United Airlines CEO said U.S. airfares could soon rise as Iran war drives up oil prices

    Updated on: March 6, 2026 / 4:28 PM EST / CBS News

Travelers could soon see a rise in U.S. airfares as climbing global oil costs due to the Iran war boost the cost of jet fuel.

Speaking at an industry event on Thursday, United Airlines CEO Scott Kirby said rising fuel costs will have a “meaningful” impact on the carrier’s financial results this quarter, CNBC reported. He also said the impact on passenger plane ticket costs will “probably start quick.” United confirmed Kirby’s comments with CBS News.

West Texas Intermediate, the U.S. oil benchmark, shot up more than 11% on Friday to nearly $91 per barrel after President Trump demanded Iran’s “unconditional surrender,” stoking investor concerns about a prolonged conflict. Brent crude, the international benchmark, jumped to $92.47, the highest level in nearly two years.

    Which seats will cost more

Travel industry analyst Henry Harteveldt, founder of the Atmosphere Research Group, told CBS News he is already seeing airplane ticket prices creep up since the Iran conflict kicked off.

“Airlines began increasing airfares this week as spot jet fuel prices started to spike,” he said.

Most of those increases have been for premium tickets in business and first-class cabins, Harteveldt added, noting that prices are less likely to climb for “people who buy basic economy or discount coach tickets.”

Harteveldt also said that some carriers have tacked on “fuel surcharges” to ticket prices on some long-haul international routes.

“Airlines know, perhaps better than any other industry, what consumers’ willingness to pay for a flight is,” he told CBS News. “So they are trying to find a balance between how much they can increase fares to cover substantially higher fuel costs and how high is too high.”

    Surging jet fuel costs

Jet fuel, which accounts for about one-fifth of airlines’ operating expenses, on Thursday cost $3.95 a gallon, up 56% from $2.50 in late February, one day before the joint U.S.-Israel attack on Iran, according to the Argus U.S. Jet Fuel Index.

The Strait of Hormuz, a vital trade route in the Middle East for oil and liquefied natural gas, is effectively closed because of the war. That supply disruption is now causing “stratospheric moves in global jet pricing,” James Noel-Beswick, head of commodities at market research firm Sparta, said in a client note this week.

Noel-Beswick also noted that jet fuel prices in Europe have hit their highest level since 2022, as airlines face “both longer flight routes and tightening supply.”

Vidya Mani, a visiting associate professor at Cornell University’s SC Johnson College of Business, told CBS News that war-related constraints on oil and gas supplies could lead to inflationary pressures across a range of goods.

“When this lasts for several weeks [or] months, the compounding effect ripples through supply chains due to the lack of energy access at major manufacturing hubs,” she said.

    Lost revenue

Airlines already face lost revenue from canceled or diverted flights in the Middle East due to the war. For carriers and other oil-intensive industries, much depends on the duration of conflict, according to Fitch Ratings.

“Disruption increases operating costs through longer routings, additional technical stops, crew and staff overtime, and higher accommodation and handling expenses,” analysts with the credit bureau wrote in a report. “As well as lost revenue, airlines are likely to be affected by higher fuel prices.”

James Talarico, a Democratic candidate for Senate in Texas, once posted information to social media, letting illegal aliens know they could evade detention as law enforcement grappled with a wave of immigration under President Donald Trump’s first term.

In a graphic put out by United We Dream, an activist group that supports abolishing Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP), Talarico encouraged viewers not to open their doors, not to sign any documentation without an attorney, to take pictures of ICE agents and to “fight back.”

“Undocumented Americans are folks who work in our businesses, learn in our schools and contribute to our communities — but lack citizenship documentation,” Talarico said in a post to X in 2019.

“As a Texas legislator, they’re also my constituents,” he added.

Talarico’s 2019 posts come as he wages a Senate campaign in the Lone Star State that’s attracted national attention. His comments clash with efforts to position himself as a pro-enforcement candidate.

In 2019, Talarico was in his second year of serving Texas as a state legislator.

At the time of his post, the United States reported an explosion of CBP Southwest Border Apprehensions, according to data published by the agency. In July alone, CBP reported 81,000 apprehensions — down from a peak of 144,000 in May — as immigrants feeling instability and crime in Guatemala, Honduras and El Salvador poured into the U.S.

