    Senate Republicans are taking stock of their relationship with the House GOP as they gear up for another key test of their unity across chambers.

    Dysfunction, miscommunications and wasted time have dotted the last few months of Republicans’ control of Congress, particularly during the longest government shutdown on record.

    Republicans in the upper chamber aren’t singling out others in the House who should bear responsibility, but they do agree that something needs to change as they plow forward to fund immigration operations for the next few years.

    “I think we all need to get in a room and figure out what’s our plan,” Sen. Katie Britt, R-Ala., told Fox News Digital. “And how are we going to get things done for the American people? That has to be the goal, and right now something needs to change.”

    Republicans are readying to fund Immigration and Customs Enforcement (ICE) and Border Patrol for the next three and a half years through budget reconciliation, which will require near-perfect unanimity in both chambers to work, given that Democrats are getting cut out of the process.

    But divisions between the chambers were laid bare during the Department of Homeland Security (DHS) shutdown, when House Republicans, led by House Speaker Mike Johnson, R-La., refused to consider the Senate’s compromise plan to reopen the agency.

    That decision prolonged the shutdown for nearly a month, and spurred the necessity to turn to reconciliation. It also fostered frustration between the Senate and House at a time when leadership and President Donald Trump are calling for unity.

    Both Johnson and Senate Majority Leader John Thune, R-S.D., have thin majorities to work with — Johnson more so than Thune. That reality isn’t something that’s lost on Senate Republicans, particularly on legislation that Democrats won’t support, and is so far preventing the knives from coming out in the upper chamber.

    “I mean, I think we understand the challenges that Mike has over there. He’s not king. He’s the speaker of the House,” Sen. Roger Marshall, R-Kan., told Fox News Digital. “And their margin of error is less than ours, proportionately. So I can’t imagine. I think he’s doing the very best he can.”

    Some Republicans argue that it’s more of a communication issue between the chambers than unfettered dysfunction in the House.

    Sen. Bernie Moreno, R-Ohio, told Fox News Digital he didn’t buy the “whole House’s dysfunction” argument, and instead said it was incumbent on senators to make more of an effort.

    “I think we have to take a little bit of ownership ourselves here in the Senate, and that’s certainly not just the leadership, but all of us,” Moreno said. “Because when we’re working on bills, we should have total, complete synchronicity with the House.”

    House Republicans, for example, contended that they were blindsided by the Senate deal to reopen the bulk of DHS earlier this year that carved out funding for ICE and Border Patrol.

    “We’ve got to be able to make sure we’re communicating better and working through the issues,” Sen. James Lankford, R-Okla., told Fox News Digital. “The House isn’t our enemy. We gotta be able to resolve all the issues on a piece of legislation. We have differences of opinion. OK, let’s work them out.”

    The issue of communication is one that, since Republicans took control of both chambers last year, was largely handled by DHS Secretary Markwayne Mullin, the former GOP senator who acted as a de facto liaison between both chambers for major legislative pushes.

    When asked if Republicans needed a Mullin 2.0, Lankford said that the main points of communication fell on Thune and Johnson.

    And Thune has not been quick to criticize Johnson or House Republicans publicly and noted that the nature of both chambers and how they operate would lead to issues along the way.

    “We obviously have a 60-vote threshold,” Thune said. “We need Democrats. You know, he doesn’t need Democrats, but he needs every Republican, and that’s a real challenge on a good day. And, you know, sometimes there aren’t a lot of good days around here.”

    Conversely, Senate Majority Whip John Barrasso, R-Wyo., argued that despite the issues, if Democrats were in control of the chambers, Americans would have been hit with the largest tax hike in decades had Republicans not mustered a unified front to pass Trump’s “big, beautiful bill.”

    “All of that would have been in the opposite if the Democrats had been in the majority and been able to do what they wanted to do to raise taxes,” Barrasso told Fox News Digital.

    Several veterans’ benefits programs, payments for 9/11 families, a ban on TikTok on government devices, and changes Congress made to how presidential elections are certified in light of the January 6 Capitol attack are all in jeopardy with a case challenging how the Democratic-led US House relied on proxy votes to pass a massive, Covid-era funding bill.

