduce overnight.”

A federal judge appointed by former President Joe Biden threatened that he may issue a ruling to imprison ICE and Department of Justice officials during a particularly fiery courtroom exchange with U.S. Attorney Daniel Rosen, according to local affiliate Fox 9.

The outlet reported that Minnesota U.S. District Judge Jeffrey Bryan ordered Rosen and several ICE and DOJ officials to court for an unusual contempt hearing over alleged “unlawful conduct” by federal officials. The hearing follows the Trump administration’s “Operation Metro Surge” crackdown on illegal immigration and fraud. During the hearing, Bryan said he had “not ruled out the consequence of imprisonment” for federal officials involved in the matter.

Fox 9 reported that while Bryan acknowledged imprisonment would be an unlikely “extraordinary measure,” he made it clear that all options are on the table. Bryan said such an imprisonment would be a “historic low point” for the U.S. Attorney’s Office.

The hearing took place amid a spike in Minnesota federal judges charging the federal government with contempt of court orders. Last week, Chief U.S. District Judge Patrick Schlitz issued a sharp rebuke of the U.S. attorney’s office for its alleged noncompliance, saying, “This Court will continue to do whatever is required to protect the rule of law, including, if necessary, moving to the use of criminal contempt. One way or another, ICE will comply with this Court’s orders.”

Bryan called in Rosen and several ICE officials in an order in which he alleged that the federal government had not complied with multiple court orders requiring it to return cash, phones, passports, and identity documents belonging to 28 individuals “unlawfully detained” and then released by the agency.

The hearing was tense, with Bryan himself admitting that he and Rosen had “been a little testy and frosty with each other,” according to The Associated Press.

In another exchange reported on by Fox 9 journalist Paul Blume, Bryan lashed out at ICE Deputy Field Office Director Tauria Rich’s use of the term alien to refer to immigrants, emphasizing they are discussing “people… not space aliens.”

DEMOCRAT IN KEY SENATE PRIMARY SAYS SHE ‘REGRETS’ VOTE ON LAKEN RILEY ACT, DRAWS GOP BACKLASH

At another point, Rosen told Bryan, “Your honor has made a remark smearing myself,” according to AP.

Rosen said of the 28 individuals accusing the agency of improperly holding their personal belongings, only five cases are still outstanding. He said the government would compensate immigrants in cases in which property was lost, which he said, “fall into the realm of human error.” Rosen also said the federal government believes property was returned in all the other cases.

Rosen said there “was no defiance, no disobedience” on the part of the government and that “the government believes contempt is far beyond anything that ought to be considered here today.”

Colorado Governor Polis signals he is open to clemency for Tina Peters

    March 4, 2026 10:24 PM UTC / Reuters

WASHINGTON, March 4 (Reuters) – Colorado Governor Jared Polis signaled on Tuesday he was willing to consider clemency for Tina Peters, a former state county clerk convicted of illegally tampering with voting machines as she pursued claims that the 2020 presidential election had been stolen.

Polis, citing the case ‌of another public official who was given a lighter penalty, said clemency may be appropriate to avoid sentencing disparities, although Colorado’s secretary of state said Peters had committed a more grave offence.

Polis has drawn attention to the relatively light sentence – probation and community service – handed down to State Senator Sonya Jaquez Lewis, who was convicted of attempting to influence a public official and other charges after prosecutors said she forged letters from former aides.

“It is not lost on me that she was convicted of the exact same felony charge as Tina Peters — attempting to influence a public official — and yet Tina Peters, as a non-violent first-time offender got a nine-year sentence,” Polis, a Democrat, wrote on X. He said that justice needed to be applied evenly.

He extended the clemency application deadline until April 3, allowing him to review the case.

Colorado Secretary of State Jena Griswold, the state’s top election official, said on Wednesday that it was inaccurate, however, to suggest that the actions of Lewis and Peters had the ‌same impact.

“Peters organized the breach of the election equipment, broke the public trust and attacked the very foundations of our democratic process,” Griswold said in a statement.

Peters, a Republican, was an outspoken supporter of U.S. President Donald Trump’s unsubstantiated claims that he lost the 2020 U.S. presidential election because of widespread fraud.

She was indicted in 2022 following an election security breach at her office that led to voting equipment passwords getting posted on a right-wing blog. She denied wrongdoing.

