The House rejected a war powers resolution on Thursday that would have required the Trump administration to seek congressional approval before continuing military action in Iran.

President Donald Trump ordered strikes on Tehran on February 28 and called for the overthrow of the current regime. The conflict has escalated across the Middle East since then — with European countries pledging military aid to Cyprus and Western allies in the Gulf, and US-Israeli and Iranian strikes continuing into the[sixth day of war].

The GOP-led Senate also rejected a similar measure to rein in Trump’s war powers in a 53 to 47 vote on Wednesday.

Airline and travel groups warn of risks to air traffic as partial shutdown persists

    March 5, 2026 4:42 PM UTC / Reuters

WASHINGTON, March 5 (Reuters) – Groups representing major U.S. airlines and travel groups warned on Thursday that an ongoing partial government shutdown could snarl air traffic as the busy U.S. spring break travel season nears.

Funding ‌for the Homeland Security Department lapsed on February 13 after Congress failed to reach a deal on immigration enforcement reforms demanded by Democrats. That halted operational funding for several government agencies, including the Transportation Security Administration.

About 50,000 TSA airport security screeners are working without pay and as the shutdown continues more workers could be unable or unwilling to come to work because of financial hardship.

Carriers are expecting a record-breaking spring travel period, with 171 million passengers expected to fly, up 4% over the same two-month period last year, said Chris Sununu, CEO of trade association Airlines for America. He castigated lawmakers for not voting to end the shutdown.

“The fear is that, once again, they’re not going to act until something really desperate happens, until we get long lines,” Sununu said, adding the repeated shutdowns are putting the U.S. aviation system at risk.

Spring break travel will heat ‌up as TSA workers get their first zero paycheck on March 13, Sununu said. He urged the Trump administration to reinstate Global Entry, which expedites U.S. customs and immigration clearance for pre-approved, low-risk travelers entering the United States.

U.S. Travel Association CEO Geoff Freeman said it was unacceptable not to pay airport security workers.

“TSA officers screen nearly a billion passengers a year. With an average salary of around $35,000, these are workers who simply cannot afford to miss a paycheck,” Freeman said. “Every time Washington fails to fund the government, these essential workers pay the price. So do travelers. So does the economy.”

Ha Nguyen McNeill, the top official at the TSA, told Congress last month that around 1,110 transportation security officers left the TSA in October and November 2025 following a 43-day government shutdown, a more than 25% increase from the same time period in 2024.

WASHINGTON, March 5 (Reuters) – U.S. Democratic lawmakers Representative Mike Levin and Senator Chris Murphy are working on a bill ‌to rein in prediction markets after well-timed bets ahead of the U.S.-Israeli air strikes in Iran stoked concerns over the legality and ethics of such trades, Levin told Reuters.

While the effort is unlikely to become law in the near future, it intensifies pressure on the likes of Polymarket and Kalshi amid growing concerns wagers on the platforms create incentives to foment conflict and disclose classified information.

“Chris Murphy and I are working on this. It’s unbelievably clear to me that if anyone is using prior knowledge of military action for financial gain that should be absolutely illegal,” the California congressman said in an interview.

The Commodity Exchange Act bars event contracts that are deemed “contrary to the public interest,” including those involving war, terrorism, or assassination, but that law still gives prediction markets far too much leeway, said Levin.

On Wednesday, Polymarket removed bets on the likelihood of a nuclear explosion anywhere in the world after online backlash.

“There is no good way for people ‌to be betting on war and death,” said Levin, adding other Democratic lawmakers share his concerns and he hopes to build a coalition around the effort.

Last month, six other Democratic senators called out the platforms after a mystery trader made a roughly $410,000 profit betting on the ouster of Venezuelan President Nicolas Maduro.

On Saturday, analytics firm Bubblemaps flagged that six accounts made a $1.2 million profit from Polymarket bets on the ousting of Iran’s Supreme Leader Khamenei just hours before he was killed in the air strikes.

Responding on X, Levin and Murphy said the trades suggested insiders were profiting from the war. Murphy added such trades should not be legal and that he planned to introduce legislation “ASAP.”

