An Immigration and Customs Enforcement attorney detailed to Minnesota to help handle the Trump administration’s immigration crackdown in the Twin Cities has been removed from her post after telling a judge that the job “sucks” because of the crushing workload and the government’s apparent inability to comply with court orders.

The attorney, Julie Le, was sent back to her job at ICE, according to a source familiar with the matter.

In an extraordinarily candid exchange with a federal judge on Tuesday, Le, who had been asked to explain why the administration was not promptly complying with a slew of court orders stemming from immigration cases she’s handling, admitted that the government did not have enough lawyers on the ground to adequately keep up with Operation Metro Surge and that trying to get errors fixed is like “pulling teeth.”

    Ad Feedback

“They are overwhelmed and they need help, so I, I have to say, stupidly (volunteered),” she told US District Judge Jerry Blackwell, who is threatening to hold her and another lawyer in contempt for repeated violations of orders he’s issued in immigration cases.

“Sometime I wish you would just hold me in contempt, your honor, so that I can have a full 24 hours of sleep. I work days and night just because people (are) still in there,” Le said.

“And, yes, procedure in place right now sucks. I’m trying to fix it,” she continued. “I am here with you, your honor. What do you want me to do? The system sucks. This job sucks. And I am trying every breath that I have so that I can get you what you need.”

Le and the other administration lawyers working on immigration cases in Minnesota since the crackdown began have been facing intense scrutiny from the judges there over a slew of missteps in the cases. Last week, the chief judge of the state’s federal trial-level court said ICE “has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence” and specifically called out nearly 100 court orders he said had been violated in recent weeks.

Among those orders are ones requiring the government to immediately release immigrant detainees whom judges determined were being held unlawfully in Minnesota or Texas, where many of them were flown after being arrested in the Twin Cities. Judges, including Blackwell, were also frustrated by release conditions ICE had imposed on some immigrants since the court had not specifically allowed the agency to fashion such conditions.

“It takes 10 e-mails to get a release condition to be corrected,” Le told Blackwell on Tuesday. “It take two escalation and a threat that I will walk out for that to be corrected.”

Though Blackwell said he thought Le and Justice Department attorney Ana Voss, who is also facing a contempt threat, were “working in good faith and under difficult circumstances,” he warned them that “a court order is not advisory and it is not conditional.”

“It is not something that any agency can treat as optional while it decides how or whether to comply with the court order,” the judge said.

“Having what you feel are too many detainees, too many cases, too many deadlines, and not enough infrastructure to keep up with it all, is not a defense to continued detention. If anything, it ought to be a warning sign,” Blackwell added.

    By Alex Miller |

Shutdown averted for now, but Senate warns DHS fight could trigger another in days

By Alex Miller | Fox News
    Published February 4, 2026 10:30am EST

As the House crushed Republican resistance to a Trump-backed funding package to end the latest partial government shutdown, lawmakers in the upper chamber weren’t confident that Congress could avoid being in the same position in the coming weeks.

President Donald Trump and Senate Minority Leader Chuck Schumer, D-N.Y., brokered the deal to end the shutdown last week. That funding truce included a move to sideline the controversial Department of Homeland Security (DHS) funding bill in favor of a short-term extension to keep the agency open.

The House’s passage of the package, which funds 11 out of 12 government agencies under Congress’ purview, sets the stage for tense negotiations between the White House and Senate Democrats over reforms to DHS.

[END OF GOVERNMENT SHUTDOWN IN SIGHT AS SPEAKER JOHNSON OVERCOMES GOP REVOLT]

But several Senate Republicans are questioning whether two weeks, which had shrunk to just nine days as of Wednesday, would be enough time to avert another partial shutdown — this time only for DHS.

“I think it’s gonna be very difficult to get the [funding bill done for DHS] in two weeks,” Sen. Rick Scott, R-Fla., told Fox News Digital.

Scott was one of a handful of Republicans in the upper chamber that rejected the compromise plan and the underlying original package because of bloated spending on earmarks and concerns that Senate Democrats would effectively try to kneecap Immigration and Customs Enforcement (ICE) operations across the country.

