    Swalwell says he plans to resign from Congress amid sexual misconduct allegations

    Democratic Rep. Eric Swalwell announced Monday he planned to resign from Congress following explosive allegations of sexual misconduct against him.

    The announcement from the California Democrat comes as he faced a just-announced House ethics investigation and mounting pressure on both sides of the aisle to step down. Swalwell, who has denied the allegations, had already suspended his California gubernatorial bid — though that did not tamp down the calls that he leave his job. The congressman was also confronting the prospect of a vote on the House floor to expel him.

    “Expelling anyone in Congress without due process, within days of an allegation being made, is wrong,” Swalwell said in a statement posted to X. “But it’s also wrong for my constituents to have me distracted from my duties. Therefore, I plan to resign my seat in Congress.”

    He did not indicate precisely when he would leave office. A special election to fill the congressman’s seat could take place this summer.

    CNN and the San Francisco Chronicle reported last week that a former staffer accused Swalwell sexual assault, describing a night of drinking that ended with him having sex with her when she could not consent. In addition to the allegation of sexual assault, three other women who spoke with CNN alleged other sexual misconduct, including that Swalwell sent unsolicited nude photos and graphic messages.

    Swalwell has strongly and repeatedly denied allegations of sexual assault.

    “I am deeply sorry to my family, staff and constituents for mistakes in judgement I’ve made in my past,” Swalwell said in his statement announcing his plans to resign. “I will fight the serious, false allegation made against me. However, I must take responsibility and ownership for the mistakes I did make.”

    Swalwell’s planned resignation marks a remarkable and swift political downfall.

    Elected to Congress in 2012, the California Democrat quickly rose within the ranks of his party. Appearing regularly on television and alongside leadership, Swalwell was part of his party’s most high-profile political battles on Capitol Hill and made a brief run for president in the 2020 election.

    At this time last week, the congressman was vying to win his state’s June 2 primary in the governor’s race. At that time, the allegations largely existed in uncorroborated form on social media, and Swalwell had issued a preemptive rebuttal.

    “This false, outrageous rumor is being spread 27 days before an election begins by flailing opponents who have sadly teamed up with MAGA conspiracy theorists because they know Eric Swalwell is the frontrunner in this race,” Swalwell campaign communications director Micah Beasley said in a statement at the time.

    But then came CNN’s and the Chronicle’s reporting, which led to a raft of his supporters pulling their endorsements and urging him to drop out of the race. Some went even further, saying he should leave office.

    More than 50 former Swalwell staffers signed a letter Sunday calling on him to drop out of the race and resign from Congress.

    “The allegations reported by the San Francisco Chronicle and CNN are serious, credible, and demand accountability,” the letter said. “We stand unequivocally with our colleague, who showed extraordinary courage in coming forward to share her truth. We believe her.”

    On Monday, not long before Swalwell announced he would resign, Sen. Ruben Gallego of Arizona, a longtime ally who chaired his 2020 presidential campaign, said in a statement it was time for the embattled California representative to go.

    “I support the ethics committee’s investigation and believe Eric Swalwell is no longer fit to be a Member of Congress. He should be expelled from Congress,” Gallego said in a statement, adding, “I trusted someone who I believed was a friend, but it is now clear that he is not the person I thought I knew.”

    Gallego told CNN on Monday evening that he last spoke to Swalwell on Friday after the reports about the ​sexual assault allegation surfaced. He said he pressed Swalwell to get out of the governor’s race and resign.

    “As soon as I got in the car, I told him, ‘Take care of your family, get out,’” Gallego said.

    While it was not yet clear whether an effort to expel Swalwell would succeed, some members of his own party had begun plotting how to remove him from the House after reading details of the alleged sexual misconduct with disgust.

    And he was not the only member these Democrats had been seeking to punish with expulsion — the most severe consequence possible for a member of Congress. Some Democrats had been privately signaling they would be willing to vote to oust Swalwell only if Republicans did the same for one of their own embattled colleagues, multiple sources told CNN.