Spokespeople for Murphy and Polymarket did not immediately respond to requests for comment.

A spokesperson for Kalshi said the platform bans and enforces against insider trading. “We also don’t list markets directly tied to death.”

WASHINGTON, March 5 (Reuters) – President Donald Trump told Reuters on Thursday that he did not sign ‌off on a $220 million border security advertising campaign featuring Homeland Security Secretary Kristi Noem, who faced bipartisan criticism over the commercials during congressional hearings this week.

“I never knew anything about it,” Trump told Reuters in a phone interview.

Noem – a top official overseeing Trump’s aggressive immigration crackdown – faced scrutiny about the campaign while testifying before congressional panels on Tuesday and Wednesday. Lawmakers from both parties asked about the contract and process to select the companies.

The ads prominently featured Noem, including a scene of her on horseback at Mount Rushmore in the former South Dakota governor’s home state.

In one of the exchanges over the contracts, U.S. Senator John Kennedy, a Republican from Louisiana, asked Noem if Trump had approved the commercials.

“The president approved ahead of time you spending $220 million running TV ads across the country in which you are featured prominently?” Kennedy asked Noem.

“Yes, sir. We went through the legal processes, did it correctly,” she replied.

During testimony before U.S. Senate and U.S. House of Representatives panels, Noem faced criticism from Democrats and some Republicans, including for her remarks in January calling the acts of two U.S. citizens shot dead by federal immigration officers in Minneapolis “domestic terrorism.”

    REPUBLICAN-CONNECTED ‌FIRMS AWARDED CONTRACT

In the hearing before House lawmakers, Democratic Representative Joe Neguse raised concerns that the contract was offered to just four companies rather than offered through a standard competitive bidding process. The U.S. Department of Homeland Security said at the time that the limited competition was warranted because of the urgent threat posed by illegal immigration.

Noem said on Tuesday that the contract was awarded through “a competitive process” and that no political appointees were involved. On Wednesday, she said the contract was “all done correctly, all done legally.”

The contract was awarded to two companies linked to long-time Republican operatives, records show, details reported last year by the Associated Press and ProPublica.

One of the companies, Safe America Media, was incorporated in Delaware a week before winning the contract. The company was awarded $143 million, federal records show.

The second, the Louisiana-based firm People Who Think, was awarded $77 million.

Neither company responded to requests for comment on Wednesday.

The Strategy Group, a company run by the husband of outgoing DHS spokesperson Tricia McLaughlin, said on Wednesday that it was paid $226,000 as a subcontractor, a small portion of the total.

(Tom Williams/CQ-Roll Call, Inc via Getty Images)

(Mikaela McGee/DHS)

Kristi Noem, the former South Dakota congresswoman and governor who has led President Donald Trump’s Department of Homeland Security thus far in his second term, was ousted from her position on Wednesday.

President Donald Trump announced on Truth Social that he will nominate Sen. Markwayne Mullin, R-Okla., to replace Noem, effective March 31.

“The current Secretary, Kristi Noem, who has served us well, and has had numerous and spectacular results (especially on the Border!), will be moving to be Special Envoy for The Shield of the Americas, our new Security Initiative in the Western Hemisphere we are announcing on Saturday in Doral, Florida. I thank Kristi for her service at ‘Homeland.’”

Trump said Mullin has done a “tremendous job” in Congress and cited his resume as a former undefeated MMA fighter.

“As the only Native American in the Senate, Markwayne is a fantastic advocate for our incredible Tribal Communities. Markwayne will work tirelessly to Keep our Border Secure, Stop Migrant Crime, Murderers, and other Criminals from illegally entering our Country, End the Scourge of Illegal Drugs and, MAKE AMERICA SAFE AGAIN,” Trump said.

Mullin is the first Native American senator in decades, following Sen. Ben Nighthorse Campbell of Colorado.

Noem, 54, will likely be at least temporarily replaced by Deputy Secretary Troy Edgar, a Navy veteran and former mayor of Los Alamitos, California, in the line of succession for the agency.

Noem’s tenure marked a distinct reversal of the open-border policies permitted by predecessor Alejandro Mayorkas during the Biden administration, and DHS has notched record drug interdictions totaling more than half a million pounds of illegal drugs in her first year.

