Obamacare enrollment drops after enhanced premium subsidies expire

    By Tami Luhby | 1 hr 15 min ago | PUBLISHED Jan 28, 2026, 10:29 PM ET

More than a million fewer people have signed up for Affordable Care Act coverage for 2026, according to federal data released Wednesday. The drop comes after the expiration of the enhanced federal premium subsidies caused monthly payments to skyrocket for many enrollees.

Just under 23 million people selected plans for 2026, according to the Centers for Medicare and Medicaid Services. That compares to just under 24.2 million people in roughly the same period last year. The data includes all sign ups in the 30 states using the federal exchange, where open enrollment ended January 15. But it doesn’t capture full enrollment in all the states that run their own exchanges, a few of which are allowing people to sign up through the end of this month.

However, total enrollment is likely to fall in coming months, experts said. A sizeable share of consumers were automatically reenrolled in policies and may not realize how much their premiums will rise until they get their first bill. This may prompt them to drop coverage or simply not pay, which will result in their being disenrolled in April.

“That number does not tell the full story. These numbers are going to go dramatically down month after month as people decide that they can’t afford health care and stop paying their premiums,” Leslie Dach, chair of Protect Our Care, an advocacy group, said in a statement.

Those who keep their coverage are likely contending with higher premium payments or higher deductibles due to the lapsing of the enhanced premium subsides, said Cynthia Cox, director of the Program on the ACA at KFF, a health policy research group. Premium payments are expected to climb by 114%, on average, this year, according to KFF.

The Congressional Budget Office projected that 2 million fewer people would have Obamacare coverage this year due to the ending of the more generous federal subsidies.

The enhanced assistance was enacted by the Biden administration as part of a 2021 Covid-19 relief package, but it expired at the end of 2025. The additional aid had spurred a large spike in Obamacare enrollment, particularly among low-income Americans who could get policies with no or very low premiums. The enhanced subsidies also made coverage more affordable for middle-class enrollees, who previously didn’t qualify for help.

The lapsing of the subsidies sparked a fierce partisan battle on Capitol Hill that led to a record-long government shutdown last fall. Democrats insisted on tying funding the federal government to extending the subsidies but eventually relented as the shutdown dragged on. The House last month passed a three-year subsidy extension after several Republican lawmakers voted with the Democrats, but the legislation has been unable to advance in the Senate amid stiff opposition from the GOP.

The decline in sign ups for 2026 is the first drop since 2020, when 11.4 million people picked plans. Enrollment gradually slid throughout President Donald Trump’s first term.

    Fewer enrollees

Interest in Obamacare policies for 2026 fell among new customers in particular. Just under 3.4 million new consumers signed up for policies, down 14% from a year earlier. Returning customers numbered just under 19.6 million, a decline of 3%.

The largest drops in overall signups include North Carolina, with a 22% plunge, and Ohio, with a 20% decline, Cox said. But the biggest increases were in New Mexico, where plan selections soared 14%, and the District of Columbia, with a 9% jump.

Several states that run their own exchanges saw their enrollment dip as a larger number of people canceled their plans for this year.

In Colorado, just over 277,000 people selected policies by the end of the state’s enrollment period, down 2% from last year. The number of new enrollees slid by nearly a quarter. This comes even as the state enacted its own premium assistance program to help replace the enhanced federal subsidies.

“On one hand, it’s encouraging to see enrollment remain relatively steady, with only a slight dip, and to see so many people receive meaningful financial assistance,” Kevin Patterson, CEO of Connect for Health Colorado, said in a news release. “On the other hand, it’s deeply troubling that a record number of people are canceling their plans because they simply can’t afford their monthly payments or are being forced to choose between health care and basic necessities like housing and food.”

Talks intensify to avert shutdown as White House and Senate leaders eye last-ditch deal

Senate Minority Leader Charles Schumer (D-NY) talks to reporters following the weekly Senate Democratic policy luncheon at the US Capitol in Washington DC, on January 28, 2026.

    Chip Somodevilla/Getty Images

The White House and Senate leaders are moving closer to a deal to avert a government shutdown but are seeking to resolve final sticking points in eleventh-hour negotiations ahead of Friday’s deadline, according to several sources familiar with the talks.

The sources indicated that the White House was moving closer to the Democrats’ demands to split funding from the Department of Homeland Security from a larger funding package in order to give them time to negotiate new policy measures on the deployment of ICE agents across the country.

The deal in the works would provide funding for the rest of the agencies in the package through the end of September — including the departments of Defense, Labor, State, Transportation and Health and Human Services. But it would only temporarily extend funding for DHS. That would allow time for the two sides to negotiate over ICE, after Senate Minority Leader Chuck Schumer laid out a list of demands that he says must be included in final legislation.