    Behind the scenes, a plan had emerged for a woman from each party, Democratic Rep. Teresa Leger Fernández of New Mexico and GOP Rep. Anna Paulina Luna of Florida, to each draft an expulsion measure to force separate removal votes targeting members who had publicly faced allegations of wrongdoing. The GOP representative’s measure would target Swalwell, while the Democrat’s would target GOP Rep. Tony Gonzales of Texas, who last month acknowledged an affair with a staffer who later died by suicide.

    Not long after Swalwell’s announcement, Gonzales similarly announced in a surprise move that he, too, would step down from Congress imminently.

    “There is a season for everything and God has a plan for us all. When Congress returns tomorrow, I will file my retirement from office. It has been my privilege to serve the great people of Texas,” Gonzales said in a statement posted to X.

    Swalwell’s resignation isn’t the end of the fallout from the allegations. The Manhattan District Attorney’s Office said Saturday it is investigating the allegation of sexual assault the former staffer said took place in New York. The Alameda County District Attorney’s Office told CNN in a statement Saturday it is “evaluating whether any alleged criminal conduct occurred within” the Bay Area county, where the same woman accused Swalwell of a separate act of sexual misconduct she said took place in 2019.

    Once a member of the House Intelligence Committee, Swalwell played a high-profile role in both impeachments of President Donald Trump. Swalwell was appointed by then-Speaker House Speaker Nancy Pelosi to serve as an impeachment manager to argue Democrats’ case in the Senate during Trump’s second impeachment trial in 2021.

    In 2023, then-House Speaker Kevin McCarthy denied seats on the intelligence panel to Swalwell and Adam Schiff, a fellow California Democrat and the former chairman of the panel.

    “I cannot put partisan loyalty ahead of national security, and I cannot simply recognize years of service as the sole criteria for membership on this essential committee. Integrity matters more,” McCarthy wrote in a letter to House Minority Leader Hakeem Jeffries as he announced the move.

    Swalwell had also previously faced a separate House Ethics Committee probe unrelated to the misconduct allegations.

    The committee closed the prior investigation in 2023 without taking action. The inquiry was opened following claims that Swalwell had been targeted by a suspected Chinese intelligence operative as part of a broader effort to establish ties with US politicians.

    Swalwell told CNN in 2020 that he was “shocked” when the FBI informed him that he had been targeted and said that he immediately cooperated with federal investigators who were looking into the individual in question.

    The Washington Post reported in March that FBI Director Kash Patel was pushing to release case files from the bureau’s investigation.

    The Justice Department has fired at least four prosecutors who were involved in prosecutions under the FACE Act during the Biden administration, a government official familiar with the firings told CBS News.

    Among those fired Monday is Sanjay Patel, a longtime federal prosecutor in the Civil Rights Division’s criminal section who was placed on administrative leave last month, sources told CBS News at the time. The terminations occurred at about the same time a report on the FACE Act and the Biden Justice Department was being finalized.

    Congress passed the FACE Act in 1994 to address rising concerns about threats and intimidation that women were facing at reproductive health clinics. Nonviolent and first-time offenses of the law are misdemeanors, while repeat offenses or violations that result in bodily injury or death can be treated as felonies.

    The FACE Act report is being drafted by the Justice Department’s “weaponization working group,” established in the first days of former Attorney General Pam Bondi’s tenure.

    Tuesday’s firings mark the latest in a purge that started last year of Justice Department employees, many of whom worked on criminal or civil cases opposed by the Trump administration or President Trump’s allies.

    A Justice Department spokesperson said in a statement that the department “has terminated the employment of personnel responsible for weaponizing the FACE Act who still remained at the department.”

    Stacey Young, a former Civil Rights Division lawyer who founded and leads the nonprofit Justice Connection, said in a statement, “Congress passed the FACE Act with bipartisan support more than 30 years ago, and courts have consistently upheld the constitutionality of its provisions that ensure safe access to reproductive health services.”