For context, CBP reported just 40,000 apprehensions in July 2018, the year before.

In response to inquiries from Fox News Digital about the post, Talarico’s campaign said his message has focused on targeting individuals who threaten the public safety of the U.S.

“James has been clear that we should be spending precious law enforcement resources cracking down on the cartels, not our communities; deporting gang members, not small business owners; and hunting down human traffickers, not moms and babies,” Talarico spokesperson JT Ennis said in a statement.

Talarico, who just beat out progressive candidate Jasmine Crockett, D-Texas., in a heated Senate primary, now looks to win over voters in November’s general election.

If elected, he would become Texas’ first Democratic senator since Sen. Bob Krueger in 1993.

It’s still unclear who Talarico will be facing in the general election due to a Republican runoff between Texas Attorney General Ken Paxton and incumbent Sen. John Cornyn, R-Texas.

When asked about immigration enforcement in the past, Talarico likened his views on enforcement to the entry of a home.

“Our border should be like a front porch — it should have a welcome mat out front and a lock on the door,” Talarico wrote on his website.

Among other immigration policies, Talarico supports increasing ICE resources for public safety and national security, banning the use of masks by ICE agents, creating a pathway to legalization for certain undocumented immigrants, hiring more immigration judges and modernizing security at ports of entry.

Talarico’s campaign believes his views separate him from his Republican competition.

“While James fights for immigration policies a majority of Texans support, Cornyn, Paxton, and the billionaires who prop them up are trying to smear James because this people-powered movement is a threat to their wealth and power,” Talarico’s campaign said.

Talarico will face down his Republican opponent on Nov. 3, 2025.

House hunting? Here’s what to know as the spring buying season arrives.

    March 6, 2026 / 5:27 PM EST / CBS News

Aspiring home buyers can look forward to a modestly more favorable real estate market heading into the spring house-hunting season.

Although home prices remain historically elevated, purchase costs are growing more slowly. According to Redfin data, median home prices in January rose at an annual rate of 1.1%, down from 4.1% a year ago.

“Conditions are better because the mortgage rates are lower and home prices went up slower than wages in the last year, which should be giving homebuyers more purchasing power and more confidence,” Daryl Fairweather, chief economist at Redfin, told CBS News.

People in the market for a home could also see more listings this spring, according to economists.

    Where are mortgage rates headed?

While mortgage rates ticked back up to 6% this week due to inflation fears linked to the Iran war, that’s considerably lower than the March 2025 rate of 6.6%.

That may be as good as it gets. Experts think home prices are likely to remain sticky heading into spring and that mortgage rates might not swing much below 6%.

“I feel like it’s more likely that [mortgage rates] will level off than they will continue to slide,” Fairweather said.

The average median sales price for a home in the U.S. was $405,300 in the fourth quarter of 2025, according to data from the Federal Reserve Bank of St. Louis. Prices are about 2% lower than they were compared to the same time last year, according to Realtor.com.

“This market may be easier for some buyers, but it’s really going to depend on that real estate thing of location, location, location,” Kate Wood, a lending expert at NerdWallet, told CBS News.

    Inventory loosening up

One sign the housing market is loosening is an increasing ratio of sellers to buyers. Sellers now outnumber buyers by about 600,000, up from 444,000 in January of 2025, according to a February report from Redfin.

An increase in the number of properties for sale gives house-hunters more options to choose from, as well as some leverage when it comes to negotiating.

Still, experts note that inventory remains tight, with years of underbuilding leaving a shortage of affordable homes. The U.S. has roughly 15% fewer homes for sale today than in 2019, according to Housing Wire.

That comes as the number of new listings slows and houses sit on the market for longer. In February, new listings decreased 6.1% from a year ago, Redfin data shows.

“Inventory is improving, but it’s generally going from worse to bad,” Wood told CBS News.

Joel Berner, a senior economist at Realtor.com, said inventory is most limited in the Midwest and Northeast, regions that still haven’t fully recovered from the post-pandemic buying frenzy. Properties are more widely available in the South and West.