“We’re going to be in a worse spot,” Scott said. “I mean… all their earmarks got done, and then now they’re going to want to, you know, they want to [get] busy de-fanging and defunding ICE.”

Congressional Democrats wanted to relitigate the bipartisan DHS bill after the fatal shooting of Alex Pretti during an immigration enforcement operation in Minneapolis. The demand forced Trump to intervene and thrust the government into a partial shutdown on Friday.

While the [funding deal] made it across his desk, it won’t get Congress out of the jam it’s in, given the short amount of time lawmakers have to negotiate the bill, which is consistently the most difficult spending bill to pass year in and year out.

Senate Majority Leader John Thune, R-S.D., noted that once negotiations began, Congress had a “very short timeframe in which to do this, which I am against.”

“But the Democrats insisted on, you know, a two-week window, which, again, I don’t understand the rationale for that,” Thune said. “Anybody who knows this place knows that’s an impossibility.”

Some Senate Democrats did not want to weigh in on a hypothetical scenario just days away, but Sen. Mark Kelly, D-Ariz., contended that because of the events in Minnesota, “there should be some motivation across the aisle to do something on, you know, all these issues.”

“I mean, I think [DHS Secretary] [Kristi Noem] should be fired, leadership needs to be changed at ICE, their budget needs to be the right size,” Kelly said. “We got to get them looking like normal police officers.”

Senate Appropriations Chair Susan Collins, R-Maine, struck a more positive tone.

[TRUMP, SCHUMER REACH GOVERNMENT FUNDING DEAL, SACRIFICE DHS SPENDING BILL IN THE PROCESS]

Senate Majority Leader John Thune thought that ICE agents being forced to wear bodycams would act as a sweetener for Democrats.(Graeme Sloan/Bloomberg via Getty Images)

She told Fox News Digital that Congress would be in a much better position, considering that lawmakers will have passed 11 out of the 12 bills needed to fund the federal government.

“We’ll now start the negotiations on DHS, and I hope we’ll be successful, but I don’t see how you can compare where we are today,” Collins said.

Thune believed that Noem’s announcement that ICE agents in Minneapolis would begin wearing body-worn cameras could act as a sweetener for Democrats. There is already $20 million baked into the current bipartisan DHS funding bill for body cameras.

Schumer rejected that olive branch from Noem, arguing that it didn’t come nearly close enough to the portfolio of reforms Democrats wanted for the agency. And he reaffirmed that Senate Democrats wanted actual legislative action on DHS reforms, not an executive order.

[CLICK HERE TO DOWNLOAD THE FOX NEWS APP]

“We know how whimsical Donald Trump is,” Schumer said. “He’ll say one thing one day and retract it the next. Same with Secretary Noem.”

“So, we don’t trust some executive order, some pronouncement from some Cabinet secretary. We need it enshrined into law.”

When asked if lawmakers would need to turn to another short-term funding patch, Schumer argued that “if Leader Thune negotiates in good faith, we can get it done. We expect to present to the Republicans a very serious, detailed proposal very shortly.”

But Thune has said for several days that it would be the White House in the driver’s seat, and ultimately it would be Trump who could broker a new deal.

“But at some points, obviously it has to be the [White House engaged] in the conversation with the Senate Democrats, and that’s how that thing’s gonna land,” Thune said.

Arms control treaty limiting U.S., Russian nuclear weapons to expire, as leaders mull what’s next

    February 4, 2026 / 1:39 PM EST / CBS News

The last remaining treaty between the U.S. and Russia that limits the number of deployable nuclear weapons expires Thursday, marking the end of decades of arms control agreements between the two countries with the largest nuclear arsenals in the world.

The New START Treaty, signed in 2010 by the U.S. and Russia, limited the number of deployed strategic nuclear weapons to 1,550 on each side and required on-site inspections and notifications to ensure both superpowers were complying with the agreement.

Russia stopped providing notifications and suspended inspections during the war in Ukraine but is estimated to not have significantly exceeded the required caps, according to the State Department’s latest report released last month.

Former President Joe Biden in 2021 extended the treaty for five years, but it cannot be extended further.