Her management of President Donald Trump’s mass deportation agenda has also led to more than 2 million reported self-deportations in 2025 and about 670,000 removals of illegal immigrants, a figure supporters have hailed as the most successful immigration enforcement operation in history.

Her agency has also been unafraid to hit back at high-profile critics, including California Gov. Gavin Newsom; Rep. Eric Swalwell, D-Calif.; Minnesota Gov. Tim Walz; and 2026 midterm candidate David Trone of Maryland, who accused DHS of “executing people in the streets” as he filmed a protest ad outside a Williamsport compound recently purchased for use as a detention facility.

Such criticisms of her mass deportation operations, particularly in Minneapolis, appeared to somewhat sour public sentiment on the administration’s handling of the immigration issue, as U.S. Border Patrol Cmdr. Gregory Bovino — a DHS subordinate — was replaced in the Twin Cities by Border Czar Tom Homan amid the firestorm.

Meanwhile, reports surfaced Thursday that Trump is “furious” with Noem over her performance in bicameral Judiciary Committee hearings this week, particularly over a contract for an advertisement that Sen. John Kennedy, R-La., and others grilled her on.

Trump reportedly took issue with her suggesting to Kennedy that he approved a taxpayer-funded ad subcontracted to a firm connected with her inner circle, according to National Review, which also reported that Sen. Markwayne Mullin, R-Okla., is being considered a top candidate for her replacement.

“I haven’t talked to the president,” Mullin told the magazine.

In Wednesday’s House hearing, Noem was questioned by Rep. Sydney Kamlager-Dove, D-Calif., over rumors of an affair with DHS “special government employee” Corey Lewandowski, a top figure in Trump’s 2016 campaign.

Noem criticized Kamlager-Dove in response, as her husband, insurance company owner and former South Dakota first gentleman Bryon Noem, sat just feet behind her.

Kamlager-Dove asked Noem if at any time during her tenure she had “sexual relations with Corey Lewandowski,” before slamming the longtime Trump aide as a “failed campaign manager” and someone lacking military experience.

Rep. Jared Moskowitz, D-Fla., followed up, pressing Noem on Lewandowski while wearing a Justice for Cricket pin referencing the dog Noem once wrote she had to euthanize on her farm.

“I really think you need to say the word ‘no’ into the record so that you can clear that up,” Moskowitz said.

Noem pushed back hard on both Democrats, saying what they were implying is “offensive” and telling Chairman Jim Jordan, R-Ohio, that she was “shocked that we’re going down and peddling this tabloid garbage in this committee today.”

“The socialist, liberal left: you go off and you attack conservative women and you say that we’re either stupid or we’re sluts. That’s what you do. And I will tell you sir… I am neither of those,” Noem fumed at Moskowitz.

Through the recent turmoil, many Republicans remained highly complimentary of Noem’s tenure.

Rep. Clay Higgins, R-La., a former law enforcement officer himself, said during the hearing that he was “embarrassed by the antics of my colleagues across the aisle.”

[CLICK HERE TO DOWNLOAD THE FOX NEWS APP]

“Madam Secretary, you inherited a disaster, and you turned it around. An astonishing 97% decrease in illegal crossings isn’t a coincidence; it’s leadership. Know that this committee has your back,” Higgins said.

When Swalwell pressed her on the ad campaign and contract, Noem shot back that while the Alameda Democrat was “focusing on photo-ops and luxury jets, I’m focused on the fact that the Coast Guard might not get paid because your party is choosing not to fund them.”

While running as a moderate with bipartisan appeal, Texas state Rep. James Talarico, who defeated Rep. Jasmine Crockett, D-Texas, for the Democratic Senate nomination, has a history of making controversial statements on matters of religion, race, gender, border security and beyond.

With Talarico in the national spotlight for the first time, many commentators and strategists are resurfacing some of his past remarks. Among them is a 2021 video of Talarico on the Texas House floor in Austin opposing a bill to ban men from women’s sports and claiming that “God is non-binary.”

“God is both masculine and feminine and everything in between. God is non-binary,” said Talarico, adding, “Trans children are God’s children, made in God’s own image.”

