Virginia passes legislation prohibiting schools from teaching falsehoods about Jan. 6 riot

    March 6, 2026 / 2:14 PM EST / CBS News

Virginia’s legislature has passed a bill prohibiting schools from teaching what it considers to be falsehoods about the Jan. 6, 2021, U.S. Capitol riot, including portraying it “as peaceful protest.”

The General Assembly approved the measure Thursday, as a first-of-its-kind legislation to combat false statements by supporters of President Trump.

The bill says that school instruction must “Not describe, portray, or present as credible a description or portrayal of the actions precipitating or involved in the events of the January 6, 2021, insurrection as peaceful protest.”

Schools may also not “state, suggest, or present as credible a statement or suggestion that there was extensive election fraud that could have changed or actually changed the results of the 2020 presidential election.”

Instead, the measure says that school instruction must “Describe the January 6, 2021, insurrection at the United States Capitol as an unprecedented, violent attack on United States democratic institutions, infrastructure, and representatives for the purpose of overturning the results of the 2020 presidential election.”

The legislation was sponsored by state delegate Dan Helmer, a Democrat from Northern Virginia. In the state Senate, the bill passed 21-19 — the chamber’s 19 Republicans opposed the measure. CBS News has requested comment from Virginia state Senate GOP leader.

State and local police in Virginia were among the law enforcement responders who helped repel the rioting mob on Jan. 6, 2021.

“The White House has tried to rewrite history,” Helmer told CBS News. “I don’t want to celebrate traders in our public schools.”

The White House posted a series of lies about Jan. 6 on an official federal government web page on Jan. 6, 2026, including a bogus claim that police bore responsibility for the attack.

Helmer’s bill is expected to be signed by Virginia Gov. Abigail Spanberger, a Democrat who was elected in November and who served in Congress at the time of the Capitol attack.

A spokesperson for Spanberger said, “The Governor will review all legislation that comes to her desk.”

Helmer, who spoke by phone with CBS News from the State Capitol, said, “This bill does not mandate the teaching of Jan. 6. It just says that if you do it, you have to do so in line with the actual facts of the day.”

President Trump and his surrogates and supporters have characterized the events of Jan. 6 as patriotic. They’ve also claimed the prosecutions of U.S. Capitol rioters represented a political “weaponization” of the Justice Department by the Biden administration.

Mr. Trump pardoned more than 1,500 Capitol riot defendants, including hundreds charged with beating and maiming police officers during the assault.

Helmer told CBS News, “The bill provides guardrails for our schools.”

“We have a history in Virginia, of celebrating the ‘lost cause of the Civil War’ and the Confederacy in our schools, trying to rewrite history that way,” Helmer said. “We have a long history of some of that going the wrong way.”

“Delegate Helmer’s bill requiring any education in school curriculum be fact-based, truthful and honest is a no-brainer,” said Harry Dunn, a former Capitol Police officer who responded to stop the mob on Jan. 6. Dunn, who is now running for the Democratic nomination for a U.S. House seat in Maryland, told CBS News, “This bill isn’t politically left. Any opponents of the bill who suggest otherwise are the ones who are making it ‘political.’ The world saw that happened that day and who was responsible for it,” said Dunn.

New York’s legislature is also considering new legislation to require proper teaching of the Capitol siege. Long Island Democratic state Rep. Chuck Lavine has proposed legislation in New York to require all public schoolchildren to receive instruction about the insurrection.

“The idea is to require New York students to be instructed about what happened on Jan. 6 and its aftermath,” Lavine told CBS News. “We can’t sweep history under the rug. If we don’t teach our students about the truth of history, we are doing them a grave disservice. And we’d be doing a disservice to our nation as well.”

His legislation must be passed by December in order to become law.

“This is part of civic responsibility,” Lavine said. “People are entitled to their own political beliefs, but they are not entitled to change facts.”

“Anyone of good faith who watched what happened on that day recognizes the threat to democracy represented by what occurred on that day,” Lavine said. “The old line is, ‘Those who ignore history are condemned to repeat its mistake.’”

Brendan Ballou, a former Justice Department prosecutor who handled Jan. 6 cases, told CBS News, “It’s absolutely essential that the reality of Jan. 6 not be forgotten and the history of the day not be rewritten.”

“Kudos to Virginia for pushing back on the relentless gaslighting about January 6th and the 2020 election,” said former prosecutor Mike Gordon, who also handled a number of Jan. 6 prosecutions. “Kids should learn the truth.”