    She added, “Firing DOJ attorneys for zealously enforcing the law is unconscionable — it politicizes the department’s enforcement actions and punishes dedicated civil servants for doing their jobs.”

    The Trump administration has repeatedly alleged without citing evidence that the Civil Rights Division under former Attorney General Merrick Garland used the Act to intentionally target conservative Christians who are morally opposed to abortion.

    Although the Justice Department also pursued criminal charges against abortion rights activists who were accused of trying to scare volunteers and workers at a crisis pregnancy clinic that counseled on alternatives to abortion, excerpts of a draft the report reviewed by CBS News said the total number of such cases were minimal compared to those targeting conservative anti-abortion Christians.

    Early in his second term, Mr. Trump pardoned many of the FACE Act defendants convicted during the Biden administration. The Justice Department also dismissed several other FACE Act cases and ordered prosecutors to put the brakes on future FACE Act investigations.

    At the same time, however, the current Justice Department has allowed the remaining FACE Act cases involving abortion rights activists to proceed without interference, with one Florida-based defendant receiving a 120-day prison term in March 2025.

    Many of the other former federal prosecutors who handled FACE Act cases have since left the Justice Department.

    Rep. Tony Gonzales, R-Texas, abruptly announced his decision to resign from Congress Monday evening amid calls for him to step aside after admitting to sexual misconduct with a staffer earlier this year.

    The embattled lawmaker was facing an anticipated expulsion vote that could have occurred as early as this week.

    “There is a season for everything and God has a plan for us all. When Congress returns tomorrow, I will file my retirement from office,” Gonzales wrote on social media. “It has been my privilege to serve the great people of Texas.”

    It is currently unclear when Gonzales will formally resign. A spokesperson for Gonzales did not immediately respond to a request for comment.

    Swalwell, too, was facing a potential expulsion vote that Rep. Anna Paulina Luna, R-Fla., was pressuring House GOP leadership to bring to the floor by Wednesday.

    “The actions of these two Members reflect poorly on every single one of us,” Luna wrote in a letter to colleagues on Monday that was reviewed by Fox News Digital. “We as Members of Congress need to stand together in publicly condemning this behavior and restore the trust we have lost with the American people.

    “We are the company we keep,” she added.

    Washington — Democratic Rep. Eric Swalwell said Monday he will resign from Congress as he faces allegations of sexual assault and other misconduct from several women.

    “I am aware of efforts to bring an immediate expulsion vote against me and other members,” he said in a statement. “Expelling anyone in Congress without due process, within days of an allegation being made, is wrong. But it’s also wrong for my constituents to have me distracted from my duties. Therefore, I plan to resign my seat in Congress.”

    Swalwell’s political career imploded as multiple women accused him of sexual misconduct, including rape and unsolicited explicit messages and nude photos. The congressman ended his campaign for California governor on Sunday as he hemorrhaged support.

    In his resignation announcement, Swalwell again apologized for past “mistakes in judgment,” but vowed to fight the “serious, false allegation.” The statement seemingly referred to the claims made by a former staffer, whose story was first reported by the San Francisco Chronicle on Friday.

    “However, I must take responsibility and ownership for the mistakes I did make,” Swalwell said in his statement.

    Swalwell’s resignation follows some of his closest allies in Congress distancing themselves from him in the wake of the allegations. Minutes before Swalwell’s announcement was posted, Democratic Sen. Ruben Gallego of Arizona said his friend was “no longer fit” to serve in Congress and should be expelled.

    “I trusted someone who I believed was a friend, but it is now clear that he is not the person I thought I knew,” Gallego said.

    Swalwell did not give a date for his resignation, saying he would work with his staff in the coming days to ensure they are able to continue serving his constituents once he steps down.

    The House was expected to vote in the coming days on whether to expel Swalwell, though it was unclear whether it had the two-thirds majority support it needed to successfully remove him from office. In the past, lawmakers have cited Ethics Committee investigations as reason to hold off on making any judgment until the panel has concluded its work. The House has expelled just six members in its history.