    Ad Feedback

The two sides are still trying to sort out the timeline for extending funding for DHS, the sources said, underscoring that a deal has not yet been reached.

But the fast-moving talks are a clear sign that President Donald Trump and GOP leaders recognize that they need to respond to the public outcry over ICE agents’ harsh tactics following the deadly shootings of two US citizens in Minneapolis this month. Plus, it’s a sign that Trump is eager to avoid the second government shutdown of his second term, after the 43-day shutdown from last fall left him upset about the fallout.

CNN has reached out to the White House for comment.

Earlier Wednesday, Schumer laid out a list of new restraints on immigration enforcement as a condition for Democratic support, including to restrict roving patrols, tighten parameters around warrants for searches and arrests, toughen use-of-force policies and require ICE agents to wear body cameras and remove their masks. Democrats, who have enough votes to sustain a filibuster in the 53-47 GOP-led Senate, say such changes must be in legislation — and that promises of executive action are not enough.

This is a developing story and will be updated.

The Justice Department is bracing for a new wave of resignations in the Minnesota federal prosecutors’ office over recent immigration enforcement efforts in the state, sources familiar with the matter said.

Prosecutors threatened to resign during a recent meeting in which US Attorney Daniel Rosen had tried to convince his office to get on board with the Trump administration’s efforts in Minnesota, the sources said. His plea so far hasn’t assuaged concerns within the office that the administration is taking potentially unlawful steps.

One of the sources said that if the resignations came to fruition, they could decimate the US Attorney’s office as they are pursuing cases against immigrants and protesters, and pile onto an already thin staff after an earlier wave ofresignationsover how the Justice Department responded to a federal officer’s shooting of Renee Good.

The meeting and potential resignations are being watched closely by Justice Department officials in Washington, and the department has been taking steps to pull prosecutors from other Midwestern offices into Minnesota to help. The Justice Department declined to comment for this story.

Attorney General Pam Bondi was in Minnesota on Wednesday, her second trip in as many weeks. At least some of her meetings there were to boost morale at the US Attorney’s office, according to a person familiar with the visits.

Justice Department prosecutors from other states are in Minnesota to assist the office while it is understaffed, and the department could request more. Previous resignations this month included some leaders in the office beneath Rosen. The Pentagon is also sending dozens of military lawyers to Minneapolis to assist in federal prosecutions.

Also on Wednesday, the chief judge of the federal district court in Minnesota complained in a sharply worded order that he believes Homeland Security officials were violating court orders by the dozens this month in cases related to immigrants in custody.

The court and the US attorney’s office prosecutors are fielding search and arrest warrants related to protests as well as immigrant detainees’ requests for relief, leading to increased tensions between prosecutors and judges.

FBI searches Fulton County elections office seeking 2020 ballots. Here’s what we know.

    Updated on: January 29, 2026 / 12:02 AM EST / CBS News

The FBI executed a search warrant Wednesday at an elections office in Fulton County, Georgia, seeking to take ballots in an investigation that a source told CBS News is linked to the 2020 presidential election.

Fulton County confirmed that the FBI executed a search warrant at its election operations center and “sought a number of records related to 2020 elections.” A state senator who was present told reporters the FBI sought hundreds of boxes of ballots.

The search drew several top Trump administration officials. Deputy FBI Director Andrew Bailey and Director of National Intelligence Tulsi Gabbard were both spotted outside the elections office late Wednesday. A news conference with federal officials was initially scheduled then later canceled.

“Director Gabbard has a pivotal role in election security and protecting the integrity of our elections against interference, including operations targeting voting systems, databases, and election infrastructure,” a senior administration official told CBS News.

The FBI operation follows years of claims by President Trump — without evidence — that the 2020 election was rigged, many of which have zeroed in on Fulton County.

What is the FBI investigating in Fulton County?

It’s not entirely clear what information the FBI is seeking, though the agency confirmed in a statement that it carried out a “court authorized law enforcement action.”

But the bureau appears to be investigating violations of two federal criminal laws, according to a search warrant shared on social media by Fulton County commissioner Marvin Arrington Jr.

One of those laws makes it a crime for elections officials to intimidate voters and to deprive them of a fair election by submitting fraudulent ballots or voter registration applications. The other law requires elections officials to retain federal election records for 22 months.

The warrant was signed by U.S. Magistrate Judge Catherine Salinas. Typically, in order to get a search warrant, authorities must show probable cause that there is evidence of a crime at a particular location. It’s unclear what evidence the FBI has presented.

Democratic state Sen. Josh McLaurin told reporters the FBI showed up at the elections office seeking to take “700 boxes of ballots,” and was seen loading boxes of ballots into trucks. McLaurin posted a video of an FBI evidence response team at the office.

