    Trump suggests Republicans should nationalize voting. Here’s what to know.

    Washington — President Trump suggested Monday that Republicans should “nationalize” voting, the latest escalation in his and his administration’s efforts to step into federal elections ahead of the 2026 midterms.

    During a podcast interview with former FBI deputy director Dan Bongino, Mr. Trump repeated his claims that people who are in the U.S. illegally are voting in federal elections and urged Republicans to “take over the voting” in at least 15 states.

    “The Republicans should say, ‘we want to take over,’” Mr. Trump said Monday. “The Republicans ought to nationalize the voting. And then we have states that are so crooked, and they’re counting votes.”

    A day later, Mr. Trump said in an Oval Office event, while flanked by lawmakers and members of his Cabinet: “I want to see elections be honest, and if a state can’t run an election, I think the people behind me should do something about it.”

    Constitution gives states — not the president — the power to run elections


    The Constitution’s Elections Clause gives states the authority to set the rules for federal elections, and offices at the state and local levels oversee their administration, though Congress can pass election regulations in certain cases.

    As a result, the president has virtually no role in overseeing elections, said David Becker, a CBS News election law contributor and the executive director of the Center for Election Innovation and Research.

    “The Elections Clause of the Constitution couldn’t be any more clear,” Becker said on CBS News’ “The Takeout with Major Garrett” on Tuesday. “It’s actually one of the areas the Founders carved out, specifically to exclude the executive from any power over elections.”

    Asked by reporters Tuesday about those constitutional limits, Mr. Trump said states “can administer the election, but they have to do it honestly.” He also referred to states as “agents of the federal government” and argued that federal authorities should be more involved.

    White House press secretary Karoline Leavitt told CBS News senior White House correspondent Weijia Jiang earlier Tuesday that Mr. Trump “believes in the United States Constitution,” but also believes there has been “a lot of fraud and irregularities.”

    Trump moves to expand control over elections


    The president has accused Democrats of allowing undocumented immigrants in their states to vote in order to bolster their support, and claimed repeatedly, without evidence, that the 2020 election was rife with fraud.

    Dozens of lawsuits filed by his campaign and GOP allies that sought to overturn the 2020 election results were dismissed, and Bill Barr, who served as attorney general in Mr. Trump’s first term, said the Justice Department did not uncover any evidence of widespread fraud.

    Still, Mr. Trump and his administration have undertaken efforts to exert more control over elections. The president signed an executive order last year that aimed to overhaul elections, including by requiring documentary proof of citizenship to register to vote. It is a crime for noncitizens to vote in federal elections and violators face up to a year in prison.

    But the directive faced several legal challenges, and portions of it, including the proof-of-citizenship provisions, have been blocked by federal judges.

    The Justice Department has also demanded complete voter registration lists from nearly every state and Washington, D.C., according to the Brennan Center for Justice. It has filed lawsuits against two dozen states and the District of Columbia for refusing to hand over the records, which include voters’ addresses, birth dates and partial Social Security numbers.

    Mr. Trump also urged Republican state lawmakers to redraw their congressional district lines to help the GOP hold onto its majority in the House. After Texas adopted new voting boundaries that aimed to give Republicans five additional House seats, California approved its own plan to make five seats more favorable to Democrats. Several other states have also moved to recraft their congressional maps.

    Then, last week, the FBI executed a search warrant at a Fulton County, Georgia, elections office and seized ballots from the 2020 presidential election. Mr. Trump has repeatedly claimed without evidence that the 2020 presidential election in Georgia, where he lost to former President Joe Biden, was “rigged” against him.

    The president told Bongino that “you’re going to see some interesting things come in” regarding Georgia, and again asserted without evidence that he won the 2020 election.

    The FBI’s search, as well as the presence of Director of National Intelligence Tulsi Gabbard at the scene, raised alarms among Democrats on Capitol Hill. Gabbard told lawmakers in a letter Monday that Mr. Trump requested she be at the search of the Fulton County elections hub. She also acknowledged facilitating a phone call between FBI agents in Atlanta and the president, and said Mr. Trump wanted to “thank the agents personally for their work.” Gabbard said the president did not ask any questions and did not issue any directives.

    The New York Times had reported earlier Monday that Gabbard helped arrange the call between Mr. Trump and FBI agents after the search.

    Mr. Trump has also backed the SAVE Act, a bill backed by congressional Republicans that would require state election officials to get in-person proof of citizenship from people registering to vote. Leavitt said Tueday the president’s comments on taking over elections referred to that legislation.