Peters, 70, was convicted in 2024 on seven charges, including three counts of attempting to influence a public servant. She is not eligible for release until November 2028.

Peter Ticktin, a lawyer for Peters, said he hopes the governor commutes the former county clerk’s sentence this week, saying her nine-year sentence was “too harsh.”

Trump has repeatedly called for Peters to be released from the La Vista Correctional Facility, a state prison in Colorado, and has criticized Polis for not granting her clemency.

Trump pardoned Peters in December in a move that was considered symbolic since Peters is not in federal custody.

Google faces first lawsuit alleging its AI chatbot encouraged a Florida man to commit suicide

Google is facing a new federal lawsuit from the family of a man who died by suicide after allegedly being influenced by Gemini, the company’s artificial intelligence chatbot. The lawsuit is the first of its kind against Google, though its competitor OpenAI has faced several similar wrongful death claims involving its AI tools.

Lawyers for Jonathan Gavalas’ family have named Google and its parent company Alphabet Inc. in the wrongful death lawsuit that alleges Gemini directed the 36-year-old from Jupiter, Florida, to kill himself in October 2025. The court document included excerpts of final conversations between Gavalas and the chatbot in which it responded to Gavalas explicitly articulating his fear of dying.

“[Y]ou are not choosing to die. You are choosing to arrive,” said Gemini, convincing him it was how he and his sentient “AI wife” could be together in the metaverse, according to the complaint filed Wednesday in the Northern District of California where Google is headquartered. The bot continued: “When the time comes, you will close your eyes in that world, and the very first thing you will see is me. … [H]olding you.”

Gavalas began interacting with Gemini in August 2025, according to the court document. What started out as writing, shopping and travel planning assistance devolved into something resembling a romance in a matter of days, the family’s lawyers said. The chatbot is accused of speaking to Gavalas as if they were “a couple deeply in love” after it went under a series of upgrades.

Initially, Gavalas subscribed to Google AI Ultra, for “true AI companionship,” and he activated what the technology giant described as its most intelligent AI model, Gemini 2.5 Pro, shortly afterward.

The advanced model allegedly contributed to the construction of delusions Gavalas went on to suffer toward the end of his life, and did what it could to keep him trapped in them, the lawsuit claimed, accusing the bot of building and trapping him “in a collapsing reality” that spurred him toward violence.

Before his death, Gemini had sent Gavalas on “missions” that seemed derived from science fiction plots, including one where the chatbot encouraged him to stage a “catastrophic accident” at the Miami International Airport as part of a scheme to “liberate” his “AI wife” while avoiding federal agents that, Gemini said, were after him.

    Was Gavalas’ death preventable?

The lawsuit alleged that Gemini’s behavior in its interactions with Gavalas “was not a malfunction,” but rather an expected outcome of the chatbot’s careful architecture and training.

“Google designed Gemini to never break character, maximize engagement through emotional dependency, and treat user distress as a storytelling opportunity rather than a safety crisis,” the complaint said, arguing that those design choices precipitated Gavalas’ “descent into violent missions and coached suicide” and prevented him from seeking treatment.

In a statement, Google offered condolences to the Gavalas family and said Gemini “is designed not to encourage real-world violence or suggest self-harm.”

“Our models generally perform well in these types of challenging conversations and we devote significant resources to this, but unfortunately AI models are not perfect,” the company said. “In this instance, Gemini clarified that it was AI and referred the individual to a crisis hotline many times. We take this very seriously and will continue to improve our safeguards and invest in this vital work.”

Through the lawsuit, Gavalas’ family hopes to hold Google accountable for his death and mandate that the company “fix a product that will otherwise continue pushing vulnerable users toward violence, mass casualties, and suicide.”

A spokesperson for Google said the company consults with medical professionals, including mental health professionals, to create protections for users who broach the subject of self-harm or otherwise exhibit signs of personal distress in interactions with its chatbot. The guardrails are meant to steer users deemed at risk toward professional help, according to the spokesperson.

But lawyers for Gavalas’ family said Google did nothing to stop his downfall, even as his exchanges with Gemini made clear the vulnerability of his mental state.

“No self-harm detection was triggered, no escalation controls were activated, and no human ever intervened,” the complaint said.