    Republican Rep. Anna Paulina Luna of Florida, who was leading the expulsion effort, said Swalwell made the right decision to resign ahead of the vote to remove him.

    Embattled Republican Rep. Tony Gonzales announced Monday that he would step down from Congress, just days before he faced the possibility of a high-stakes vote that could have made him the seventh member to ever be expelled from the House.

    The Texas Republican said he planned to “file my retirement from office” on Tuesday, which GOP leadership sources confirmed to CNN meant that he would resign. Gonzales had been under investigation by the House Ethics Committee for having a relationship with a former senior aide in his congressional office.

    It was not immediately clear when the resignation would take effect. Gonzales and Democratic Rep. Eric Swalwell have both been under fierce pressure by their House colleagues to resign after allegations that they had sexual relationships with people who had worked for them. Swalwell announced his own resignation minutes before Gonzales.

    Those two resignations in quick succession Monday night amounted to a stunning flurry of accountability, and a sudden turn in a months-long saga for the Texas Republican.     Many of the most vocal lawmakers — including Rep. Anna Paulina Luna of Florida, who had notably called to expel Gonzales even though it would hurt the GOP’s margins — are also involved in Congress’ ongoing investigation into how the federal government mishandled the investigation into serial abuser Jeffrey Epstein.

    The dramatic push for resignations marked a stunning moment on Capitol Hill.

    During the late 2010s amid the #MeToo movement, Democrats pressured members of their own party, such as Sen. Al Franken of Minnesota and Rep. John Conyers, to resign. Republicans pressured their own members, like Reps. Blake Farenthold of Texas and Trent Franks of Arizona, around the same time. All faced accusations of sexual misconduct.

    As the allegations against Swalwell unfolded, behind the scenes, a plan had emerged for a woman from each party, Democratic Rep. Teresa Leger Fernández of New Mexico and GOP Rep. Anna Paulina Luna of Florida, to each draft an expulsion measure to force separate removal votes targeting the two members. The GOP representative’s measure would target Swalwell, while the Democrat’s would target Gonzales.

    Their idea was for both parties to lose a member — which would mean no change in Speaker Mike Johnson’s fragile majority.     WASHINGTON, April 13 (Reuters) – A Minnesota county is investigating an arrest by federal agents who allegedly broke into a St. Paul home with guns drawn, handcuffed ​a man and forced him outside in the snow in his underpants ‌and sandals, only to discover they had the wrong man.

    Ramsey County officials said in a statement on Monday that federal agents “may have committed the crimes of kidnapping, burglary, and false imprisonment” ​in the January incident.

    The man mistakenly detained, ChongLy “Scott” Thao, has said the ​officers had no warrant.

    The incident has drawn further scrutiny to how federal ⁠agents have operated in Minneapolis, a city at the center of debates over ​law enforcement tactics in President Donald Trump’s immigration enforcement actions.

    Minneapolis and St. Paul, situated ​side by side, are known as the Twin Cities. Ramsey County officials said they were seeking information from the Department of Homeland Security.

    County Attorney John Choi and Sheriff Bob Fletcher said in ​the statement that Thao was handcuffed, removed from his home without consent and ​driven around and questioned while in custody for about an hour before being returned home.

    The two “criminal ‌illegal ⁠aliens” who DHS said it was seeking in that raid turned out to be elsewhere, one of them behind bars in a Minneapolis-area prison serving a four-year sentence.

    Asked about the investigation, DHS said in a statement that U.S. Immigration and Customs ​Enforcement does not kidnap ​people.

    It said its ⁠law enforcement officers were executing a warrant and concluded through surveillance and intelligence that suspected sexual predators had ties to the ​property, adding that a U.S. citizen at the house refused ​to be ⁠fingerprinted or identified facially.

    DHS added: “As with any law enforcement agency, it is standard protocol to hold all individuals in a house of an operation for safety of the public ⁠and ​law enforcement.”

