Supreme Court chief justice pinpoints what Americans misunderstand about he and his colleagues

Chief Justice Roberts says Supreme Court is not making policy decisions

    By Eric Mack
    Fox News

    Published May 7, 2026 8:14am EDT

Political critics of Supreme Court decisions fundamentally do not understand the role of the institution, according to Chief Justice John Roberts.

It is to interpret the law, not make it, he told a judicial conference in Hershey, Pennsylvania.

“I think, at a very basic level, people think we’re making policy decisions, we’re saying we think this is how things should be, as opposed to what the law provides,” Roberts said Wednesday night. “I think they view us as purely political actors, which I don’t think is an accurate understanding of what we do.”

The decision reviewing the unconstitutionality of race-based gerrymandering under the Voting Rights Act has resurfaced rebukes of the political ideology of the Court. Three conservative justices, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett, were placed on the bench by President Donald Trump during his first term, giving Republican-nominated justices a 6-3 majority.

Justices, however, are making decisions based on the law and contextual readings of the Constitution, not their personal policy preferences, Roberts stressed to the conference of judges and lawyers from the 3rd U.S. Circuit in Pennsylvania.

“I think considered criticism is a very good thing,” Roberts said. “You hope it’s intelligent criticism, but it doesn’t have to be. It’s a free country and I certainly don’t object to it, and I don’t think [my colleagues do either].”

FOX NEWS POLL: APPROVAL OF SCOTUS AT 5-YEAR HIGH, REBOUNDING FROM RECORD LOW IN 2024

The Supreme Court has also expanded gun rights and overturned the constitutional right to abortion in recent years. Public confidence in the Supreme Court was at a low of 40% after the 2022 Dobbs v. Jackson Women’s Health Organization abortion ruling, showing the politics of rulings determines perception as the words of the Constitution remain unchanged.

The rulings are “based on our best effort to figure out what the Constitution means and how it applies” to the existing law, Roberts said.

“We’re not simply part of the political process, and there’s a reason for that, and I’m not sure people grasp that as much as is appropriate,” Roberts said, stressing that “one thing we have to do is make decisions that are unpopular.”

“On the other hand,” Roberts said, “there is a point where it changes from criticism of the opinion to criticism of the judge and it can lead to some very serious problems.”

JUSTICE NEIL GORSUCH BREAKS SILENCE ON VIOLENT THREATS AGAINST JUDICIARY, SUPREME COURT LEAKS

Heated political rhetoric, potentially fueled by violent protest groups, can endanger judges.

In June 2022, an armed suspect was caught outside Kavanaugh’s home. Nicholas John Roske pleaded guilty and was sentenced to 97 months in prison and lifetime supervised release after admitting to the attempted assassination.

“There’s a lot of hostility that’s publicized about judicial decisions and which judge wrote those decisions,” Roberts warned. “I think we have to be a little more careful and make sure people, to the extent you can, are more careful about that.”

TRUMP REVEALS HE HAS MULTI-PICK SCOTUS PLAN READY AS RETIREMENT SPECULATION HEATS UP

Judges bowing to the pressures of political ideology from the American public would have devastating effects, according to Roberts.

“If you do it cavalierly, overrule precedent just because you think it’s wrong, then the whole system begins to suffer,” he said.

The advanced ages of Thomas and Alito have raised questions of whether they might consider retirement either before the midterms — which could change Congress’ ability to get through another conservative justice nominee under Trump — or before 2028, where a flip of the White House and/or Congress could shift the court back away from a conservative majority.

United States and Mexican law enforcement said they seized dozens of packages of cocaine from a go-fast vessel as part of one of several operations aimed at stopping the flow of illicit drugs around the world.

Customs and Border Patrol air assets first spotted the go-fast boat in the Pacific Ocean off the coast of Mexico, the Joint Interagency Task Force South, a group made up of 21 partner nations including the U.S. and Mexico, said on social media. The boat’s crew allegedly threw bales of illicit drugs into the ocean as they realized they had been spotted.

The Mexican navy was able to quickly respond and retrieve the drugs. They seized about 1,990 pounds of cocaine, the task force said. Photos show the efforts to rescue the drugs from the ocean.

Officials said the navy also fast-roped Marines directly onto the deck of the go-fast vessel. The task force did not say if any arrests were conducted.

It was one of at least three recent operations the Mexican navy conducted in the Pacific Ocean, according to a social media post from the agency. In one operation, naval forces seized 22 packages of cocaine and rescued 11 shipwrecked people from a vessel near Guerrero. The rescued group received medical attention before being handed over to immigration authorities, the navy said.

A second operation saw the navy discover seven packages of cocaine while inspecting a container ship that was docked in the port city of Manzanillo. Three stowaways were also discovered and detained, the navy said.