    The case stems from the years-old Republican pushback to the move by then-Speaker Nancy Pelosi to allow members to vote remotely during the pandemic. The lawsuit, filed by Texas Attorney General Ken Paxton, is moving forward in an appeals court known for embracing far-right arguments out of step even with the conservative US Supreme Court.

    Paxton is now running for the Senate, where legislation is routinely passed without its members physically present. Sen. Mitch McConnell, who once led the chamber Paxton now seeks to join, is supporting Congress’ power to use proxy voting, even as the Kentucky Republican was critical of Democrats’ choice to do so during the public health crisis.

    A federal judge in the far-flung Texas district where Paxton filed the lawsuit previously ruled in the case that the role remote voting played in Congress’ passage of a $1.7 trillion appropriations package violated the Constitution. While a three-judge panel of the 5th US Circuit Court of Appeals reversed that ruling, the full court hinted its openness to Texas’ arguments by throwing out the panel’s opinion and agreeing to rehear the case, with oral arguments on Tuesday.

    The case affects only a provision of the law concerning workplace accommodations for pregnant employees. But if the appeals court agrees with Paxton’s arguments, it will create a precedent making any part of the massive appropriations package vulnerable to legal challenge in the 5th Circuit, which covers Louisiana, Texas and Mississippi. If the case ultimately lands before the Supreme Court and the justices side with Paxton, such a precedent would apply nationwide.

    Among the other provisions in the appropriations bill that the case endangers are an expansion of summer meal programs for low-income schoolchildren, legislation aimed at addressing doping in the horse-racing industry, and a permanent option for states to offer 12 months of postpartum Medicaid coverage. The Trump administration has continued the defense mounted by the Justice Department under President Joe Biden for how the House passed that bill.

    The implications of the case are even broader, according to a friend-of-the-court brief from McConnell. The logic of the lawsuit threatens the way the Senate does much of its business by unanimous consent and voice votes, while inviting the courts to meddle with Congress’ internal rulemaking, he told the appeals court.

    “The thing that you hear generally, from a lot of folks, is that the House and the Senate have to be able to set their own internal procedures,” Molly Reynolds, the vice president and director of Governance Studies at the Brookings Institute, told CNN. “Those are things that the two chambers have to have power over, if they’re going to function and conduct the business of the country.”

    The long tail of a political battle over proxy voting

    Under the rules adopted by the Democratic-controlled House in May 2020, lawmakers who did not want to travel to Washington, DC, or otherwise be in the chamber to vote because of Covid-19 could designate a lawmaker on the floor to vote on their behalf.

    Republicans were mostly against the idea at first, a reflection of the partisan divide over how aggressively to respond to the virus, according to Reynolds. Some Republicans even sued Pelosi and other House officials. But the federal courts in DC rejected the lawsuit, and the Supreme Court declined to take it up.

    As time went on, the use of remote voting evolved. Some members — including Republicans — embraced proxy voting for non-Covid-related reasons, such as using it to stay at home with a newborn child or to stay on the campaign trail.

    When the GOP regained the House gavel in January 2023, then-Majority Leader Kevin McCarthy ended the practice — but not before the outgoing Democratic majority passed an annual spending bill just before Christmas 2022 with 226 members voting by proxy, outnumbering the 205 present in the chamber.

    Paxton’s lawsuit challenges that law, alleging that it was unconstitutional under the Constitution’s Quorum Clause because the House lacked a majority physically present to pass the bill. Some of the same Republicans who filed the failed lawsuit in DC are now supporting Paxton in the case, with a friend-of-the-court brief led by Texas Rep. Chip Roy, a vocal proxy-voting critic who is now running for Paxton’s job.

    “While it may be easy to adopt legislative shortcuts or turn a blind eye to the Constitution in times of crisis, our Framers ensured that no such measures could be taken,” the Republicans wrote.

    Paxton filed the case in Lubbock, Texas, where two-thirds of all civil lawsuits are assigned to Judge Wesley Hendrix, an appointee of President Donald Trump who has sided with Texas in other high-profile cases against the federal government in matters concerning emergency room requirements for abortion care and climate change regulations.

