    Before the shutdown began last week, a top FEMA official warned lawmakers that shuttering DHS could significantly strain the agency’s disaster response capabilities.

    Office of Response and Recovery Associate Administrator Gregg Phillips told a House panel examining the effects of a DHS shutdown that while FEMA’s disaster relief fund holds roughly $7 billion — enough to sustain emergency responses for the “foreseeable future” — a catastrophic event could quickly exhaust those resources.

    “That said, if a catastrophic disaster occurred, the [disaster relief fund] would be seriously strained,” Phillips said.

    For comparison, the federal government spent more than $50 billion on disaster relief during the last fiscal year. Phillips also noted that, during his nearly two-month tenure, FEMA had already spent $3 billion in 45 days on roughly 5,000 projects.

    Earlier this week, President Donald Trump said FEMA would play a “key role” in responding to a sewage spill into the Potomac River, where roughly 200 million gallons of raw sewage poured into the waterway that runs through the nation’s capital.

    The cost of FEMA’s involvement in that cleanup effort has not yet been determined, a DHS spokesperson told Fox News Digital.

    The current DHS funding bill, which Senate Democrats rejected last week, includes roughly $26 billion for FEMA’s disaster relief fund. But negotiations remain stalled as Democrats push for reforms to Immigration and Customs Enforcement (ICE).

    There has been little progress this week. Congressional Democrats sent a counterproposal to the White House late Monday, responding to an offer from the administration made last week.

    A White House official told Fox News Digital “the parties are still pretty far apart.”

    “The administration remains interested in good-faith conversations to end the Democrat shutdown before more Americans feel the impacts,” the official said. “But the administration also remains committed to carrying out the president’s promise to enforce federal immigration law.”

    Spokespeople for Senate Minority Leader Chuck Schumer, D-N.Y., and House Minority Leader Hakeem Jeffries, D-N.Y., said congressional Democrats have “been clear for weeks about the reforms needed to rein in ICE and stop the violence.”

    “We’ve continued working through language and additional issues to make progress, but Republicans have largely ignored the core guardrails Americans are demanding,” they said. “Dems are negotiating in good faith. It’s time for Republicans to do the same.”

    Unless a deal is reached before next week, the Senate is expected to vote Monday on the original full-year DHS funding bill, a measure likely to be blocked again by Schumer and his caucus.

    Minnesota judge holds lawyer for DOJ in contempt as tensions flare over immigration cases

    A Minnesota federal judge ordered a government attorney to be held in civil contempt of court for violating an order requiring the Justice Department to turn over identification documents to a man who was ordered released from ICE custody, further escalating tension between the judiciary and Trump administration over immigration cases.

    On Wednesday, U.S. District Judge Laura Provinzino ordered the attorney, Matthew Isihara, to pay $500 each day until the petitioner’s identification documents are returned to him.

    Isihara is a military attorney currently detailed to assist the Justice Department as a special U.S. attorney, according to his LinkedIn profile.

    The plaintiff, Rigoberto Soto Jimenez, was arrested in mid-January, part of a monthslong immigration crackdown in Minnesota. On Feb. 9, after the man sued for his release, Provinzino ordered Soto Jimene to be released from ICE custody, finding that he was unlawfully detained because immigration officials did not have an administrative warrant to justify his detention.

    She ordered his release “without imposing any conditions of release” and ordered “all property” to be returned to him. She also said he must be released in Minnesota, where court documents show he has lived since 2018 with his lawful permanent resident spouse.

    On Tuesday, the judge scheduled a show cause hearing with lawyers for both parties after Provinzino said that the Justice Department had failed to release Soto Jimenez in Minnesota as required by her order — although Provinzino’s filing did not specify where he was released — and failed to return Soto Jimenez’s property to him. The judge also said the government failed to provide her with a status update.

    The Justice Department, Isihara and an attorney for Soto Jimenez did not immediately respond to requests for comment.

    Provinzino isn’t the first federal judge in Minnesota to accuse the government of violating court orders in immigration cases. In some cases, judges have accused federal agencies of slow-walking their orders to release migrants, releasing people in other parts of the country or making people wear ankle monitors despite orders to release them with no conditions.