    “President Trump cares deeply about the safety and security of our elections — that’s why he’s urged Congress to pass the SAVE Act and other legislative proposals that would establish a uniform standard of photo ID for voting, prohibit no-excuse mail-in voting, and end the practice of ballot harvesting,” Abigail Jackson, a White House spokeswoman, said in response to Mr. Trump’s comments.

    Congressional Republicans push back on nationalizing elections


    The president’s call to “nationalize elections” is facing pushback from Republican leaders on Capitol Hill. Senate Majority Leader John Thune told reporters that while he backs a plan to require photo identification to vote, he does not favor federalizing elections.

    “I’m a big believer in decentralized and distributing power, and I think it’s harder to hack 50 election systems than it is to hack one,” he told reporters on Capitol Hill. “So in my view, that’s always a system that’s worked quite well.”

    House Speaker Mike Johnson also defended the system of states administering elections and said Mr. Trump was “expressing frustration” about election integrity.

    “It’s a system that works well, so long as the states make it a priority to ensure the integrity of our elections, and we have real concerns about some of the blue states, frankly, that have not been doing that well,” he told reporters. “So that’s the president’s — he’s expressing that frustration. We all have it. We’re looking for solutions.”

    A new slogan and accompanying red hat made its debut at the White House on Tuesday as President Donald Trump signed the Consolidated Appropriations Act, reopening the federal government with a room full of Republican lawmakers in attendance.

    The hat, bearing the phrase “America Is Back!” sat on the Resolute Desk in the Oval Office during the bill-signing ceremony, as House Speaker Mike Johnson praised the message while standing alongside the president.

    “This is good for the country, and America is back,” said Johnson, who added that the hat was “appropriate” and “the right slogan.”

    Trump confirmed the item’s novelty during the signing event, looking toward the hat held in Johnson’s hands.

    “It’s a new hat,” Trump said. “[It] just came out. America is back.”

    Trump noticed CNN’s Kaitlan Collins in the press pool and quipped, “Look, CNN is thrilled [about the hat]. Look at her. She never smiles. I’d never see her [smile]. But someday I’ll see her smile.”

    While the event focused on passage of the sweeping government funding package, the hat quickly became a visual focal point. As of Tuesday afternoon, however, the “America Is Back!” hat had not yet appeared for sale on the Trump Store official site, which currently features other Trump-branded merchandise, including MAGA hats.

    Johnson’s remarks came as Republicans sought to champion the passage of the Consolidated Appropriations Act (CAA) after days of uncertainty, with Johnson standing behind Trump as the president signed the bill reopening the government.

    The CAA signed Tuesday funds most federal agencies through the end of the fiscal year, though separate negotiations remain ongoing over longer-term funding for the Department of Homeland Security (DHS).

    Trump later argued that the new phrase does not replace his longtime political slogan, “Make America Great Again.”

    “We’ll never forget MAGA,” he said. “But I thought this was very appropriate.” Sen. Barasso, R-Wyo., added, “Love it.”

    It is unclear when or if the “America Is Back” hat will be made available for purchase in the Trump online store.

    Upon request for comment, the White House referred Fox News Digital to Trump’s stated remarks.

    A federal judge on Tuesday expressed skepticism over the Pentagon’s effort to downgrade the pay and rank of Democratic Sen. Mark Kelly of Arizona after he publicly urged service members not to follow unlawful military orders.

    Kelly, a retired Navy captain, previously sued Defense Secretary Pete Hegseth in mid-January, saying he is the target of “extreme rhetoric and punitive retribution” by the Trump administration over a video in which he and five other Democratic lawmakers urged members of the military to “refuse illegal orders.”

    Following the video’s release in November, Kelly received a censure letter in early January from Hegseth which claimed the senator’s public criticism undermined the chain of command, counseled disobedience among the ranks and represented conduct unbecoming of an officer. The Navy later followed up with a letter saying his retirement pay grade would be re-evaluated.

    In a 45-minute court hearing on Tuesday, U.S. District Judge Richard Leon appeared concerned by the Justice Department’s arguments that the speech limitations customarily imposed on active-duty military officers to promote discipline and obedience was being extended to include retired service members like Kelly.

    “That’s never been done,” Leon told Justice Department attorney John Bailey, adding that the government did not have a single case to support the argument.

    “You’re asking me to do something that the Supreme Court has never done,” Leon said. “That’s a bit of a stretch, is it not?”

    Kelly’s legal team, which includes the former U.S. Attorney for the District of New Jersey as well as other prominent former senior officials from the Justice Department, say that the Pentagon’s actions are an unlawful attempt to stifle his First Amendment right to free speech.