    The Justice Department under Biden asked for the case to be moved to Austin or Washington, DC, alleging “judge shopping” by Paxton’s office and arguing that those venues made more sense for procedural reasons. Hendrix rejected the request and ultimately ruled in Paxton’s favor in 2024 that the appropriations bill was passed in violation of the Constitution’s Quorum Clause.

    Hendrix’s ruling invalidated only a smaller piece of legislation tucked into the law, the Pregnant Workers Fairness Act, which requires workplaces to extend certain accommodations to pregnant employees. He concluded that Texas proved the workers’ law was harming the state in a way that gave it standing in the case, but he said Paxton’s attacks against other pieces of the law failed to meet that procedural threshold.

    A three-judge panel of the 5th Circuit reversed Hendrix’s ruling, but the full 5th Circuit’s announcement this year it would hear the case was a signal it may be inclined to side with Texas.

    Paxton’s office and the Justice Department did not respond to CNN’s inquiries.

    “The Quorum Clause focuses on participation, not on physical presence,” the Justice Department said in a court brief.

    Wide-ranging implications

    While only the pregnant workers provision is targeted in the appeal, a 5th Circuit ruling finding its passage unconstitutional would open the door to lawsuits challenging any other part of the massive appropriations package.

    As a practical matter, litigants will run into hurdles suing over government money that has already been spent. But year-end spending packages are often stuffed with an assortment of other, non-funding-related pieces of legislation, and this law was no different.

    More than half of its 1,600-plus pages of legislative text are devoted to law changes outside of the appropriations process. That includes the Electoral Count Act, which lawmakers drafted in response to the January 6, 2021, Capitol attack to clarify that vice presidents play only a ceremonial role in Congress’ certification of the election.

    It also included a raft of veterans’ support bills that boosted health services for former members of the military and that protected them from predatory debt collection procedures. Also in the law was the Fairness for 9/11 Families Act, which facilitates certain payments to the families of victims of that terrorist attack. A major overhaul of rules for retirement savings was included in the appropriations package, as was a fix to the 2021 law that created the Horseracing Integrity and Safety Authority to respond to another court ruling finding the anti-doping measure was unconstitutional.

    The appropriations bill also created three temporary judgeships, raising questions about how any precedent against the funding law’s constitutionality could be used to challenge decisions by those judges.

    Potential impacts going forward

    The spending package for 2023 was the only bill the House voted on while pandemic remote voting was allowed where there wasn’t a majority on the floor, as Hendrix’s opinion noted.

    In its briefs with the 5th Circuit, Paxton’s office played down the potential reach of the case, arguing that “decision in favor of the State will affect only one law from the short-lived proxy-voting era.”

    Still, former national security officials wrote in their own friend-of-the-court brief that courts should not constrain Congress’ ability to allow remote voting going forward. Doing so could hobble the government in the event of another public health crisis, natural disaster or terrorist attack, they said.

    “Nationwide threats unfolding over the course of days or weeks could prevent or significantly delay Congress’s ability to convene in person,” wrote the group of former officials, who include ex-CIA Director Michael Hayden and Adm. Michael Mullen, a former chairman of the Joint Chiefs of Staff.

    “But even brief disruptions could be disastrous. If Congress needed to act within hours—to raise or suspend the debt ceiling, enact or extend appropriations, or respond to an imminent national security threat—an inability to convene physically could trigger severe economic, diplomatic, or security consequences,” they added.

    The case also looms over the tools the Senate uses hundreds of times a year to approve bills, resolutions and nominees without a recorded vote. The legal threats to those procedures, known as voice votes and unanimous consent, “significantly impair the daily operations of the Senate,” McConnell said in his brief, which was authored by former Attorney General Bill Barr.

    While the lower court’s ruling in the case tried to distinguish those procedures from House proxy voting, McConnell was not convinced.

    “Without procedures for conducting business without a majority physically present on the floor of the Senate, business would grind to a halt,” he said.

    Voters are going to the polls in Nebraska and West Virginia on Tuesday, with Democrats vying for the chance to run in an open seat in Nebraska that the party has long been eyeing.