“What’s happening is the inventory is actually higher [in those regions] than it was pre-pandemic levels, and so there are a lot of options there, and prices are falling,” Berner said.

Cities that experienced the largest growth in new inventory last month include San Jose, California; Seattle, Washington; and Portland, Oregon, according to Redfin.

Jason Waugh, president of Coldwell Banker, said he expects the combination of lower interest rates and stabilizing inventory to contribute to modest sales growth and a more affordable market.

“My opinion has always been [buy] when you can afford to,” he said. “It doesn’t really matter the time of year, seasonality or overall market conditions.”

WASHINGTON, March 6 (Reuters) – U.S. President Donald Trump is expected to forge ahead with his aggressive immigration crackdown driven by top aide Stephen Miller and a new homeland secretary nominee who shares Trump’s hardline view, current and former U.S. officials and lawmakers said.

The Republican president fired Homeland Security Secretary Kristi Noem on Thursday after months of controversy over heavy-handed immigration enforcement tactics ‌and lawmaker questions about government contracts and turmoil within her department.

But Miller – the White House deputy chief of staff and the architect of Trump’s immigration agenda – retains control of the issue, three U.S. officials said. And Trump’s pick to become homeland secretary, U.S. Senator Markwayne Mullin of Oklahoma, is viewed as closely aligned with Trump’s approach.

“Stephen is a survivor,” one of the officials said, requesting anonymity to discuss internal dynamics. The official said Noem’s firing was not a referendum on Trump’s restrictive agenda, but rather on the execution of it.

In response to a request for comment, a White House official said Miller helps coordinate a wide range of issues – from immigration to counter-cartel operations – and is “working to ensure the President’s policy agenda is implemented.”

The Department of Homeland Security and Mullin’s office did not respond to requests for comment.

Trump won back the White House in 2024 with a campaign that heavily focused on stopping illegal immigration and ramping up deportations. Immigration was one of Trump’s best-polling issues after returning to office – and a key focus for the Republican Party broadly. But amid backlash over his aggressive enforcement in U.S. cities, support for his immigration approach declined in recent months, Reuters/Ipsos polls show.

Republicans currently hold narrow majorities in both chambers of the U.S. Congress but are heading into midterm elections in November that threaten their control on Washington.

White House spokesperson Karoline Leavitt said on Thursday in an X post related to Noem’s dismissal that Trump’s immigration goals remained unchanged.

“President Trump’s immigration agenda is keeping our border secure and deporting illegal alien criminals from our country, and it will continue without interruption,” she said.

Under Noem’s leadership, DHS sent thousands of federal immigration agents to Los Angeles, Chicago, Minneapolis and other Democratic-led cities to seek out immigration offenders, sweeping through residential neighborhoods and chasing day laborers in Home Depot parking lots.

But after federal agents shot and killed two U.S. citizens in Minneapolis – Renee Good and Alex Pretti – the administration said it would move to a less public-facing “targeted” approach to immigration arrests.

Current and former federal immigration officials said there had been no immediate policy shift since Noem’s departure was announced, but several said they expected the administration to continue to avoid ‌high-profile surges into U.S. cities following the fallout in Minneapolis.

MULLIN SEEN AS TOUGH ON BORDER SECURITY

Mullin, 48, became a senator in 2023 after a decade in the U.S. House of Representatives. Like Noem, he is a rancher and owns a cattle ranch in Oklahoma that also serves as a wedding venue, among other businesses.

Even as a freshman, Mullin has stood out from the crowd of 100 senators, at times presiding over the Senate wearing a large, light-colored cowboy hat.

He had a short-lived career as a mixed martial arts fighter and garnered widespread media attention in 2023 when he rose from his chair during a Senate hearing to challenge Teamsters President Sean O’Brien to “stand your butt up” and fight.

Mullin voted for a Republican-backed funding package last year that devoted a historic $170 billion to immigration enforcement through September 2029 and backs core elements of Trump’s immigration platform.

Republican lawmakers praised Mullin after the news that Trump would nominate him for DHS secretary, a position that requires majority confirmation in the Senate.