A self-identified Presbyterian seminarian, Talarico casts many of his political stances in Christian and biblical language. However, while speaking on a January episode of “The Ezra Klein Show,” Talarico appeared to equate Christianity with other religions, including Hinduism and Islam.

“I believe that Jesus Christ reveals that reality to us, but I also believe that other traditions reveal that reality in their own ways, with their own simple structures. And I’ve learned more about my tradition by learning more about Buddhism, Hinduism and Islam and Judaism. And so, I see these beautiful faith traditions as circling the same truth about the universe, about the cosmos,” he said.

Despite his use of biblical language, Talarico’s stances on many core religious issues stand in stark contrast with most traditional Christian denominations.

He has used the Bible to defend abortion and, on his campaign website, advocates codifying Roe v. Wade into national law. On an episode of “The Joe Rogan Experience” last year, Talarico said the story of Jesus Christ’s incarnation justifies his support for abortion.

“I say all this in the context of abortion, because before God comes over Mary, and we have the incarnation, God asks for Mary’s consent… so to me, that is an affirmation in one of our most central stories that creation has to be done with consent. You cannot force someone to create… so that’s how I come down on that side of the issue.”

After the Supreme Court overturned Roe in 2022, Talarico said, “This summer, more than half our population became second-class citizens. Every one of our neighbors with a uterus became the property of the State. And nothing is more un-Christian.”

In a video going viral on social media, Talarico appears to be giving a sermon in a church in which he says, “Did they teach you in Sunday school that Jesus Christ himself was a radical feminist?”

Beyond religion, he has also taken stances that break with common scientific understanding. In a Texas House Committee on Public Education hearing, he stated, “Modern science obviously recognizes that there are many more than two biological sexes; in fact, there are six.”

During the same hearing, he went even further, saying, “The point is that biologically speaking, scientifically speaking, sex is a spectrum, and oftentimes can be very ambiguous.”

State Rep. James Talarico on the Texas House of Representatives floor in Austin.(James Talarico Senate campaign)

In another sermon, he said the use of the term “woman” in the context of women’s rights should not be understood as an “exhaustive” term.

“Our trans community needs abortion care too. Defending trans Texans is something we have to do every day at the state Capitol, and you better believe I’ll be giving sermons on that too,” he said, continuing, “So when I use the word ‘woman,’ it should not be understood as an exhaustive lens through which we understand, examine and interrogate patriarchy. Similar to how we specify anti-Black racism.”

In a series of 2020 tweets, Talarico referred to racism as a “virus” spread by all White people, regardless of whether they exhibit its “symptoms.”

“White skin gives me and every white American immunity from the virus. But we spread it wherever we go —through our words, our actions, and our systems. We don’t have to be showing symptoms—like a white hood or a Confederate flag—to be contagious,” he wrote, adding, “The only cure is diagnosing the virus within ourselves and taking dramatic actions to contain the spread. The first small step is proclaiming loudly and unequivocally that #BlackLivesMatter.”

On the Senate campaign trail, Talarico has framed his candidacy as one in opposition to billionaires, who he said are “destroying” the U.S.

“The only thing the media wants to ask me about are trans athletes. The only minority destroying this country is the billionaires,” he said during an interview with MSNBC. “Trans people are 1% of the population. Undocumented people are 1% of the population. We are all focused on the wrong 1%. Trans people aren’t taking away our healthcare. Undocumented people aren’t defunding our schools. It’s the billionaires and their puppet politicians.”

He has also harshly criticized U.S. Immigration and Customs Enforcement officers, accusing them of using terror to target immigrant families.

“Those neighbors of ours deserve a lot better than ICE terrorizing them and their children, ICE tearing families apart,” he said in an interview with local outlet KRWG.

Regarding border security, Talarico said during the Texas Democratic Senate debate against Crockett that “Our southern border should be like our front porch. There should be a giant welcome mat out front and a lock on the door.”

He continued, “We can welcome immigrants who want to live the American dream. We can build a pathway to citizenship for those neighbors who have been here, making us richer and stronger, and we can keep out people who mean to do us harm.”