Is Trump saying Kristi Noem committed perjury?

Analysis by Aaron Blake | 14 min ago | PUBLISHED Mar 6, 2026, 1:57 PM ET

Homeland Security Secretary Kristi Noem testifies before a Senate Judiciary Committee hearing on Capitol Hill, on March 3, 2026.

    Elizabeth Frantz/Reuters

Either President Donald Trump isn’t telling the truth, or Kristi Noem seems to have committed perjury.

There’s not really a third alternative, at this point.

Trump on Thursday could have just relieved Noem of her duties, as he did. But he didn’t stop at that; he also repeatedly appeared to deny portions of her testimony — which she gave under oath — to the Senate this week.

Specifically, Trump took issue with her claims that he was aware of and had approved a controversial $220 million Department of Homeland Security ad campaign that prominently featured Noem.

(The ad campaign is controversial not just because of the dollar amount and how much it promoted Noem personally, but also because it resulted in a lucrative subcontract for the husband of a now-former DHS spokesperson, according to a report by ProPublica.)

Noem repeatedly signaled in her testimony that Trump was aware of and even approved of the ad campaign. Trump is telling a very different story.

“[I never knew anything about it],” he told Reuters on Thursday, shortly before Noem was ousted.

“[I didn’t know about it],” Trump added later in an interview with NBC News.

But how directly does that contradict Noem’s testimony? And who appears to have told the truth?

It’s worth noting that even if Noem did commit perjury, it’s rare to see someone prosecuted for lying to Congress. Some Democrats are already beating this drum on Noem, but Republicans would have to be on board to even make a referral to the Department of Justice, which would ultimately decide whether to pursue charges.

Still, Democrats could pursue the matter later if and when they control more levers of government.

Let’s break down what we know.

    Noem clearly confirmed Trump knew

Noem faced questions on this topic Tuesday from both Republican Sen. John Kennedy of Louisiana and Democratic Sen. Adam Schiff of California.

She was at times evasive when they tried to pin down exactly what Trump had approved. But Noem clearly agreed that Trump knew about the ad campaign and even the dollar amount, and that he consented to them.

When Kennedy asked her if Trump asked her to run the ads, Noem said, “We had that conversation, yes …”

Perhaps sensing a little wiggle room in Noem’s answer, Kennedy asked again whether “you’re testifying that President Trump approved this ahead of time.”

“We had conversations about making sure that we were telling people…” Noem began.

But Kennedy cut her off, seemingly sensing that she was avoiding a direct answer.

“No, ma’am. I’m asking you — sorry to interrupt,” Kennedy said. “But the president approved, ahead of time, you spending $220 million running TV ads across the country in which you are featured prominently?”

Finally, Noem answered directly: “Yes, sir.”

“We went through the legal processes, did it correctly, worked with (the Office of Management and Budget) –” she added.

Kennedy again, though, seemed to believe this was somewhat evasive — that she said “yes” but then quickly pivoted to the legal process rather than Trump’s role.

So he twice asked her if Trump knew she was going to do the ads.

    Noem twice replied, simply, “Yes.”

Kennedy ultimately said it was “hard for me to believe” that Trump signed off on the amount.

    Evasive again

But then Schiff began asking about the subject. And suddenly Noem was more evasive again. Rather than answer the question, she talked about the importance of the ads’ message.

When asked how she knew Trump approved of spending $220 million, Noem replied: “We had conversations and worked with OMB to make sure that the funding was there.”

Schiff kept trying. He asked whether she had “conversations directly with the president where he approved this $220 million ad campaign” and whether “the president approved this expenditure.” Both times, Noem talked around the questions.

    What to make of this?

It’s somewhat normal for politicians to give evasive answers. It’s why they often don’t respond with yesses or nos but instead put things in their own words.

But it is strange how the answers to these questions weren’t always, “Yes.” If Trump was fully on board with all of this and knew about the details, that would seem to be something Noem would want to scream from the mountaintops.

Still, due to Kennedy’s persistence, Noem ultimately claimed Trump was not only aware of the ads and approved of them, but also consented to the dollar amount.

That’s virtually impossible to square with Trump’s flat denial that he “never knew anything about it.”

It could be Trump who isn’t telling the truth

Noem’s best defense here might be that it’s actually Trump who isn’t telling the truth.