    “There is a clear First Amendment violation here,” said Ben Mizer, one of Kelly’s attorneys, during oral arguments on Tuesday. He added that the government’s actions not only infringe on Kelly’s rights but also run “the risk of chilling the speech of every retired veteran in this country.”

    Kelly’s lawyers also separately argue that, as a member of Congress, he is immune from criminal prosecution or civil lawsuits targeting his legislative activity under the Constitution’s Speech and Debate clause.

    The Justice Department on Tuesday told Leon that Kelly is not eligible to petition the federal court for relief because he has failed to exhaust his administrative appeals through the military tribunals and that the actions taken against him are not final.

    Mizer, however, said that it was clear based on Hegseth’s own words that he has expressed bias towards Kelly.

    “Secretary Hegseth has … demonstrated bias, and he is not a decision-maker who has kept an open mind,” he told Leon.

    Leon said he hopes to rule on the issue by Feb. 11 in order to give the parties time to appeal.

    Kelly, speaking to reporters outside the courthouse on Tuesday, said he appreciates “the judge’s quick and careful consideration in this case given what is at stake here.”

    He added that he believes he has the Constitution on his side.

    Kelly is one of six congressional Democrats who appeared together in the video last year.

    The video came as the Trump administration was facing intense pressure over its military strikes against drug vessels, with legal experts and congressional Democrats saying the strikes amounted to unlawful extrajudicial killings.

    The Justice Department has since sent inquiries to the five other congressional Democrats who participated in the video. In response to the Justice Department probe, the lawmakers have accused the Trump administration of trying to silence and intimidate them.

    Leaked documents from the Iranian regime reveal a coordinated plan by its security apparatus, approved by Supreme Leader Ayatollah Ali Khamenei, to violently suppress nationwide protests using force, surveillance and internet shutdowns.

    Excerpts of the documents, reviewed by Fox News Digital, show that Iran’s Supreme National Security Council developed the strategy after the 2019 nationwide protests that came amid fuel price hikes and economic collapse.

    At a National Council of Resistance of Iran (NCRI) press briefing Tuesday covering the regime’s pre-planned orders behind the protests and mass killings, Alireza Jafarzadeh, deputy director of the Washington office, said the documents “were obtained from within the regime” and later cited The People’s Mojahedin Organization of Iran (MEK) as having gained access to them.

    “This Directive by the National Security Council was obtained by the network in Iran of the MEK, which has access to sources within the regime,” he confirmed to Fox News Digital.

    “These documents show the regime’s efforts to prevent the resurgence of the uprising and, if it occurred, to suppress it,” Jafarzadeh added before stating that there are “clear operational plans allocated to the IRGC to use lethal force to kill as many people as needed to stay in power.”

    The first document, classified “top secret,” was issued Mar. 3, 2021, with the regime codifying four escalating law enforcement and security conditions. The regime defined how unrest would be handled and which authorities would be in command at each stage.

    Initial law enforcement and non-armed security situations placed command authority with Iran’s national police force, with support from the Islamic Revolutionary Guard Corps (IRGC) and the Intelligence Ministry (VAJA).

    In the most severe category, designated an “armed security situation,” full command authority rapidly shifted to the IRGC.

    “For now, this compilation should be communicated for two years,” Khamenei wrote before ordering the blueprint implemented nationwide.

    The secret guidelines became the blueprint for crushing the January 2026 protests, which erupted amid soaring inflation, currency collapse and anger toward clerical rule.

    According to the Human Rights Activists News Agency (HRANA), at least 6,854 people have been killed during the protests, with 11,280 cases under investigation.

    Internal regime assessments cited in other leaked files describe three phases of the 2026 uprising: an initial law enforcement phase, followed by a non-armed security phase and finally an armed security situation beginning Jan. 8 when authority shifted fully to the IRGC that played the command role and carried out armed killings.

    The documents specify that during armed security situations, the IRGC operated with support from other security bodies, while Iran’s Ministry of Communications was ordered to impose internet restrictions, including full shutdowns.

    A second classified document, compiled in 2024 by the IRGC’s Sarallah Headquarters, reveals how far the regime went to prepare for dissent.

    The 129-page “Comprehensive Security Plan of Tehran” details extensive surveillance and repression measures, identifying members of the opposition MEK and family members of executed dissidents as “level number one” enemies subject to monitoring and control.

    “It also shows how far the regime is prepared to go to kill as many people as needed, which they did in January 2026. However, these killings further convinced the people that there is only one way to end the killings, and that is to overthrow the regime,” Jafarzadeh added.

    “There are more people, especially young ones, who have joined the ranks of the organized force to confront the IRGC and liberate the nation,” he said.