Talarico defeated Crockett in the Democratic primary by a comfortable margin despite her already having a national following. Now, Democrats believe that Talarico stands a good chance to flip a Texas Senate seat blue for the first time in 33 years.

He will face off against either longtime incumbent Sen. John Cornyn, R-Texas, or state Attorney General Ken Paxton, depending on which candidate emerges victorious from the GOP’s May 26 primary runoff election.

Republicans quickly took aim at Talarcio on Tuesday evening, even before his victory over Crockett was called.

“James Talarico is an open borders, Trump-hating radical who can never be allowed to set foot in the U.S. Senate,” National Republican Senatorial Committee communications director Joanna Rodriguez charged in a statement.

Texas Attorney General Ken Paxton, a Republican candidate for the U.S. Senate, speaks during a primary election night watch party Tuesday, March 3, 2026, in Dallas.(Julio Cortez/AP Photo)

Paxton, in a primary night speech in Dallas, claimed Talarico is a “far-left radical who wants to abolish ICE, says God is non-binary — I’m not even sure I know what that means — and thinks Christians are commanded to put boys in girls’ sports. He will do nothing more than be a puppet for Chuck Schumer and the national Democrats.”

And Cornyn, in a Fox News Digital interview on Sunday, argued that both Talarico and Crockett “should be running for the Senate in California, not in Texas. They’re way out of the mainstream in Texas.”

Sen. John Cornyn, R-Texas, speaks during a campaign stop in The Woodlands, Texas, Saturday, Feb. 28, 2026.(Annie Mulligan/AP Photo)

Meanwhile, a veteran Republican operative who works in Senate races described Talarico as “Beto 2.0,” as he referred to former Democratic Rep. Beto O’Rourke, the one-time rising star who came up short as the 2018 Democratic Senate nominee in trying to knock off conservative Sen. Ted Cruz, and who later ran unsuccessfully for the White House and for Texas governor.

“Republicans recognize that Talarico’s a formidable candidate but also know that Texas is still a pretty conservative state, and they’re going to try and brand him a far-left radical so that center-right voters and independent voters in the state don’t choose him over the Republican nominee,” longtime Texas-based GOP consultant Brendan Steinhauser told Fox News Digital.

“Republicans are going to find every speech on the Texas House floor that Talarico gave that was progressive in nature or to the left, and they’re going to use that time and again to try and brand him as a far left guy. That’s the kind of playbook I expect, and they’re not going to waste anytime doing that,” he added.

Among Talarico’s top supporters is progressive Rep. Greg Casar, D-Texas, who celebrated his primary victory by posting on X, “James Talarico is the future of the Democratic Party.”

State Rep. James Talarico shakes hands with supporters at his primary night celebration, on March 3, 2026, in Austin.(Paul Steinhauser/Fox News)

“He unites working people of all kinds to take on the billionaires who are making life unaffordable. He’s going to show Texas Republicans how powerful working people are when we stand together. On to victory in November,” wrote Casar.

JT Ennis, a spokesperson for Talarico’s campaign, responded to Fox News Digital’s request for comment by dismissing criticism of Talarico’s comments as “stale attacks to mislead Texans.”

In an emailed statement, Ennis told Fox News Digital, “John Cornyn, Ken Paxton, Greg Abbott and the billionaires who prop them up are scared of James Talarico for good reason: our campaign is building a movement poised to change the politics of this state and take power back for working people.”

“While they lob stale attacks to mislead Texans, we are uniting the people of Texas to win in November.”

And the Democratic Senatorial Campaign Committee chair, Sen. Kirsten Gillibrand, touted that “Talarico has spent years fighting for Texans in the state house, where he went to bat for teachers and students, fought to lower the cost of health care, and took on corruption in politics. Now, he’s ready to take that fight to the U.S. Senate.”

Meanwhile, conservative pundits believe Talarico will fail to gain the bipartisan appeal needed to flip Texas blue.

Matthew Schmitz, a conservative commentator, wrote on X, “James Talarico’s woke Billy Graham shtick has the same function as Tim Walz’s trans-affirming Elmer Fudd persona. Democrats desperately want a rural/religious-coded white male who can make their most unpopular positions seem American as apple pie.”