The Justice Department lawyer listed on the search warrant was Thomas Albus, interim U.S. attorney for the Eastern District of Missouri. It’s unclear why Albus’s name appears on the warrant rather than a Justice Department official based in Georgia. A spokesperson for Albus’ office did not respond to a request for comment from CBS News.

The search took place at the Fulton County Elections Hub and Operations Center, but the warrant shared by Arrington was addressed to the Office of the Clerk of Court — seemingly due to a discrepancy in Georgia law.

Earlier in the day, the FBI showed up with a warrant for the Fulton County elections office, but ballots and other 2020 election paperwork are technically held under seal by the clerk of the Fulton County Superior Court under state law, forcing federal officials to seek a new warrant for the clerk’s office, Fulton County Commissioner Dana Barrett told CBS News.

Barrett said both the FBI and Clerk of Courts Che’ Alexander were filming the process of inventorying the boxes for chain-of-custody purposes.

The federal government has not publicly commented on why it carried out the search. The FBI said in a statement it can’t provide details because its “investigation into this matter is ongoing.” The White House referred a request for comment to the FBI.

Local Democratic politicians have strongly criticized the FBI and suggested it could be related to Mr. Trump’s fraud claims.

Democratic Sen. Jon Ossoff of Georgia said: “I suspect today’s raid is a continuation of this sore loser’s crusade, despite repeated audits and independent reviews confirming that Donald Trump was indeed defeated.”

Democratic Rep. Nikema Williams of Georgia demanded that the FBI cut off its investigation, writing that “raids and renewed investigations based on the lie that President Trump won the election lack a factual basis and only serve to intimidate voters and undermine the integrity of our upcoming elections.”

Robb Pitts, chairman of the Fulton County Board of Commissioners, said in a news conference late Wednesday: “For the life of me, I still cannot understand the fascination about the 2020 election, which occurred six years ago. That election has been reviewed, it’s been audited, and in every case, in every instance, we get a clean bill of health.”

Pitts also said that, following the search, “I can no longer certify that these ballots are secure.”

Sen. Mark Warner of Virginia, the top Democrat on the Senate Intelligence Committee, specifically questioned Gabbard’s involvement. He wrote that “there are only two possible explanations” for why the director of national intelligence would be present at the FBI’s search.

“Either Director Gabbard believes there was a legitimate foreign intelligence nexus — in which case she is in clear violation of her obligation under the law to keep the intelligence committees ‘fully and currently informed’ of relevant national security concerns — or she is once again demonstrating her utter lack of fitness for office that she holds by injecting the nonpartisan intelligence community she is supposed to be leading into a domestic political stunt designed to legitimize conspiracy theories that undermine our democracy,” Warner wrote.

Why is the Trump administration interested in Fulton County?

Home to Atlanta and some of its suburbs, Fulton County is the most populous county in Georgia and a key Democratic stronghold — and it played a central role in Mr. Trump’s false claims that the 2020 presidential election was stolen.

In the weeks following the 2020 race, Mr. Trump’s allies claimed, without evidence, that widespread fraud in Fulton County led to former President Joe Biden’s narrow 11,779-vote win in Georgia, and urged state officials to reverse the results. At one point, Mr. Trump told Secretary of State Brad Raffensperger: “I just want to find 11,780 votes.”

Trump-appointed Attorney General Bill Barr said in 2020 that the Justice Department hadn’t found evidence of fraud on a wide enough scale to tip the results of the election. Biden’s win in Georgia was also confirmed in both a machine recount and an audit that involved hand recounts by every county in the state.

But Mr. Trump has continued to insist that the 2020 election was “rigged,” and since returning to the White House, he has vowed to investigate the issue.

“It was a rigged election. Everybody now knows that,” the president said in a speech last week in Davos, Switzerland. “People will soon be prosecuted for what they did. It’s probably breaking news, but it should be. It was a rigged election.”

Last month, the Justice Department filed a civil lawsuit against Alexander, the Fulton County clerk of courts, asking a judge to force her to hand over the county’s 2020 election ballots and other voting records. The department said she had failed to hand over the records as part of a Justice Department investigation into whether the county complied with federal elections law.

Alexander asked the court to dismiss the lawsuit, arguing the Justice Department hadn’t offered a legitimate reason to seek the records. She also said the records were under seal, and would need to be unsealed by a state judge in Fulton County. A judge has not yet ruled on the matter.

Separately, Fulton County drew national attention because the county’s District Attorney Fani Willis criminally charged Mr. Trump and more than a dozen other people with racketeering in 2023, accusing them of illegally trying to overturn Mr. Trump’s 2020 election loss.

The case was stalled for years, in part because an appellate court removed Willis from the case over a romantic relationship she had with a special prosecutor she hired to assist in the investigation, posing a “significant appearance of impropriety.” Another prosecutor who stepped in to replace Willis decided to dismiss the prosecution “to serve the interests of justice.”
