Justice Department’s antitrust chief has been fired, sources say

Gail Slater, who ran the antitrust division for the Justice Department for nearly a year, was forced out by the Trump administration this week, two people familiar with the matter told CNN.

Slater, who suggested in a post on X Thursday she was leaving on her own, had been at odds with Attorney General Pam Bondi and the West Wing for months, the sources said. Her ouster as the antitrust chief was viewed as a long time coming, and it remains to be seen who fills her role on a permanent basis.

Bondi issued tepid praise of Slater in a statement Thursday.

“On behalf of the Department of Justice, we thank Gail Slater for her service to the Antitrust Division which works to protect consumers, promote affordability, and expand economic opportunity,” the attorney general said.

As its name suggests, the Justice Department’s anti-trust division enforces US antitrust laws, pursuing civil or criminal cases against companies with an eye on promoting competition. In recent years, it has pursued cases against Apple and Google, and inside the department, Slater was known to be pushing the administration to be aggressive on tech companies, whose leaders often have the ear of Trump.

Sen. Elizabeth Warren said in a statement that the ouster “looks like corruption.”

“A small army of MAGA-aligned lawyers and lobbyists have been trying to sell off merger approvals that will increase prices and harm innovation to the highest bidder,” the Massachusetts Democratic said. “Every antitrust case in front of the Trump Justice Department now reeks of double-dealing — Ticketmaster’s stock is already surging. Congress has a responsibility to unearth exactly what happened and hold the Trump administration accountable.”

The friction between Slater and President Donald Trump’s White House had been clear for months. In December, Trump issued a “full and unconditional pardon” for Oak View Group co-founder Tim Leiweke, who was indicted by his own Justice Department — in a case led by Slater — earlier in 2025.

“As outlined in the indictment, the Defendant rigged a bidding process to benefit his own company and deprived a public university and taxpayers of the benefits of competitive bidding,” Slater said in a statement at the time.

Slater said in her Thursday post on X: “It is with great sadness and abiding hope that I leave my role as AAG for Antitrust today. It was indeed the honor of a lifetime to serve in this role.”

The anti-trust division is expected to play a critical role in assessing Netflix’s Warner Brothers Discovery’s deal to sell the Warner Bros. studio and HBO to Netflix, which Paramount is trying to stop by appealing straight to shareholders with its own bid. (CNN is owned by Warner Brothers Discovery.)

In an NBC interview last week, Trump said, “I’ve decided I shouldn’t be involved. The Justice Department will handle it.” But Paramount CEO David Ellison returned to the White House last week to meet privately with Trump, two sources familiar with the matter told CNN.

This is a developing story and will be updated.

Heather Diehl / Getty Images

Judge blocks Pentagon from downgrading Sen. Mark Kelly’s military rank, pay

    February 12, 2026 / 1:10 PM EST / CBS News

A federal judge on Thursday blocked the Pentagon from downgrading the military retirement rank and pay of Democratic Sen. Mark Kelly of Arizona, finding that the government had “trampled on Senator Kelly’s First Amendment freedoms.”

A retired Navy captain, Kelly drew the Trump administration’s ire after he and five other Democratic lawmakers posted a video urging members of the military to “refuse illegal orders.”

U.S. District Judge Richard Leon’s order prohibits the Defense Department and the Trump administration from taking any adverse action against Kelly to reduce his retirement rank and pay.

“This Court has all it needs to conclude that Defendants have trampled on Senator Kelly’s First Amendment freedoms and threatened the constitutional liberties of millions of military retirees,” Leon wrote. “After all, as Bob Dylan famously said, ‘You don’t need a weatherman to know which way the wind blows.’”

Leon’s ruling comes a month after Kelly sued Defense Secretary Pete Hegseth, arguing that he was the target of “extreme rhetoric and punitive retribution” by the Trump administration.

Kelly asked Leon to set aside Hegseth’s recent moves to demote him and cut his military pension, and to block the enforcement of any punishment against him.

Sen. Mark Kelly outside court in Washington on Feb. 3, 2026. Heather Diehl / Getty Images

Leon’s decision came two days after federal prosecutors in U.S. Attorney Jeanine Pirro’s office failed to secure an indictment against Kelly and the other Democratic lawmakers who appeared in the video. Prosecutors had hoped to charge them with violating a federal law that makes it a crime to counsel or cause “insubordination, disloyalty, mutiny, or reversal of duty” by military members, sources previously told CBS News.

Kelly and his colleagues came under fierce criticism by the Trump administration after they posted the video in November. The video was published amid the military buildup around Venezuela and strikes against alleged drug boats. The other five Democrats were also either military veterans or members of the intelligence community, but they have not faced any adverse action from the Defense Department because they do not draw retirement pay from the U.S. military.