Talarico and Casar did not immediately respond to Fox News Digital’s requests for comment.

Trump taps US Senator Mullin to replace Noem as DHS chief

    • Noem embraced harsh immigration rhetoric and actions
    • Staffing change may alter Trump’s immigration strategy
    • Critics accuse Noem of targeting non-criminal immigrants

WASHINGTON, March 5 (Reuters) – One of the top officials overseeing President Donald Trump’s immigration crackdown, U.S. Homeland Security Secretary Kristi Noem, will leave her role, U.S. President Donald Trump said on Thursday, a major staffing move that raises questions about the direction of the Republican president’s immigration agenda.

“I am pleased to announce that the ‌Highly Respected United States Senator from the Great State of Oklahoma, Markwayne Mullin, will become the United States Secretary of Homeland Security (DHS), effective March 31, 2026,” Trump wrote on Truth Social.

Noem will serve as “Special envoy for The Shield of the Americas,” Trump said.

Noem, a former governor of South Dakota, became one of Trump’s most high-profile Cabinet secretaries with social media posts that portrayed immigrants in harsh terms, highlighting cases of alleged criminal offenders and using vitriolic language.

She faced criticism in January when she quickly labeled two U.S. citizens fatally shot by federal immigration agents in Minneapolis as committing “domestic terrorism.” Videos that emerged after the deaths undercut the assertion by Noem and other Trump officials that the two deceased – Renee Good and Alex Pretti – were violent aggressors.

The public backlash for deaths led the Trump administration to move to a more targeted approach to immigration enforcement in Minnesota after months of sweeps through U.S. cities that led to violent clashes with residents opposing the crackdown.

Democrats in the U.S. House of Representatives moved to impeach Noem and at least two Republicans in Congress called for her to lose her job after the incidents. During congressional hearings in March, Democrats and some Republicans criticized Noem for her approach to the immigration crackdown and management of DHS, including concern over a $220 million ad campaign that heavily featured Noem.

The staffing change raises questions about whether the Trump administration could seek to intensify its mass deportation push or retreat to a more targeted approach. Under Noem’s leadership, masked immigration agents surged into Los Angeles, Chicago and Washington, D.C., scouring neighborhoods and Home Depot parking lots in search of possible immigration offenders.

The popularity of Trump’s immigration approach fell as agents ‌detained U.S. citizens and tear-gassed streets in an attempt to drive up deportations, which last year fell short of the administration’s goal of 1 million per year.

STRONG EMBRACE OF TRUMP’S HARDLINE IMMIGRATION APPROACH

While Noem, 54, served as a prominent proponent of Trump’s agenda, White House Deputy Chief of Staff Stephen Miller, a long-time Trump aide, controls Trump’s immigration policy.

Noem was quickly confirmed to lead the 260,000-employee Department of Homeland Security in January 2025 after Trump took office. On social media, she referred to immigrants convicted of crimes as “scumbags” even as the number of non-criminals arrested by immigration authorities rose under Trump.

She joined immigration enforcement operations on the ground in New York City and visited a maximum-security prison in El Salvador where Venezuelan immigrants deported by the Trump administration were being held without charges or access to lawyers.

The number of migrants caught trying to illegally cross the U.S.-Mexico border plummeted under Trump’s restrictive policies, a steep drop after high levels of illegal immigration under former President Joe Biden, a Democrat.

Noem, reflecting Trump’s agenda, also took steps to cut legal immigration programs and increase vetting. She ended several Temporary Protected Status programs that provided work permits to hundreds of thousands of immigrants from Venezuela, Haiti and other nations, drawing legal challenges.

After an Afghan immigrant was accused of attacking National Guard members in Washington, D.C., Noem said she recommended that Trump place “a full travel ban on every damn country that’s been flooding our nation with killers, leeches, and entitlement junkies.”

Critics said Noem demonized immigrants and promoted an immigration enforcement strategy that targeted non-criminal, working immigrants and families.

During Noem’s tenure, the number of deaths in immigration detention rose to a two-decade high while staff in DHS oversight offices were slashed sharply.