    Republican Rep. Don Bacon is retiring in January, leaving a seat open in a district that has voted for Democrats in the last five presidential elections. Several Democrats are vying for the chance to take on presumptive Republican nominee Brinker Harding, a member of the Omaha City Council who is running unopposed in the GOP primary.

    Also in Nebraska, GOP Sen. Pete Ricketts faces a slew of primary challengers while two Democrats are running in the primary — but the state Democratic party has endorsed Dan Osborn, who is running in November as an independent.

    And in West Virginia, GOP Sen. Shelley Moore Capito faces five challengers, and five Democrats are on the ballot to secure the nomination for November.

    Nebraska 2nd District

    The leading Democratic hopefuls in Nebraska’s 2nd Congressional District have been battling over whether one candidate’s campaign damages the party’s competitiveness in the area.

    Nebraska state Sen. John Cavanaugh and political organizer Denise Powell are leading a crowded Democratic primary for Bacon’s Omaha-area seat, which he has held for five terms.

    At issue in the race is how deep-red Nebraska splits its electoral college votes in presidential elections. Powell argues that Cavanaugh’s potential success gives Republicans an opportunity to change how the state awards its electoral college votes to a winner-take all system. The state currently awards most of its votes by congressional district, giving Democrats a chance to deny Republicans of at least one vote in the 2nd Congressional District.

    Nebraska Senate

    Ricketts was nominated in 2023 to finish the rest of former GOP Sen. Ben Sasse’s term, and he won a special election the following year to finish the term. He is now running for his first full term.

    Ricketts, a former governor and the son of Nebraska billionaire Joe Ricketts, is facing four primary challengers on Tuesday, with Ricketts having been backed by President Trump and the Nebraska Farm Bureau. Ricketts is already focusing on a matchup against Osbon in November.

    Osborn, a former labor leader from Omaha, is running as an independent, but he has been endorsed by the Nebraska Democratic Party for the general election. Osborn took on Republican incumbent Sen. Deb Fischer in 2024 and came up less than 7 points of her in a state that Mr. Trump won by over 20 points. But Ricketts was also on the ballot that year, and won his race by more than 25 points against a Democratic challenger.

    Nebraska has not elected a Democrat to the Senate since 2006, when Sen. Bill Nelson defeated Ricketts.

    There are two Democrats on the ballot on Tuesday, although Nebraska Secretary of State Bob Evnen in March had sought to remove Cindy Burbank from the ballot for not being a “good-faith” candidate because she has said she will back Osborn for the general election. The Nebraska Supreme Court later reinstated her candidacy, saying Evnen’s complaint had been filed too late.

    Burbank’s campaign website accuses the other Democrat on the ballot, pastor William Forbes, of trying to get on the ballot in November to divert votes from Osborn. Her campaign website says Osborn deserves a “fair shot against Ricketts.”

    “William Forbes is a Ricketts plant,” Nebraska Democratic Party chair Jane Kleeb posted on social media last week. “Don’t let the MAGA Republicans mess with our primary. Vote for Cindy Burbank.”

    Both Ricketts and Forbes have insisted that Forbes’ candidacy is in good faith. Forbes, who is anti-abortion, told CNN he voted for Mr. Trump multiple times but said he is a lifelong Democrat.

    There are also two Legal Marijuana NOW party candidates running on Tuesday, although one candidate, Early Starkey, and the former party chair have accused the other candidate, Mike Marvin, of being a “Dan Osborn plant, which Marvin denied to the Nebraska Examiner. The Examiner also reported that Burbank paid Marvin’s filing fee, which she said was because “Mike’s check was for ten dollars too much.”

    Osborn, who is not on the ballot Tuesday since he is running as an independent, has raised over $3.8 million this year and faces an Aug. 3 deadline to get enough signatures to be on the ballot in November. Ricketts has raised over $4.8 million.

    Other races

    Nebraska’s Republican Gov. Tom Pillen is facing five primary challengers, while two Democrats are running for the Democratic nomination.

    And in West Virginia, two-term incumbent Capito, a Republican, is facing state Sen. Tom Willis and four other challengers on Tuesday. Moore Capito has received Mr. Trump’s endorsement. Five Democrats are running for the Democratic nomination to the Senate seat.