“He’s strong on the border and that’s what we need,” Republican Senator Eric Schmitt of Missouri told reporters on Thursday. “The deportations will continue.”

Noem was sharply criticized by both Democrats and Republicans for swiftly saying Good and Pretti were engaged in “domestic terrorism” after they were killed and before a full investigation.

Mullin similarly portrayed Pretti as a threat despite video evidence that undercut that claim. He said Pretti was “a deranged individual” who had a loaded pistol and intended “to cause max damage,” during an interview with Fox News on January 24, the day Pretti was killed.

Democrats on Capitol Hill welcomed Noem’s removal but said the Trump administration’s approach to immigration enforcement still needed to change. Democrats have blocked funding for DHS since mid-February in a push to force the White House to moderate its tactics.

Senator Chris Murphy, a Democrat from Connecticut, said funding talks are being run out of the White House and that he does not expect Noem’s firing to break the stalemate.

“I think we’re better off without her, but she wasn’t running the department,” Murphy said on Thursday. “Stephen Miller runs that department and will continue to run the department so I don’t really think much will change.”

War with Iran fuels mounting concern for safety of Americans jailed in the country

    March 6, 2026 / 4:48 PM EST / CBS News

Advocates for at least four American nationals who were jailed in Iran before the U.S.-Israeli strikes started are growing increasingly concerned about their safety, as intense bombing continues across the country.

Two of those U.S. nationals have been named publicly: 49-year-old Journalist Abdolreza “Reza” Valizadeh, whom the U.S. State Department formally designated as “wrongfully detained” by Iran in May 2025, and 61-year-old Kamran Hekmati, who was arrested in July 2025 while visiting family in Iran.

Both were being held in Tehran’s notorious Evin Prison before the war started. There has been no confirmed information on their whereabouts or condition since then.

Nonprofit groups say they are tracking at least two other U.S. nationals believed to be detained in Iran, whose identities CBS News cannot confirm.

“Evin Prison, we know, has been a military target by the Israeli government before in the past. During the 12-day war [between Israel and Iran in June 2025], it was actually bombed. So we have this risk of Evin Prison being hit in some kind of kinetic military strike,” said Kieran Ramsey, a retired FBI assistant director and chief investigative officer at the Global Reach organization, which works to bring home Americans wrongfully held abroad.

“Then we have the risk of reprisals by other prisoners and by guards at the prison, because Kamran is American. He’s also Jewish. So our concerns continue to escalate as every day goes by,” Ramsey told CBS News.

“The IDF, the Israeli Defense Force, had put the neighborhood of Evin Prison on notice that residents should depart to avoid air attack. So, obviously prisoners within Evin don’t have that same luxury,” Ryan Fayhee, a lawyer representing Valizadeh and a partner at the law firm Akin Gump, told CBS News. “It’s totally black for us. We aren’t able to communicate with Reza or his family in Tehran. And so it must be just, truly, he must be feeling very helpless right now.”

CBS News spoke to Joe Bennett, the son of British prisoners Lindsay and Craig Foreman, who were also being held at Evin Prison. Bennett is able to have daily phone calls with his mother, who, earlier this week, reported explosions so close to the prison that windows were blown out. As of Friday, she remained at the prison and able to make her daily calls.

Who are Reza Valizadeh and Kamran Hekmati?

Valizadeh became a U.S. citizen in 2022 after working for the U.S. government-funded broadcaster Radio Farda, the Persian branch of Radio Free Europe/Radio Liberty.

He believed he had received assurances that it was safe for him to return to Iran, where most of his family lives, but days after arriving in Tehran in 2024 for a visit, he was detained by the Islamic Revolutionary Guard Corps and taken to Evin Prison.

Reza Valizadeh is seen in an undated photo provided by his family. Valizadeh Family via AP

He spent weeks under intense interrogation and in isolation, and Iranian officials did not publicly acknowledge his arrest for almost two months. In December 2024, Valizadeh was sentenced to 10 years in prison after being charged with “collaborating with a hostile government,” according to a petition filed in January by his attorney with the United Nations Working Group on Arbitrary Detention.

Since then, his family says Valizadeh, who has asthma, has suffered from coughing fits and been denied medications.