After all, as the Atlantic noted late Thursday, this isn’t the first time Noem has said Trump was aware of and approved of the ads. She also said so back in February 2025, shortly after these conversations would have taken place.

Appearing at the Conservative Political Action Conference, Noem recalled detailed conversations with Trump about the ad campaign.

She said Trump cited the “beautiful ads you did about South Dakota,” and said, “I want you to do those for the border.”

She also said the president told her that she should appear in the ads, rather than Trump. She even said he urged her to include specific content: “I want you to thank me for closing the border.”

“They will run throughout the world, letting America and the world know it has a new leader,” Trump said, according to Noem.

It’s certainly possible Noem wasn’t telling the truth back then. But her story was detailed. And as a newly christened DHS secretary, it would seem risky to come in and immediately invent a conversation you had with Trump in a public event.

Whatever the case, who lied remains an important question — Noem is still going to be a government employee. Trump said she will continue serving in government as special envoy for “The Shield of the Americas,” a policy initiative focused on the Western Hemisphere.

So who’s telling the truth? The outgoing DHS secretary with the credibility problem? Or the president with the credibility problem? Stay tuned.

Mullin promises to earn Dem votes as GOP colleagues pounce on his seat

Reps Bice and Hern show interest in Oklahoma seat as Mullin awaits confirmation

President Donald Trump’s move to fire Homeland Security Secretary Kristi Noem and tap Sen. Markwayne Mullin, R-Okla., as her replacement triggered a domino effect in Congress.

Before Mullin can take the helm of the Department of Homeland Security (DHS), he has to be confirmed. And once confirmed, someone will have to take his seat. Both caveats come with their own hurdles.

Senate Democrats may try to toss a wrench into the confirmation process and extract promises for reforms to the agency, particularly Immigration and Customs Enforcement (ICE). DHS has been closed for three weeks, and the shutdown will likely continue for at least a month.

Senate Minority Leader Chuck Schumer, D-N.Y., has vowed to oppose Mullin and argued that changes need to be made regardless of who runs the agency.

“It’s a question of policy, not personnel,” Schumer said. “The Senate should not consider any DHS secretary nominee until DHS and ICE are reined in.”

Mullin has staunchly opposed Democrats’ demands to reopen the agency and whether he’ll budge to get their votes remains to be seen.

But he’s open to speaking with Schumer and his caucus and wants to earn their votes. Whether he can do that before Trump’s March 31 deadline is up in the air.

“The Department of Homeland Security is to keep everybody — regardless of whether you support me, if you don’t support me, regardless of what your thoughts are — I’m here to enforce the policies that Congress passed,” Mullin said.

Then there’s the race for succession. Mullin, who is currently near the end of his first term in the upper chamber, was in the midst of running for re-election. With his appointment by Trump, that seat is now wide open for Republicans hungry to reach the Senate.

Oklahoma Gov. Kevin Stitt, a Republican, will choose who fills Mullin’s Senate seat in the short term. But it’ll be up to voters in the Sooner State to pick their next senator.

“I will be looking to appoint a strong, small-government conservative voice to support President Trump and protect Oklahomans’ way of life,” Stitt said on X.

And GOP hopefuls have already begun crowding the potential primary race for his seat within hours of Trump’s announcement.

Reps. Stephanie Bice, R-Okla., and Kevin Hern, R-Okla., are already showing interest, Fox News Digital was told.

A source close to Bice told Fox News Digital that she was considering running for the likely open Senate seat first, which Bice followed with her own public statement on Thursday evening.

“President Trump has made an excellent choice. Markwayne is a great friend and a fierce advocate for the America First Agenda. I’m excited for him to take the helm at DHS,” she posted on X. “It’s the honor of a lifetime to stand side by side with President Trump for the people of Oklahoma. I’ve received encouragement from every corner of this great state to run for the U.S. Senate. And it’s something I’m carefully considering.”

Meanwhile, Fox News Digital was told that Hern — who currently serves in House leadership in the role of GOP Policy Committee chairman — already began calling players within the Republican orbit to get their support.

Multiple people familiar with Hern’s thinking told Fox News Digital that he intends to run.

Hern is also generating buzz among Senate Republicans. Sens. Jim Banks, R-Ind., Bill Hagerty, R-Tenn., and Ron Johnson, R-Wis., have all come out in support of him.

Neither Hern nor Bice is interested in being appointed by Stitt, however, likely due to Oklahoma’s unusual laws dictating how Senate vacancies must be filled.