    Trump earlier this year deployed thousands of ​armed agents in and around Minneapolis to detain and deport migrants in an operation in which agents fatally ​shot two American citizens, Renee Good and Alex Pretti.

    President Donald Trump turned a McDonald’s delivery into a Tax Day pitch Monday, bringing a DoorDash driver to the White House to tout the elimination of taxes on gratuities — and then surprising her with a cash tip from his pocket.

    Trump welcomed Arkansas native Sharon Simmons to the White House on Monday, where the DoorDash delivery driver handed off two bags of the president’s favorite fast food while promoting Trump’s “no tax on tips” policy ahead of Tax Day. As he gaggled with reporters and Simmons, the “DoorDash Grandma” was asked about tips received at the White House.

    “Are the White House good tippers?” a member of the media asked Simmons.

    “Wait,” Trump said before reaching into his pocket to whip out what appeared to be a $100 bill and hand it to Simmons.

    “You reminded me,” he continued.

    After accepting the tip, Simmons responded that the White House has “very” good tippers.

    Under the One Big Beautiful Bill Act, tip earners may make up to $25,000 in tax-deductible income from 2025 through 2028,according to the Tax Foundation, a think tank that studies tax policy.

    “I heard you picked up an extra $11,000 that you wouldn’t get because the tax bill was so big, the refund was the biggest you’ve ever had,” Trump said while speaking with Simmons.

    Simmons, a grandmother of 10, has completed over 14,000 deliveries since she began in 2022, according to a DoorDash press release.

    “Since No Tax on Tips was enacted, we estimate Dashers have saved hundreds of millions of dollars,” the release read.

    Max Rettig, DoorDash global head of public policy, said in the release that this moment marks a win for millions of Dashers nationwide, who can now keep more of their earnings when filing their taxes this year.

    “DoorDash is proud to advocate on behalf of Dashers like Sharon and push for policies like No Tax on Tips because they deliver real impact to so many hardworking people and their families,” said Rettig.

    Texas Rep. Tony Gonzales to step down as he faces expulsion vote

    Republican Rep. Tony Gonzales of Texas announced Monday he is stepping down as he faces an expulsion vote in the coming days stemming from his affair with a staffer who later died by suicide.

    “When Congress returns tomorrow, I will file my retirement from office,” Gonzales said.

    Under pressure from House GOP leadership, Gonzales ended his campaign for reelection in March after he admitted to the affair.

    Texts between the woman, Regina Santos-Aviles, and Gonzales that were viewed by CBS News showed Santos-Aviles saying, “This is going too far boss” after he asked for a “sexy pic” in 2024. In another text exchange with a colleague that was viewed by CBS News, Santos-Aviles wrote, “I had affair with our boss and I’m fine.”

    Santos-Aviles died in September 2025 after setting herself on fire.

    Gonzales faced bipartisan calls for his resignation earlier this year when the details of the relationship with one of his aides came to light. But GOP leaders, who have been operating with a razor-thin majority, stopped short of calling for his resignation.

    But sexual misconduct allegations against Democratic Rep. Eric Swalwell of California also renewed attention on Gonzales’ behavior. Democratic Rep. Teresa Leger Fernández of New Mexico said she would put forward a measure to expel Gonzales as Republican Rep. Anna Paulina Luna of Florida spearheaded a resolution to remove Swalwell.

    Gonzales’ retirement news came shortly after Swalwell announced he would be leaving Congress amid sexual assault allegations. The House was expected to vote on whether to expel both congressmen later this week. If their colleagues had voted to remove both from office — which would have required a two-thirds majority vote — it would not have changed the balance of the House.

    Neither Gonzales nor Swalwell gave a precise timing of when they would vacate their seats. Leger Fernández had warned that Gonzales had until 2 p.m. Tuesday to make his resignation “effective immediately” or she would move ahead on his expulsion vote.

    Their resignations also effectively put an end to the respective House Ethics Committee investigations into their alleged misconduct, as the panel does not have jurisdiction over former members of Congress.

    “There is a season for everything and God has a plan for us all,” Gonzales said Monday.