In the third operation, the navy recovered 34 additional packages of illicit cargo from a boat near Acapulco, which were transported to the Oaxacan coast to be destroyed.

The navy did not say what dates these operations took place on, or specify which effort the CBP assisted with. The navy said that 65.5 tons of illicit cocaine has now been seized under the current administration.

Rubio holds ‘constructive’ meeting with Pope Leo after Trump sends hard-line Iran message to Vatican

Secretary of State Marco Rubio met with Pope Leo at the Vatican for “constructive” conversations on Thursday following heightened tensions between President Donald Trump and the pontiff over the U.S.-Iran conflict.

“The conversations today were friendly and constructive,” a State Department official told Fox News Digital.

Rubio, a Catholic, held a private meeting with the pope to reaffirm the Vatican-U.S. partnership early on Thursday morning. Trump said he sent Rubio to deliver what he described as a “very simple” message: Iran must not obtain a nuclear weapon.

Rubio and Leo discussed the situation in the Middle East and “topics of mutual interest in the Western Hemisphere,” according to a State Department readout.

“The meeting underscored the strong relationship between the United States and the Holy See and their shared commitment to promoting peace and human dignity,” said spokesperson Tommy Pigott in a statement.

The Vatican issued a statement following the “cordial talks” that “renewed” a common commitment to bilateral relations.

“There was then an exchange of views on the regional and international situation, with particular attention to countries marked by war, political tensions and difficult situations Humanitarian, as well as on the need to work tirelessly for peace,” the statement said.

The meeting marked the Trump administration’s first engagement with the pontiff in nearly a year following tension.

“There has also been this threat against the entire people of Iran, and this is truly unacceptable,” the pope said in April. “There are certainly issues of international law here, but even more so a moral issue for the good of the whole entire population.”

Trump has taken an aggressive approach to his messaging with Iran and told reporters on Wednesday he only has one message for the pope.

“I can tell you this, that as far as the Pope is concerned, and it’s very simple. Whether I make him happy or I don’t make him happy, Iran cannot have a nuclear weapon. And he seemed to be saying that they can. And I say they cannot, because if that happened, the entire world would be hostage. And we’re not going to let that happen,” he said.

“They reviewed ongoing humanitarian efforts in the Western Hemisphere and efforts to achieve a durable peace in the Middle East. The discussion reflected the enduring partnership between the United States and the Holy See in advancing religious freedom,” said Pigott in a readout.

Good & Gather snack, other nut mixes recalled due to salmonella risk

    May 7, 2026 / 10:43 AM EDT / CBS News

An Illinois food manufacturer is recalling several snack products due to concerns that they may be contaminated with salmonella, according to a recall notice with the Food and Drug Administration.

The recall affects nut mixes and a corn mix manufactured by John B. Sanfilippo and Son and sold under the brand names Southern Style Nuts, Fisher, Squirrel Brand and Good & Gather.

The Good & Gather product, a Mexican street corn-inspired trail mix, was sold at Target, while the others were sold at various retail stores, online and by QVC, according to the FDA notice.

The snack mixes contain dry milk powder previously recalled by another food company, California Dairies. The FDA said the seasoning tested negative for salmonella before it was used for the products and that John B. Sanfilippo and Son initiated the recall as a “precautionary measure.”

“Consumers who have recently purchased the items listed below should not consume these products and should return them to the store of purchase for a full refund or replacement,” the FDA said in the recall notice.

Salmonella is a bacterial disease that can spread through contaminated water or food. It can cause serious and sometimes fatal infections in young children, pregnant women, older adults and people with weakened immune systems.

14 tornadoes reported across Mississippi as powerful storms ravage hundreds of homes, knock out power

    May 7, 2026 / 11:53 AM EDT / CBS/AP

Destructive storms ripped through parts of Mississippi on Wednesday night, producing at least 14 reported tornadoes, authorities said. One tornado has been confirmed.

A 1-year-old child was missing after the storms hit, CBS affiliate WJTV reported, citing emergency responders in Lincoln County. Officials said at least 17 people were hurt to some degree.

The storms collapsed hundreds of homes, downed trees and knocked out power lines in multiple counties, officials said. A fire completely engulfed a home in Tylertown after witnesses say it was struck by lightning.

In Lincoln County, falling trees split a car and trapped people at a mobile home park in the small community of Bogue Chitto, WJTV reported.

“I was just watching TikTok on my bed and thought it was thunder. I went to my living room. I went back to my room, and the room’s gone,” resident Max Mahaffey told WAPT-TV.

He said he wasn’t injured, but his grandmother hurt her ankle and some of his neighbors suffered cuts and bruises.