In January, President Trump told The New York Times “if it expires, it expires,” indicating he could let the treaty lapse. A White House official told CBS News the president will decide a path forward on nuclear arms control “which he will clarify on his own timeline,” and he has indicated he would like to keep limits on nuclear weapons and involve China in future arms control talks.

Secretary of State Marco Rubio said Wednesday that it’s “impossible” to come to an agreement without China “because of their vast and rapidly growing stockpile.”The Pentagon has estimated China will have over 1,000 nuclear weapons by 2035, up from around 200 in 2019.

The current treaty is a bilateral agreement between the U.S. and Russia, which have about 4,300 and 3,700 nuclear warheads respectively, according to the Federation of American Scientists.

Russian President Vladimir Putin in September suggested both sides should abide by the parameters of the treaty without signing another deal for a year, which former Under Secretary of State for Arms Control Rose Gottemoeller told senators was a viable option.

“It should be Donald Trump who gets to be the president of nuclear peace in this case, not Vladimir Putin,” Gotttemoeller testified Tuesday before the Senate Armed Services Committee. She argued that continuing to keep New START limits in place for another year would allow the U.S. “to reestablish strategic stability with Russia and control nuclear weapons at the negotiating table.”

Retired Adm. Charles Richard, the former head of U.S. Strategic Command, and Tim Morrison, a former deputy assistant to the president for national security affairs during the first Trump administration, disagreed, arguing that the treaty does not address several pressing concerns.

All three of the former officials agreed the treaty is not perfect, in part, because it does not account for China and it doesn’t constrain non-strategic nuclear weapons, like tactical nuclear weapons, but Goettmoeller told senators it’s better than nothing.

“My bottom line is that it does not serve U.S. national security interests to have to address the Chinese nuclear buildup while simultaneously facing a rapid Russian upload campaign,” Gottemoeller said.

Now that the treaty limiting the U.S. and Russia is expected to expire, each of the officials raised concerns about other countries exploring their own nuclear programs in the future even if they’re not actively pursuing it right now.

“I don’t think you can understate the risk of proliferation,” Morrison told senators.

Morrison said the U.S. stockpile is aging and emphasized that effective nuclear deterrence requires sustained investment.

“By 2035, 100% of U.S. nuclear weapons, the warheads and bombs themselves, will have exceeded their design lives by an average of 30 years,” Morrison said. “The only means to reliably enforce compliance with arms treaties is to be able to threaten that failure to comply will be met with a compelling response.”

Undated: An artist rendering of the future Columbia-class ballistic missile submarines. The 12 submarines of the Columbia class are a shipbuilding priority and will replace the Ohio-class submarines reaching maximum extended service life. U.S. Navy illustration

And to deploy the weapons effectively, the U.S. needs to boost its defense industrial base, the former officials all agreed, especially when it comes to building Columbia-class submarines that will make up the sea-based part of the nuclear triad.

“I think the numbers are insufficient on all portions of the triad, particularly on the bomber and the ballistic missile submarine leg,” said Richard, the retired admiral formerly in charge of U.S. Strategic Command. “There are additional capabilities that we should consider in addition to the recapitalization of the triad and increasing the capacity inside the triad.”

Supreme Court lets California use new congressional map in midterms, rejecting bid to block it

    February 4, 2026 / 1:59 PM EST / CBS News

Washington — The Supreme Court on Wednesday declined to block California’s new congressional map that could net Democrats five seats in the upcoming midterm elections.

The decision from the high court clears the way for California to use for now the newly drawn lines for most of its 52 House districts in this year’s congressional elections. There were no noted dissents.

The map was crafted in response to a rare mid-decade redistricting by Texas Republicans last year, which aimed to help the GOP maintain its control of the lower chamber in Congress. California officials sought to draw a map that would see Democrats pick up five seats in the House, which would offset the five seats that were newly crafted in Texas to favor Republicans.

California voters backed a ballot measure known as Proposition 50 in November, which enacted the new lines for many of the state’s congressional districts through the end of the decade.