    Denise Powell, who cofounded the political action committee Women Who Run Nebraska, and state Senator John Cavanaugh are the top candidates in the crowded Democratic primary.

    Powell has framed her moderate campaign as ​one that can protect Nebraska’s “blue dot.” President Donald Trump won the statewide popular vote in 2024 by more than 20 percentage points and ​two of its three congressional districts by double digits.

    Cavanaugh, the progressive candidate, has derided Powell as “Dark Money Denise.” If ⁠he were to win, Nebraska’s Republican governor would appoint his replacement in the state legislative chamber and boost the Republican majority, which some Democrats warn could ​allow the party to pass a stricter abortion ban.

    Cavanaugh’s allies have called that narrative “MAGA Republican” lies, saying Democrats are poised to pick up seats in state ​legislative races.

    Brinker Harding, an Omaha city councilman, is running uncontested for the Republican nomination. He has raised $1.3 million, according to campaign finance disclosures, and reported having more cash on hand than both Powell and Cavanaugh combined.

    Democrat Kamala Harris won the district at the presidential level in 2024 by less than 5 percentage points. The district is one of three districts ​won by Harris and currently represented by a Republican. Bacon’s seat is the only Harris-won district with no incumbent, making it a top target for ​Democrats.

    NARROW HOUSE MAJORITY AT STAKE

    Republicans hold a narrow 217-212 majority in the U.S. House of Representatives, where the chamber’s lone independent caucuses with Republicans. There are five vacancies due ‌to deaths ⁠and resignations.

    Democrats would need to net three seats in November’s midterm elections to win control of the House for the final two years of Trump’s presidency. The president’s party traditionally loses seats in the midterms, but Trump has urged Republican-led states to redraw their congressional maps to preserve a majority in Congress.

    Trump’s nudge launched a national redistricting war between the parties, which scrambled to create advantages for their respective parties in states such as Texas, California, Florida, Louisiana and Tennessee.

    Republican-led states ​across the South have also redrawn ​their maps following the Supreme Court’s ⁠recent decision gutting Section 2 of the Voting Rights Act. The ruling threatens once-protected majority-minority districts across the South.

    SENATE RACE DRAWS UNUSUAL FIELD

    Republican Senator Pete Ricketts of Nebraska is expected to win the primary for his party’s nomination on ​Tuesday. Dan Osborn, his top opponent in November, is running as an independent. Osborn lost to Republican Senator Deb ​Fischer in 2024 ⁠by less than 7 percentage points, significantly overperforming Harris statewide.

    There will also be a Democratic primary, even though the state party has said it chose not to field a candidate because Osborn has the best chance to unseat Ricketts.

    William Forbes, an anti-abortion Trump voter, launched his campaign for the Democratic nomination in March. Democrats have ⁠accused Forbes of “running ​to trick voters.”

    Cindy Burbank also launched her campaign in March. Her website calls Forbes a “fake” ​Democrat who would simply split Democrats’ votes to help Ricketts win reelection. While asking voters to back her in the primary, Burbank also says Osborn “deserves a fair shot against Ricketts,” suggesting she ​would end her campaign if she won the Democratic nomination so Osborn could have a head-to-head race against Ricketts.

    综合路透社和法新社报道,乌克兰和俄罗斯此前同意于5月9日到11日期间停火,美国总统特朗普日前说,希望停火能够延长。尽管停火期间双方均未报告大规模袭击,但都指前线战斗仍持续,互指对方发动无人机袭击和炮击。

    乌克兰外长瑟比加在社媒平台上称,基辅曾提议延长停火,但莫斯科却反而升级了冲突。“我们曾提议莫斯科将部分停火延长至5月11日之后。然而,就在今夜,俄罗斯向乌克兰发射了200多架无人机,袭击了包括一所幼儿园在内的民用基础设施,造成至少六人受伤,一人死亡。”

    乌克兰空军称,自星期一傍晚6时起,俄罗斯共发射216架无人机,其中192架被击落或摧毁。

    克里姆林宫星期二说,为期三天的停火协议结束后,俄军已恢复在乌克兰的军事行动。

    俄罗斯媒体报道,俄罗斯国防部称,过去24小时,防空系统已击落108架无人机。