    Patrick Schiltz, the chief judge of the U.S. District Court in Minnesota, accused ICE of violating court orders nearly 100 times in the month of January.

    In recent months, the federal court system has been flooded by requests for people to be released from immigration detention. Those requests — known as “habeas corpus petitions” — have spiked as the Trump administration has ramped up immigration arrests and sought to detain many migrants indefinitely while their deportation cases are pending.

    Those requests have caused what one U.S. official described to CBS News as a “tsunami” of immigration cases that have strained the Justice Department’s resources.

    The issue is especially acute in Minnesota, where the U.S. Attorney’s Office has grappled with a wave of resignations by experienced prosecutors. The Justice Department has tried to augment that office with prosecutors from neighboring states and military attorneys.

    Isihara, a member of the Army’s Judge Advocate General’s corps, has been listed as an attorney on more than 100 cases filed against the government since last month, federal court records show.

    Another person who was temporarily assigned to help the Justice Department with habeas petitions in Minnesota, ICE lawyer Julie Le, has been assigned to more than 80 cases. The strain on federal resources burst into public view in one of Le’s cases earlier this month, when she responded to frustrations by a federal judge by saying during a hearing: “The system sucks. This job sucks. And I am trying every breath that I have so that I can get you what you need.”

    Le, who was later removed from her Justice Department detail, invited the judge to hold her in contempt of court “so that I can have a full 24 hours sleep.”

    The Trump administration has given Immigration and Customs Enforcement officers broader powers to detain lawful refugees who have yet to secure permanent U.S. residency, in its latest effort to more heavily scrutinize immigrants, illegal and legal alike, according to a government memo issued Wednesday and obtained by CBS News

    The directive, dated Feb. 18 and submitted by government lawyers in a federal court filing on Wednesday, instructs ICE to detain refugees who entered the U.S. lawfully but who have not formally obtained permanent residency — also known as green card — a year after their admission.

    Refugees are immigrants granted a safe haven in the U.S. after proving they are fleeing persecution in their home countries due to their race, religion, nationality, political views or membership in a social group.

    Historically, the U.S. has resettled tens of thousands of refugees annually, most of whom undergo a years-long vetting process in refugee camps overseas before reaching American soil. But the Trump administration has virtually shut down the U.S. refugee program, making limited exemptions for some groups, including Afrikaners whom officials have claimed are escaping racial oppression in South Africa because they are White.

    The latest policy targets refugees already brought to the U.S. Under federal law, refugees are required to apply for a green card within a year of their arrival.

    Through the new memo, the Trump administration is arguing that those refugees who have not become permanent U.S. residents a year after coming to the country must return to government custody to have their cases reviewed and re-screened. The directive was issued by acting ICE Director Todd Lyons and U.S. Citizenship and Immigration Services Director Joseph Edlow, who, among other things, oversees the green card process.

    The memo says these refugees can return to government custody voluntarily by appearing for an interview at an immigration office. But if they don’t, the memo says, ICE must find, arrest and detain them.

    “[The Department of Homeland Security] must treat the one-year mark as a mandatory re-vetting point for all refugees who have not adjusted to [Lawful Permanent Resident] status, ensuring either that they are scheduled to ‘return’ to custody for inspection or, if they do not comply, that they be ‘returned’ to custody through enforcement action,” the memo reads.

    The directive gives ICE the power to “maintain custody” of these refugees “for the duration of the inspection and examination process.” That review, officials said, is designed to determine whether refugees obtained their refugee status through fraud or whether they pose a threat to national security or public safety, because of potential ties to terrorism or serious criminal histories.

    The memo says refugees who raise red flags during this examination may be stripped of their legal status and processed for deportation.

    The directive reverses longstanding ICE policy that stipulated that refugees’ failure to get a green card within a year of their admission was not, by itself, a legitimate legal reason to detain them. The prior policy also required ICE to decide, within 48 hours of detaining a refugee, to release them or place them in deportation proceedings if officials found any valid deportation grounds.