“As somebody who’s represented Americans wrongfully detained in the past, this is a very, highly unusual situation where our ability to advocate for Reza obviously is muted right now with the military strikes,” Fayhee told CBS News. “It’s difficult to imagine what a lawyer can do for Reza, other than to ask the U.S. and the Israelis to exercise extreme caution in the area around Evin Prison. And Reza is not the only American citizen within the walls of Evin.”

Hekmati, who lives in Long Island and runs a jewelry business in New York City, immigrated to the U.S. from Iran after the Iranian Revolution in 1979, his advocates from the nonprofit Global Reach, which works to secure the release of Americans wrongfully held abroad, say.

He had traveled to Iran a number of times because of an urgent family matter, but was prevented from leaving in May last year and eventually arrested in July. He was then charged under a law that prohibits Iranian citizens from visiting Israel within a decade of entering Iran, his advocates say, though they say he hadn’t been to Israel for 13 years. He was later sentenced on an additional charge of meeting with agents of Israel’s Mossad intelligence agency.

    Iran’s history of wrongful detentions

The day before the U.S. and Israel launched their strikes on Iran, Secretary of State Marco Rubio designated Iran as the first ever State Sponsor of Wrongful Detention. The designation was created last fall, after President Trump issued an Executive Order to Protect U.S. Nationals from Wrongful Detention Abroad.

“When the Iranian regime seized power 47 years ago, Ayatollah Khomeini consolidated his control of power by endorsing the hostage taking of U.S. embassy staff,” Rubio said in a statement at the time. “For decades, Iran has continued to cruelly detain innocent Americans, as well as citizens of other nations, to use as political leverage against other states. This abhorrent practice must end.”

Valideza’s lawyer says U.S. special envoy Steve Witkoff and President Trump’s son-in-law Jared Kushner went into the most recent negotiations with Iran, before the war started, with Valideza’s name on a list.

“The military strikes have interrupted what I hoped was a conversation about Reza. I will say this: If the Iranians are looking for an off-ramp … that’s to release American citizens that are being held, including Reza, including Kamran Hekmati,” Fayhee said.

Ramsay, the retired FBI assistant director, also suggested the American prisoners could present a potential diplomatic solution for the conflict.

“We hear a lot of different reasons as to why this war has started and what the end goals are. Things like no more enrichment of nuclear material, no more ballistic missiles, no use of proxies. We want a fourth thing added to that, and that is Iran ceases and desists all hostage diplomacy,” Ramsay told CBS News.

Ramsay said there also could be other options to get the detainees home.

“I have 30-plus years in the federal government behind me, and had you asked me … maybe last year or the year before, was things like a rescue operation possible for this? And I would have told you no. But when we look at what this administration did in Venezuela with Maduro, I would say everything’s on the table.”

A State Department spokesperson told CBS News on Friday that it was aware of reports of Americans detained in Iran prior to February 27, and that it seeks to provide consular support. The spokesperson said Iran should immediately release all Americans detained in the country.

“President Trump has been clear that he wants every American wrongfully detained to be returned home safe and sound, and that there will be dire consequences for regimes who treat Americans as political pawns,” White House Deputy Press Secretary Anna Kelly said in a statement to CBS News on Friday.

Virginia Gov. Abigail Spanberger hit back at Secretary of War Pete Hegseth after the Pentagon announced it would cut ties and funding relationships with numerous collegiate institutions over what it described as woke ideologies.

A Pentagon leadership memo initialed “PBH” — the secretary’s full name is Peter Brian Hegseth — sent just before the U.S. bombed Iran and entitled “Aligning senior service college opportunities with American values,” laid out an examination of standing “Professional Military Education institutions, [the] bedrock upon which we build lethal warfighters grounded in the founding principles that underpin American

Spanberger fired back after it was reported that the College of William & Mary in Williamsburg, Va., would be affected. The Norfolk Virginian-Pilot covered her remarks at a high school in Hampton — about halfway between the two cities.

Spanberger said the move is an “outrageous attack at yet another point of pride in Virginia,” as the memo said the Senior Service College programs there would be ended and that servicemembers would lose support.