The National Weather Service said “a very large and dangerous tornado” moved from eastern Lincoln County into Lawrence County.

Gov. Tate Reeves said multiple tornadoes were reported throughout the central and western parts of the state and that the state Emergency Management Agency was coordinating response efforts.

“Pray for Mississippi,” he posted online.

Mamdani’s latest tax pledge ‘makes no sense’ and will only exacerbate Florida ‘exodus’: former mayor

The former Republican mayor of Boca Raton is speaking out against the economic and tax policies of New York City Mayor Zohran Mamdani and warning that reports of business owners and job creators fleeing to red states like Florida are likely to continue.

“I didn’t have to be a soothsayer to know that when you elect a Democrat socialist with far left ideas that are just intent on taxing, taxing, taxing and have plans that have no hope of passing, you’re going to cause more capital to flee,” Scott Singer, running for Congress as a Republican in Florida’s 25th District, told Fox News.

Mamdani has faced heavy criticism over his “tax the rich” platform since taking office, including from Citadel CEO and billionaire Ken Griffin, who recently pledged to increase his investment in Florida in response to new taxes on the wealthy imposed by the new socialist mayor.

Singer, who predicted a business exodus from New York City to Florida in an interview with Fox News Digital in October, says the “exodus is going to continue naturally.”

“People have already gotten wise and crazy statements like taxing people just because we can, and putting surtaxes on what are already the highest tax rates in the country, and thinking people aren’t going to move is a bad idea,” Singer said. “It’s not going to work, and people are going to continue to move.”

Mamdani recently celebrated a proposal to tax luxury second homes owned by the ultra-wealthy, a plan expected to generate at least $500 million annually.

“It makes no sense from a policy standpoint,” Singer said. “A part-time resident in New York City who’s already paying tons of property taxes at a rate that Mamdani wanted to increase, what, 11% more? They’re not using any services. So why would people continue to invest there? All they’re going to do is drive more capital away, depress values, and create fewer job opportunities.”

Former Trump advisor warns NYC’s mayor will ‘chase out’ all taxpayers from New York

The right path forward, according to Singer, is “creating job growth, lowering taxes, shrinking government and allowing the free market to continue to attract jobs to attractive places.”

Fox News Digital reached out to Mamdani’s office for comment.

Mamdani claimed last month that threats of the city’s wealthiest residents leaving the city over high taxes are “imagined.”

“For all of the discussion of the imagined exodus that would take place were we to tax the wealthiest New Yorkers by the appropriate amount — I say imagined because before I was a mayor I was a state legislator, and I was part of an effort to increase taxes on millionaires at that time — we were told the same thing then — and what we find now is that we have more millionaires today than we did at that time even after having passed that tax,” Mamdani said.

New York City’s population declined in 2025, the year before Mamdani took office, resulting in a net loss of about 12,000 people. The drop follows post-pandemic gains of 70,000 in 2023 and 163,000 in 2024, driven largely by increased immigration, including asylum seekers, according to an April 20 report from the Citizens Budget Commission.

Cruise passengers who departed ship early monitored for hantavirus in U.S., worldwide

    May 7, 2026 / 11:31 AM EDT / CBS News

    By Mark Osborne

The effort to monitor the spread of hantavirus from a cruise ship currently off the west coast of Africa is expanding, including in the United States, after health officials confirmed the virus on the ship is the rare strain that is transmissible from human to human.

Twelve countries are currently monitoring people who had disembarked the cruise ship before cases of hantavirus were confirmed, the World Health Organization said at a press conference Thursday. Those countries are Canada, Denmark, Germany, the Netherlands, New Zealand, Saint Kitts And Nevis, Singapore, Sweden, Switzerland, Turkey, the United Kingdom and the United States.

Two residents in Georgia and one in Virginia are among those being monitored for signs of the rare and often deadly disease after they returned home from the MV Hondius, the cruise ship at the center of the outbreak. All three are in good health and showing no signs of the virus, according to the departments of health in Georgia and Virginia. An unspecified number of California residents are also being monitored, the state’s health department said, with none showing signs of the illness or infection.

But three people who were on the cruise have died, including a couple from the Netherlands and another woman from Germany, according to the World Health Organization.

The husband in the Dutch couple died on board the cruise ship on April 11, the company said. However, Oceanwide Expeditions, the company that owns the ship, confirmed on Thursday that 30 guests — including six Americans — disembarked the Hondius on Saint Helena, an incredibly remote island in the middle of the South Atlantic, on April 24, and then returned on their own to their countries of origin.

“No samples were taken [from the man who died on board] and because his symptoms were similar to those of other respiratory diseases, hantavirus was not suspected,” Dr. Tedros Adhanom Ghebreyesus, director-general of the WHO, said at a press conference Thursday.