    The Trump administration has taken unprecedented steps to reopen and reexamine the immigration cases of people who were previously granted legal status in the United States. In November, the administration directed immigration officials to review the cases of refugees admitted under former President Joe Biden, potentially reinterviewing them in some cases to determine whether they meet the legal definition of a refugee, CBS News previously reported.

    While its crackdown on illegal immigration has garnered more attention and controversy, the Trump administration has mounted a quieter, yet still sweeping effort to tighten legal immigration channels, usually justifying the moves on national security grounds.

    After the Thanksgiving week shooting of two National Guard members in Washington, D.C. — allegedly at the hands of an Afghan national — USCIS has paused all legal immigration applications filed by immigrants from dozens of countries identified as “high risk.”

    Late last year, the Trump administration launched an effort, dubbed Operation PARRIS, to reexamine the cases of thousands of refugees in Minnesota. The move coincided with the deployment of thousands of federal immigration agents to the Minneapolis region. Lawyers reported cases of refugees detained in Minnesota being flown to Texas to be held and questioned there, before a federal judge curtailed the operation.

    The administration argues its efforts are designed to mitigate national security and public safety concerns involving some refugees. Advocates for immigrants say the campaign is punishing people who came to the U.S. legally, after fleeing warzones and violence, on dubious security or fraud allegations and questionable legal grounds.

    “This policy is a transparent effort to detain and potentially deport thousands of people who are legally present in this country, people the U.S. government itself welcomed after years of extreme vetting,” said Beth Oppenheim, the CEO of HIAS, a humanitarian group that helps resettle refugees and is challenging the Trump administration’s effort to detain some refugees.

    White House press secretary Karoline Leavitt on Wednesday pushed back on a reporter who asked for examples of when the president had been “falsely called racist.”

    “Yesterday, in his statement about Jesse Jackson, the president said ‘despite the fact that I’m falsely and consistently called a racist by the scoundrels and lunatics and the radical left Democrats all, it was always my pleasure to help Jesse along the way.’ Where or when does the president believe he’s been falsely called racist?” the reporter asked.

    Leavitt responded to the reporter in disbelief and asked if he was “kidding,” to which the reporter replied that he was not.

    “I will pull you [a] plethora of examples. I’m going to get my team in that room to start, going through the Internet of radical Democrats throughout the years and who have accused this president falsely of being a racist. And I’m sure there’s many people in this room and on network television across the country who have accused him of the same. In fact, I know that because I’ve seen it with my own eyes,” Leavitt said.

    The press secretary noted that the president was scheduled on Wednesday to hold an event marking Black History Month. Additionally, she listed a number of policy accomplishments aimed at benefiting both the Black community and Americans as a whole, such as the administration’s commitment to funding Historically Black Colleges and Universities (HBCUs) and the establishment of Trump accounts.

    “So, there is a lot this president has done for all Americans, regardless of race, and he has absolutely been falsely called and smeared as a racist. And I’m happy to provide you those receipts, and we gladly will right after this briefing,” Leavitt added.

    TRUMP REMEMBERS JESSE JACKSON AS ‘GOOD MAN,’ ‘FORCE OF NATURE’

    The reporter was referring to President Donald Trump’s post regarding the death of Reverend Jesse Jackson, who died on Tuesday at the age of 84. The president, who posted several pictures of himself with Jackson, remembered the late reverend as a “good man with lots of personality, grit and ‘street smarts’” before making the remarks about being falsely labeled as a racist.

    Trump noted that he supported and “provided office space” for Jackson and the reverend’s civil rights organization, the Rainbow PUSH Coalition. Additionally, Trump said that he had responded to Jackson’s “request for help getting criminal justice reform passed and signed, when no other president would even try.” The president also touted his own work to secure long-term funding for HBCUs.

    “Jesse was a force of nature like few others before him,” Trump said before seemingly taking a swipe at the reverend over his support of former President Barack Obama’s candidacy.

    “He loved his family greatly, and to them I send my deepest sympathies and condolences. Jesse will be missed!” Trump added.

    The president has often faced accusations of racism from prominent Democrats, including his most recent predecessor, former President Joe Biden. Trump has long pushed back against the notion, highlighting his relationships with prominent Black figures during his celebrity days and his policy moves during his time as president.