“The idea that the Pentagon would pull back from this fellowship program that has been long a fixture at William & Mary is just outrageous,” she said, according to the paper.

The Pentagon memo said the department will “no longer invest in institutions that fail to sharpen our leaders’ warfighting capabilities or that undermine the very values they swore to defend,” and that more than a dozen schools faced termination.

Spanberger, who formerly worked for the CIA, said the move speaks to the Defense Department’s “lack of understanding of the real strength of universities, whether it’s William & Mary or others, in educating the next generation of military leadership,” according to the paper.

She also cited the fact William & Mary’s current chancellor is himself one of Hegseth’s predecessors.

Robert Gates was former President George H.W. Bush’s director of central intelligence and later served as Secretary of Defense under President George W. Bush, remaining in the role into former President Barack Obama’s term.

Fox News Digital reached out to the Pentagon for comment.

In a statement obtained by Hampton Roads’ CBS affiliate, the college administration said it was “puzzled and saddened” by Hegseth’s move, saying that William & Mary is “among the country’s most military-friendly institutions” and also embraces its ROTC program.

While the Williamsburg school may be on the chopping block, the affiliate reported that Regent University in Virginia Beach — founded by Christian evangelist Pat Robertson — may be considered one of the replacement institutions.

In the memo, Harvard, Washington University in St. Louis, MIT, Tufts, Georgetown, George Washington University, Princeton, Yale, Brown and Queen’s University in Canada were listed as schools facing separation.

Colleges being considered as replacements include Liberty University in Lynchburg, Va., The Citadel, Virginia Tech, the University of North Carolina, Clemson University and Hillsdale College in Michigan.

A Pakistani man convicted on Friday of plotting to assassinate President Donald Trump and other politicians told an FBI agent he thought Iran “was responsible” for the assassination attempt on Trump in Butler, Pennsylvania.

Asif Merchant, 47, told the FBI agent, Jacqueline Smith, that the incident “was the same thing he was sent here to do,” Smith testified during Merchant’s trial. Merchant told jurors the Islamic Revolutionary Guard Corps (IRGC) sent him on a “mission” to kill U.S. politicians, including by telling him to attend a Republican rally.

Merchant was arrested July 12, 2024, one day prior to the shooting in Butler, where Thomas Crooks fired several shots into a rally crowd, killing one and grazing Trump’s ear.

The FBI has said repeatedly that it found no evidence that Crooks had co-conspirators or that any foreign actors were involved in the incident.

Merchant, who was convicted by a jury of murder-for-hire and attempt to commit terrorism, testified that Trump was not his only target, telling jurors then-President Joe Biden and former presidential candidate Nikki Haley were also on his list. He claimed that he only took part in the plot because Iran’s IRGC warned it would target his family.

“I had no other options,” Merchant said. “My family was threatened.”

Merchant now faces a maximum penalty of life in prison. His sentence will be determined at a later hearing.

Merchant was arrested after he was recorded on camera outlining a plot on a napkin to kill a politician with a person who turned out to be an FBI informant. Federal prosecutors showed video during the trial of Merchant speaking to the informant. The prosecutors said Merchant also tried to hire two hit men and pay them $5,000, but the men turned out to be federal agents posing as assassins.

Smith, the FBI agent who met with Merchant after his arrest, said that Merchant never conveyed that he feared for his family. Merchant said he wanted to do intelligence work and be paid for it, Smith said.

The FBI agent also said Merchant was told by an Iranian handler to attend a Republican political rally to scope out security but that Merchant was worried about being identified, and so he watched the rally online instead.

Merchant’s defense team told jurors their client, who has two wives, was a family man and cared deeply about his faith and that he intentionally acted carelessly because he wanted to be caught.

In their closing arguments, defense lawyers said Merchant had his hand forced in the operation, thinking his family would be harmed if he did not cooperate. Additionally, the lawyers cited several instances where they said Merchant’s actions as an intelligence operator were little more than incompetent.

The legislation, if enacted, would direct the U.S. Treasury Department to monitor the tax suspension in a bid to ensure that the savings are passed on to consumers as lower gasoline prices.

“Suspending the federal gas tax would help bring prices down and give families some much needed ‌relief,” Kelly said.