Among those 30 who disembarked was the wife of the Dutch man who died on the cruise, according to Oceanwide Expeditions. Her health worsened on a flight from Saint Helena to Johannesburg on April 25, the WHO said. She then briefly boarded a KLM passenger flight in Johannesburg, but she was not allowed to fly due to her medical condition, the airline said. She died in South Africa the next day after not being allowed to fly home, according to the WHO.

A British man who exhibited symptoms on the ship was evacuated on April 27 to receive medical care in South Africa. His case was the first confirmed to be hantavirus on May 4, Oceanwide Expeditions said. The man remains hospitalized, but his condition was improving, the WHO said.

Officials then confirmed the Dutch woman’s blood tested positive for hantavirus. KLM said it was notified of the test results on May 5 and was notifying everyone on the flight that the woman had boarded.

South African authorities said Wednesday the strain of hantavirus identified in the Dutch woman and the man in the hospital is the Andes strain. The Andes strain, which is found primarily in Argentina and Chile, can be transmitted from human to human, unlike other strains of the virus, which are caused by direct contact with rodents.

“In previous outbreaks of Andes virus, transmission between people has been associated with close and prolonged contact, particularly among household members, intimate partners and people providing medical care,” Tedros said at the press conference. “That appears to be the case in the current situation.”

    Concerns over the virus

Health experts say the risk for a widespread outbreak of the disease is still unlikely.

“The pandemic risk from this outbreak is low,” said CBS News medical correspondent Dr. Céline Gounder. “Hantavirus does not spread the way flu or COVID does. But this is exactly the kind of event that tests whether global health systems work.”

Two Brits who were aboard the Hondius have since independently returned to the U.K. and are also being monitored, according to the U.K. Health Security Agency. Neither is currently reporting symptoms, and they’ve been advised to self-isolate, the agency said in its statement, adding, “The risk to the general public remains very low.”

Another person who disembarked in Saint Helena was tested in Switzerland for the disease and tested positive for the Andes strain, the WHO said.

Three people with suspected hantavirus cases were airlifted from the ship Wednesday, including German and Dutch passengers and a British crew member, Oceanwide Expeditions said. The Dutch passenger and British crew member are being treated in the Netherlands and are both stable, the WHO said. The German passenger was asymptomatic and returned to Germany, the WHO said.

Dr. Jay Bhattacharya, acting director for the U.S. Centers for Disease Control and Prevention, said in a statement Wednesday night that the CDC has been “coordinating with domestic and international partners” since it learned of the outbreak.

The ship departed Cape Verde late Wednesday and is traveling north to the Canary Islands. The trip is expected to take three or four days, though some officials in the Canary Islands have already said they don’t want the ship docking at the Spanish archipelago’s largest island, Tenerife, as planned.

“I want to express my deep rejection of the arrival of the ship Hondius at the port of Granadilla,” José Domingo Regalado, mayor of the Tenerife seaside community of Granadilla de Abona, said in Spanish in a video statement Wednesday. “What we ask is that action be taken, since they can be transferred to the nearest airport to their countries of origin so that they can quarantine and be treated by their health system if they require it.”

Regalado added the decision to bring the passengers to the Canary Islands showed “no common sense.”

Canarias President Fernando Clavijo announced on Thursday the ship would be allowed to anchor off the islands, but not dock there.

Argentina offers help with treating virus

in Argentina, where the Andes strain originated, the country’s health ministry said it was offering its “technical capacity, experience and resources available to assist health systems that require it.”

“Yesterday it was confirmed that the variant corresponds to the Andes strain, which only has a history of circulation in Chubut, Río Negro and Neuquén and in southern Chile,” the health ministry said. “Taking into account that the ship set sail from Argentina on April 1, our country actively collaborates with the international agencies involved and with all the countries involved to contain the outbreak and ensure proper management of cases.”

The country said no associated cases have been reported in Argentina.

Argentina’s health ministry also said no hantavirus cases have ever been reported in Tierro del Fuego since mandatory notification began in 1996. The cruise ship departed from that region’s capital, Ushuaia.

The Dutch couple who died arrived in Argentina on Nov. 27 and spent months traveling around the country and neighboring Chile and Uruguay before returning to Argentina on March 27 and boarding the MV Hondius on April 1.

“Prior to boarding the ship, the first two cases had traveled through Argentina, Chile and Uruguay on a bird-watching trip, which included visits to sites where the species of rat that is known to carry Andes virus was present,” Tedros said on Thursday. “WHO is working with health authorities in Argentina to understand the movements of the couple, and I thank the government of Argentina for its cooperation, given its experience and expertise with Andes virus.”