Soon after the video was published, President Trump and Hegseth lambasted the lawmakers for the comments, with the president claiming that their statements amounted to “SEDITIOUS BEHAVIOR, punishable by DEATH!”

Hegseth claimed Kelly’s statements “undermined the chain of command” and constituted “conduct unbecoming an officer.” The Pentagon announced it was conducting a review of misconduct allegations against Kelly to determine whether he should be recalled to active duty to face court-martial proceedings.

The Defense Department said in December it was escalating its review into a command investigation. Hegseth then announced that the Pentagon had “initiated retirement grade determination proceedings” that could result in a “reduction in his retired grade” and “a corresponding reduction in retired pay.” Hegseth also said he issued a formal letter to censure Kelly, citing his “reckless misconduct.”

In a statement, Kelly said Leon’s order “made clear that Pete Hegseth violated the constitution when he tried to punish me for something I said. But this case was never just about me. This administration was sending a message to millions of retired veterans that they too can be censured or demoted just for speaking out. That’s why I couldn’t let it stand.”

“I also know that this might not be over yet, because this President and this administration do not know how to admit when they’re wrong,” Kelly continued. “One thing is for sure: however hard the Trump administration may fight to punish me and silence others, I will fight ten times harder. This is too important.”

CBS News has reached out to the Defense Department and Justice Department for comment.

At a recent court hearing, Leon grilled the Justice Department and expressed strong reservations about the Pentagon’s efforts. Active-duty military officers typically face limitations on their right to free speech to promote discipline and obedience, but the military is now seeking to extend those limits to retired service members like Kelly.

“That’s never been done,” Leon told Justice Department attorney John Bailey during the Feb. 3 hearing, adding that the government did not have a single case to support the argument.

“You’re asking me to do something that the Supreme Court has never done,” Leon said. “That’s a bit of a stretch, is it not?”

In his ruling on Thursday, Leon reiterated those concerns again.

“Secretary Hegseth relies on the well-established doctrine that military
servicemembers enjoy less vigorous First Amendment protections given the fundamental obligation for obedience and discipline in the armed forces,” Leon wrote.

“Unfortunately for Secretary Hegseth, no court has ever extended those principles to retired servicemembers, much less a retired servicemember serving in Congress and exercising oversight responsibility over the military. This Court will not be the first to do so!”

US military forces have departed a strategic military garrison in Syria after more than a decade “as part of a deliberate and conditions-based transition” to a smaller US footprint in the country, US Central Command said on Thursday.

The US troops at al-Tanf garrison had primarily been focused on anti-ISIS efforts as part of Combined Joint Task Force-Operation Inherent Resolve. The Pentagon announced in April 2025 that it would begin consolidating its presence in Syria following the territorial defeat of ISIS in 2019.

“U.S. forces remain poised to respond to any ISIS threats that arise in the region as we support partner-led efforts to prevent the terrorist network’s resurgence,” CENTCOM Commander Adm. Brad Cooper said in a statement. “Maintaining pressure on ISIS is essential to protecting the U.S.
    homeland and strengthening regional security.”

Syria’s defense ministry said in a statement on Thursday that its army has now taken control of al-Tanf in coordination with the United States.

US officials have heavily invested in supporting Syria’s new president, Ahmed Al-Sharaa, as his government has worked to secure control over Syria following its successful effort to overthrow Bashar al-Assad in December 2024. Al-Sharaa previously led a US-designated terrorist group and until recently had a $10 million US bounty on his head but has attempted to transition what had been a hodgepodge resistance force into a governing authority in the country.

An ISIS ambush in Palmyra in December killed two Iowa Army National Guard soldiers and an American interpreter. Following the attack US officials pledged a continued focus on targeting ISIS in the region, and as recently as last week CENTCOM forces “located and destroyed an ISIS communication site, critical logistics node, and weapons storage facilities with 50 precision munitions delivered by fixed-wing, rotary-wing, and unmanned aircraft,” according to a statement.

Syria’s military forces are currently made up of an array of fighters from different backgrounds and with varying extremist views and affiliations, CNN has reported. But the Trump administration has made clear that it backs Al-Sharaa as Syria’s new leader, painting his extremist ties as a thing of the past and emphasizing his partnership in targeting ISIS in the region.

In November, Al-Sharaa became the first Syrian head of state to visit the White House. “He’s a very strong leader,” President Donald Trump told reporters at the time, calling Al-Sharaa “a tough guy from a tough place.” The visit came after the US partially lifted sanctions on Syria, marking a major shift in relations between the two countries.

Judge says Pete Hegseth is unlawfully retaliating against Sen. Mark Kelly over ‘illegal orders’ video

A federal judge on Thursday shut down Defense Secretary Pete Hegseth’s attempts to punish Democratic Sen. Mark Kelly over his urging of US service members to refuse illegal orders, ruling that the Pentagon chief’s actions were unconstitutionally retaliatory.