The White House did not immediately respond to a request for comment.

Trump told Reuters in an interview on Thursday that he is not concerned about rising U.S. gasoline prices linked to the conflict, saying “if they rise, they rise.”

Reuters reported this week that the Trump administration is considering actions aimed at combating rising energy prices in light of the war, as U.S. officials race to blunt the political and economic impact of rising fuel costs.

U.S. crude futures have jumped 35% since the war with Iran started on February 28, as the spreading conflict disrupts Middle East supplies.

In 2022, then-President Joe Biden called for a three-month suspension of the federal gasoline tax to combat record prices related to the COVID pandemic, but Congress never acted. Five states including Georgia, New York and Florida temporarily suspended state gas taxes in 2022.

Federal judge appears skeptical of recent Pentagon policy restricting journalists’ activities

    Updated on: March 6, 2026 / 5:41 PM EST / CBS News

A federal judge sharply questioned the government on Friday about a new Pentagon policy that places strict controls over what journalists can report if they wish to be allowed to continue working from inside the building.

In a tense exchange, U.S. District Judge Paul L. Friedman for the District of Columbia said he has lived through many military and national security conflicts, from the Vietnam War to the Sept. 11 attacks, and noted that the press played a vital role in all of those events in helping the American public understand what its government was doing.

Regarding the Vietnam War, he said that “the public, I think it’s fair to say, was lied to about a lot of things,” and added, “A lot of things need to be held tightly and securely, but openness and transparency allow members of the public to know what their government is doing.”

The New York Times sued the Pentagon late last year after it ordered all of the credentialed journalists who worked inside the building to sign a lengthy set of restrictions on their news gathering activities. Violating the policy could lead to the revocation of their press passes by the Pentagon. Most of the press outlets who worked in the building refused to sign the new policy and were forced to vacate.

CBS News is among an array of media organizations — including Newsmax, The New York Times, The Washington Post, NewsNation, The Hill and Fox News, which previously employed Defense Secretary Pete Hegseth as an on-air host — that declined to sign the new Pentagon restrictions.

After the departure of news organizations that would not agree to the Defense Department’s restrictions, the outlets inside the Pentagon were limited to right-wing news sites and bloggers who did agree to its conditions. Since the U.S. military operation against Iran began last week, some — but not all — reporters have returned to the Pentagon with visitors’ passes and have been allowed to attend briefings by Hegseth and Joint Chiefs of Staff Chairman Gen. Dan Caine.

At Friday’s hearing, lawyers for the press asked the court to block the Pentagon from enforcing the new policy, arguing it is a violation of the First Amendment freedom of the press.

“The press has always been in the building as soon as it opened,” said David Schulz, a lawyer for the Pentagon Press Association who was among a team of attorneys arguing on the media’s behalf on Friday.

During questioning by the government, Judge Friedman bristled when a Justice Department attorney appeared to suggest it could be a crime if journalists ask questions that solicit the disclosure of sensitive national defense information.

“Asking a question is not criminal,” Friedman said. “All you have to say is I can’t answer that question for national security reasons.”

Michael Bruns, the Justice Department attorney, acknowledged that asking questions itself is not a crime, but if those questions led to the disclosure of unauthorized classified information, then the Pentagon could take that into account when determining whether a journalist could pose a security risk and should have a press pass revoked, he argued.

Friedman also sharply questioned why the Pentagon took issue with a tip line set up by the Washington Post, but had no concerns when far-right influencer Laura Loomer also promoted a tip line and is currently among the few outlets who signed the Pentagon’s policy so she could report from inside the building.

“Is the Washington Post tip line criminal solicitation?” Friedman asked.

“I don’t think so, your honor,” Bruns said.

“You’re not clear whether the Washington Post tip line constitutes criminal solicitation?” Friedman asked again.

    “No, your honor,” Bruns said.

“So, if you’re not clear, how can they be clear?” Friedman retorted.

Bruns told Friedman that the Washington Post tip line was problematic because it targeted military members while Loomer’s is more general in nature.

Friedman asked both sides to respond by Monday with suggestions for how he should structure an order before he makes a final ruling.