RFK Jr. challenges Dunkin’ and Starbucks over safety of sugary drinks

    March 5, 2026 / 12:41 PM EST / CBS News

Health and Human Services Secretary Robert F. Kennedy Jr. is challenging two major coffee chains – Dunkin’ and Starbucks – as part of his “Make America Healthy Again” initiative.

Kennedy recently called on the two companies to prove their high-sugar drinks are safe for teenagers and suggested the Trump administration could place limits on your morning cup of coffee.

“We’re gonna ask Dunkin Donuts and Starbucks, show us the safety data that show that it’s OK for a teenage girl to drink an iced coffee with 115 grams of sugar in it. I don’t think they’re gonna be able to do it,” Kennedy said late last month.

Massachusetts Gov. Maura Healey, where Dunkin’ is based, responded to Kennedy on X, posting “COME AND TAKE IT” with an image of a Dunkin’ cup.

Federal dietary guidelines published earlier this year recommend meals should have no more than 10 grams of added sugar – but nearly every drink on the Dunkin’ menu exceeds that amount and at least six have more than 100 grams, according to the coffee chain.

“This isn’t about any one brand. Ultra-processed foods and beverages are bad for you, regardless of who happens to sell them,” said CBS News contributor Dr. Céline Gounder. “Your go-to beverage really shouldn’t be liquid candy.”

Studies show taxes on sugary drinks and photo warnings reduce consumption. Dr. Gounder said a direct ban is unlikely to happen.

“It’s gonna require either new legislation and regulation, or state and local governments stepping in where they can,” she said. “The FDA is not the sugar police and it can’t ban sugar from beverages.”

According to the Centers for Disease Control and Prevention, frequently drinking sugary drinks is associated with “weight gain, obesity, type 2 diabetes, heart disease, non-alcoholic liver disease, tooth decay and cavities.”

The Department of Health and Human Services said it has strengthened reviews and closed loopholes, but did not clarify what action Kennedy may take to stop businesses from selling high-sugar drinks.

Dunkin’ and Starbucks have not responded to Kennedy’s comments. On Thursday, Dunkin’ announced the release of a zero-sugar energy drink available in six flavors.

    By Mary Cunningham
    Updated on: March 5, 2026 / 2:34 PM EST / CBS News

24 states sue Trump administration over tariffs imposed after Supreme Court ruling

    By Mary Cunningham
    Updated on: March 5, 2026 / 2:34 PM EST / CBS News

Two dozen states sued the Trump administration on Thursday, alleging that President Trump exceeded his authority in imposing new global tariffs after the Supreme Court in February struck down emergency import duties he introduced last year.

The lawsuit centers on 10% tariffs the Trump administration recently implemented under Section 122 of the Trade Act of 1974. Mr. Trump later said he would raise the tariffs to 15%. The states argue that the tariffs violate the Constitution’s separation of powers principle.

In a 6-3 decision last month, the Supreme Court ruled that Mr. Trump did not have the right to impose tariffs under the 1977 International Emergency Economic Powers Act (IEEPA).

“As with his unlawful use of IEEPA, the president has once again exercised tariff authority that he does not have — involving a statute that does not authorize the tariffs he has imposed — to upend the constitutional order and bring chaos to the global economy,” the states said in the suit.

Trump administration officials have said that raising tariffs on imports will restore fairness to global trade, spur investment in the U.S. and generate government revenue. Data shows the U.S. collected $287 billion in customs duties, taxes and fees in 2025, up 192% from the previous year.

    Stinging legal defeats

The lawsuit asks the U.S. Court of International Trade to rule that Section 122 tariffs are illegal and to order the U.S. government to refund states for any costs while the tariffs were in effect.

The litigation also intensifies the pushback against the Trump administration over its tariff policies since the high court’s ruling striking down its IEEPA levies. A Court of International Trade judge ruled on Wednesday that businesses that paid IEEPA tariffs are entitled to refunds. Separately, a federal appeals court on Monday declined to delay implementation of the Supreme Court ruling on IEEPA.

Trade experts estimate that the U.S. government could owe as much as $175 billion to businesses that paid IEEPA levies.