But shortly after voters approved the map, a group of California Republicans filed a lawsuit alleging that the voting boundaries are unconstitutional. The plaintiffs alleged that the state legislature relied predominantly on race in the mapmaking process and drew several House district lines to favor Latino voters, which violated the 14th and 15th Amendments.

The Trump administration joined the lawsuit and claimed the map was an unconstitutional racial gerrymander.

But a divided panel of three federal judges upheld the map, finding that California lawmakers were motivated by politics, not race, when they drew new congressional districts.

“We find that the evidence presented reflects that Proposition 50 was exactly what it was billed as: a political gerrymander designed to flip five Republican-held seats to the Democrats,” Judge Josephine Staton wrote for the two-judge majority. “In other words, the ‘impetus for the adoption’ of the Proposition 50 Map was ‘partisan advantage pure and simple.’”

California Republicans sought emergency relief from the Supreme Court last month and asked the justices to stop the state from using the new districts during the 2026 election cycle and instead require it to use congressional lines adopted in 2021 by an independent redistricting commission.

They asked the high court to issue a decision by Feb. 9, when congressional candidates can begin submitting paperwork to run.

“The public has a paramount interest in elections conducted under constitutionally valid district lines,” lawyers for California Republicans wrote in their request for relief. “The integrity of representative government is undermined when the State sorts voters by race in constructing the very units of representation.”

The Trump administration backed the GOP voters and urged the Supreme Court to block California from using the new map. Solicitor General D. John Sauer argued in a filing that race was used as a proxy for politics, and said California’s recent redistricting is “tainted by an unconstitutional racial gerrymander.”

“Of course, California’s motivation in adopting the Prop 50 map as a whole was undoubtedly to counteract Texas’s political gerrymander,” he wrote. “But that overarching political goal is not a license for district-level racial gerrymandering.”

In urging the Supreme Court to leave the new House district lines in place, California officials said Republicans only brought their suit challenging the state’s map — while also defending Texas’ new voting boundaries — to ensure Republicans hold onto the House.

“That is a natural political objective, just as it was natural for Governor Newsom and California Democrats to want to counteract Republicans’ strategy,” they wrote in a filing. “But what is deeply unnatural — indeed, contrary to fundamental principles of democracy and judicial impartiality — is plaintiffs’ request for this Court to step into the political fray, granting one political party a sizeable advantage by enjoining California’s partisan gerrymander after having allowed Texas’s to take effect.”

Lawyers for the League of United Latin American Citizens, which is backing the new lines, argued that California’s map was approved by more than 7 million voters and said there is “overwhelming evidence” that the House district lines were redrawn for partisan purposes.

“It would be extremely disruptive to election officials, voters, and political parties, in addition to candidates, to change California’s entire redistricting map now, during an active primary campaign,” they wrote in a filing urging the Supreme Court to leave the new voting lines in place.

Texas Republicans moved to draw new House district lines last summer after President Trump and White House aides pushed them to create a new map that would help Republicans hold onto their majority in the House. But the decision by Texas GOP lawmakers set off a race for other states to redraw their own congressional maps for the 2026 election cycle.

Democrats in California went to work crafting new voting lines that would counter the new GOP-favored seats in Texas, and redistricting efforts spearheaded by Democrats are underway in Maryland and Virginia. A state judge in Virginia, however, ruled a proposed constitutional amendment allowing Democrats to redraw its congressional map was illegal. On the other side of the aisle, Republicans in North Carolina and Missouri approved plans that each sought to shift a single Democrat-held seat to the right.

A divided three-judge panel in Texas blocked the state from using its redrawn House districts for the midterm elections and found the map was racially gerrymandered. But state Republicans asked the Supreme Court to intervene, and the high court restored Texas’ new congressional voting lines in December.

In a concurring opinion, Justice Samuel Alito indicated that he believed politics was the predominant factor driving state lawmakers in Texas and California in the redistricting process. Joined by Justices Clarence Thomas and Neil Gorsuch, Alito wrote “it is indisputable” that the “impetus for the adoption of the Texas map (like the map subsequently adopted in California) was partisan advantage pure and simple.”