A mid-term vacancy is traditionally filled by the state’s governor, after which an election occurs at the next pre-scheduled race date. The governor’s appointee must sign an affidavit swearing they will not run in that election.

In this case, Mullin was up for re-election in November, so anyone seeking the office will have to run in a June primary and then be up for a full six-year term at the end of this year.

But that also means that Bice and Hern will both be able to run for Mullin’s current seat without risking the House GOP’s own razor-thin majority.

    • Secure Flight:

Noem and DHS watchdog feuding over classified airport security risk report

    Updated on: March 6, 2026 / 2:57 PM EST / CBS News

Weeks before Homeland Security Secretary Kristi Noem was fired by President Trump, a dispute between her department and its internal watchdog over access to records and communications with Congress had been escalating. The conflict burst into public view when senior Republican senators eviscerated Noem at a hearing earlier this week.

The feud has raised concerns over the Department of Homeland Security’s apparent move to restrict oversight of a classified report examining airport security screening.

During a Senate hearing Tuesday, GOP Sen. Chuck Grassley of Iowa, confronted Noem over allegations that her department issued a memo to prohibit DHS Inspector General Joseph Cuffari from discussing a classified report about covert testing of Transportation Security Administration checkpoints with certain congressional committees.

Grassley said the report concerns undercover testing of TSA screening procedures, adding that the Government Accountability Office has been unable to obtain the report or access TSA personnel as part of its own review into the classified findings.

The Iowa senator also said the Government Accountability Office has been unable to obtain the report or contact TSA personnel as part of its own review.

“If what my office has been told is accurate,” Grassley said, addressing Noem from the dais, “these matters should have been ironed out a long time ago.”

Republican Sen. Thom Tillis of North Carolina blasted the DHS secretary, suggesting the inspector general’s actions signaled unusually serious findings.

“Does anyone have any idea how bad it has to be for the inspector general to come out and do this publicly?” Tillis said.

The remarks have triggered a broader investigation by the ranking member of the Senate Homeland Security and Governmental Affairs Committee, Democratic Senator Gary Peters of Michigan, who’s now leading a probe into whether DHS improperly restricted its watchdog’s ability to communicate with lawmakers.

In a March 4 letter to DHS General Counsel James Percival, Peters said the panel is examining “potential obstruction of communications by the Inspector General to Congress.” The committee is also reviewing allegations from Cuffari that the department has “systematically obstructed” the top watchdog’s work.

The letter references a warning from Percival to Cuffari that notifying Congress about access problems could constitute “bad faith and bordering on a material misrepresentation.”

“This threat to the Inspector General not to communicate with Congress is unacceptable,” Peters wrote.

The dispute centers partly on a classified report the inspector general completed late last year following covert “red team” testing of TSA checkpoint screening conducted after the agency announced a policy change that allows travelers to keep their shoes on during security screening.

According to a source briefed on the decision, TSA was not directly consulted before the policy change was announced. The policy reversal, announced July 8, 2025, ended a requirement in place since 2006 and was initially welcomed by travelers eager to speed up airport security lines, though it remains unclear how much testing or risk analysis preceded the move.

According to multiple sources familiar with the report, subsequent TSA red-team testing involved undercover auditors attempting to move simulated prohibited items through airport security checkpoints — a long-standing method used by DHS watchdogs to measure the effectiveness of screening procedures.

Sources said the report raised serious concerns tied to DHS’ decision to allow travelers to keep their shoes on during airport screening.

Under standard procedure, DHS had 90 days to respond to the report with a corrective action plan. That window appears to have expired, and the issue has not been resolved, according to lawmakers testifying earlier this week.

The dispute has since broadened into a larger conflict over the inspector general’s authority to access DHS records and information concerning multiple independent investigations.

In a March 2 letter to Congress, Cuffari wrote that DHS has “systematically obstructed the work of the DHS Office of Inspector General.” He described numerous instances where the department denied or delayed access to databases and classified information needed by auditors in their independent investigations.

The inspector general accused the department of blocking long-standing access to internal DHS databases used for oversight work, restricting data related to border enforcement and TSA programs, and delaying access to classified intelligence systems.

In one case, the inspector general wrote that DHS officials refused to perform what he described as a routine administrative step to grant investigators access to an intelligence program, even though another intelligence agency had approved the request. That refusal “stymie[d] our work,” Cuffari wrote, citing a review related to the 2024 attempted assassination of then-former President Donald Trump.

According to a letter written by Cuffari, DHS blocked inspector general access to the following systems and databases:

    • BorderStat, a database containing real-time information on border crossings and inspections.
    • A counterintelligence database needed for a national security–related criminal investigation.
    • TECS, the system used to track how border officers inspect and admit travelers entering the United States.
    • A security clearance eligibility database tracking which DHS employees and contractors are cleared for access to classified information.
    • Secure Flight, TSA’s system that screens airline passengers against government watchlists.
    • The Unified Immigration Portal, which contains data on border arrests, detentions, and releases.
    • A classified intelligence program relevant to the review of the July 2024 assassination attempt against Donald Trump.

Cuffari also wrote that DHS has established a new internal framework requiring the inspector general to justify requests for information, a process he described as a “manufactured and confusing framework involving six distinct variables” not derived from the Inspector General Act.

The Inspector General Act typically grants federal watchdogs broad authority to access agency records unless an agency or department formally invokes specific national security provisions to block that access — a rare step that would require notification to Congress. Cuffari said that authority has not been invoked in this case.

Former U.S. officials who oversaw earlier covert testing of TSA screening procedures, told CBS News the situation described in the letters would represent a significant departure from the way oversight has traditionally worked.

Officials were surprised to learn that DHS lawyers – not the inspector general’s office – had briefed members of Congress, a practice one official called “completely inappropriate.”

“These reports are exactly the kind of thing the inspector general is supposed to explain directly to Congress,” the official added.

Covert testing by the DHS inspector general has historically exposed significant vulnerabilities in airport screening systems.

In past cases, this kind of testing by the DHS IG has prompted major changes at TSA. In 2015, after a covert “red team” test revealed screeners failed to detect mock weapons or explosives in the vast majority of attempts at 15 airports, the findings leaked publicly. Then-Homeland Security Secretary Jeh Johnson ordered sweeping reforms, including a mass retraining of TSA officers and an overhaul of screening procedures.

In a statement, a DHS spokesperson said the department is “confident in our multilayered security approach,” writing that within the past year, TSA has conducted over 1,000 red team tests.

Russia is aiding Iran’s war effort by providing intel on US military targets, sources say

Russia is providing Iran with intelligence about the locations and movements of American troops, ships and aircraft, according to multiple people familiar with US intelligence reporting on the issue, the first indication that Moscow has sought to get involved in the war.

Much of the intelligence Russia has shared with Iran has been imagery from Moscow’s sophisticated constellation of overhead satellites, one of the people said. It is not clear what Russia is getting in return for the assistance.

CNN has asked the Kremlin and the Russian embassy in Washington for comment.

It is also not clear whether any single Iranian attack can be linked to Russian targeting intelligence, which was first reported by the Washington Post. But several Iranian drones have hit locations where US troops have been in recent days. An Iranian drone struck a makeshift facility housing US troops in Kuwait on Sunday, killing six US service members, CNN has reported.

One of the sources briefed on the intelligence said, “This shows Russia still likes Iran very much.”

The US also has intelligence suggesting that China may be preparing to provide Iran with financial assistance, spare parts and missile components, three people familiar with the matter said, though Beijing has stayed out of the war up until now. China relies heavily on Iranian oil and has reportedly been pressuring Tehran to allow safe passage for vessels through the Strait of Hormuz.

“China is more cautious in its support. It wants the war to end because it endangers their energy supply,” one of the sources familiar said.

The CIA declined to comment. CNN has asked the Chinese embassy in Washington for comment on the suggestion China may be preparing to assist Iran.

Defense Secretary Pete Hegseth told reporters on Wednesday that Russia and China are “not really a factor” in the war with Iran.

Russia and Iran have been cooperating for at least the last three years on missile and drone technology, with Iran providing Russia with Shahed drones and short-range ballistic missiles to target Ukraine and helping to set up a massive drone factory to pump out Iranian-designed drones inside Russia. Iran has in turn sought Russia’s help to bolster its nuclear program, CNN has reported.

The US operation against Iran currently involves more than 50,000 troops, more than 200 fighter jets and two aircraft carriers, CENTCOM Commander Adm. Brad Cooper said this week, and administration officials have not said how long the war is expected to last. The US military objective, according to Pentagon officials, is to eliminate Iran’s ballistic missile capabilities, which Pete Hegseth said this week Iran was using as a “shield” to develop its nuclear program.