The decision landed two days after a grand jury in Washington, DC, declined to approve charges sought by federal prosecutors against the Arizona senator and several other Democratic lawmakers who taped a video last year warning that “threats to our Constitution” are coming “from right here at home,” and repeatedly implored service members and the intelligence community to “refuse illegal orders.”

Together, the grand jury declination and ruling from senior US District Judge Richard Leon represent major impediments to efforts by aides of President Donald Trump to use the levers of government to punish Kelly, a retired Navy captain and former astronaut, over his participation in the video.

Leon, an appointee of former President George W. Bush, wrote in a scathing, 29-page ruling that Hegseth was trampling over the First Amendment rights of Kelly and that his moves are an impermissible form of government retaliation.

“That Senator Kelly may be an ‘unusually staunch individual’ does not minimize his entitlement to be free from reprisal for exercising his First Amendment rights,” Leon wrote. “Senator Kelly was reprimanded for exercising his First Amendment right to speak on matters of public concern.”

The Pentagon, the judge wrote, was targeting “unquestionably protected speech” that is actually entitled to “special protection” under the law.

The decision is likely to be appealed by the Justice Department, which insists that Hegseth’s actions are unreviewable by federal courts or, at the very least, owed a great deal of deference by judges examining disputes like the one at hand.

Applauding Leon’s ruling Thursday, Kelly acknowledged in a statement that “this might not be over yet, because this President and this administration do not know how to admit when they’re wrong.”

“One thing is for sure: however hard the Trump administration may fight to punish me and silence others, I will fight ten times harder. This is too important,” the senator said.

Kelly’s case, brought last month, came just after Hegseth announced the Pentagon would pursue administrative action against the senator, including reducing his last military rank, which would lower the pay he receives as a retired Navy captain, and issuing a letter of censure.

Both Hegseth and Trump have publicly attacked Kelly over a video posted in November by the Arizona lawmaker – and five other Democrats with a history of military or intelligence service – urging service members not to obey unlawful orders that could be issued by the Trump administration.

“When viewed in totality, your pattern of conduct demonstrates specific intent to counsel servicemembers to refuse lawful orders. This pattern demonstrates that you were not providing abstract legal education about the duty to refuse patently illegal orders. You were specifically counseling servicemembers to refuse particular operations that you have characterized as illegal,” Hegseth wrote to Kelly last month in the censure letter.

Leon forcefully rejected Hegseth’s attempt to extend existing loopholes on First Amendment protections for active-duty service members to retirees such as Kelly, imploring the administration to “be grateful for the wisdom and expertise that retired servicemembers have brought to public discussions and debate on military matters in our Nation over the past 250 years.”

Citing a friend-of-the-court brief filed by former high-ranking military officials who warned that many service members are already declining to opine on matters of public importance out of fear of also being retaliated against, Leon called that reality “a troubling development in a free country!”

“Defendants’ argument runs up against our Nation’s long tradition of retired service members, including those holding elected office, routinely contributing to the public discourse in ways critical of current military policy,” he wrote.

    Retribution campaign hits roadblocks

Leon is the latest federal judge to frustrate Trump’s efforts to go after his perceived political enemies. In several other cases, judges have stymied the president’s retribution crusade by killing criminal cases brought against former FBI Director James Comey and New York Attorney General Letitia James and ruling against the president’s attempts to hamstring the work of Mark Zaid, a notable whistleblower attorney.

In the “illegal orders” video released in November, the lawmakers don’t specify which orders service members have received, or might receive, that could be illegal.

But it was posted as US military officials, including the commander of US Southern Command, and US allies, including the UK, questioned the legality of a series of military strikes targeting suspected drug traffickers in the Caribbean and eastern Pacific and as the Trump administration faced multiple court challenges to Trump’s decision last year to send scores of federalized state National Guard members to Democratic-led cities.

The video enraged Trump, who suggested the six lawmakers engaged in “SEDITIOUS BEHAVIOR, punishable by DEATH!”

Prosecutors from the US Attorney’s Office in DC reportedly pursued less serious charges when they presented their case to the grand jury on Tuesday.

Though it’s generally rare for grand juries to decline to approve charges sought by prosecutors, such rejections have occurred more frequently in recent months as the administration has pursued legally dubious cases. Prosecutors can try again to secure the indictments against the lawmakers.

FTC warns Apple’s Tim Cook over alleged political bias in its Apple News app

    February 12, 2026 / 1:48 PM EST / CBS News

The Federal Trade Commission on Thursday sent a warning letter to Apple CEO Tim Cook about Apple News, pointing to reports claiming the news aggregator “systematically boosts left-wing sources and suppresses right-wing sources.”

FTC Chairman Andrew Ferguson alerted the tech giant’s chief executive that, if the allegations are true, the company could be violating the FTC Act, a law that prohibits unfair or deceptive acts or practices. The Apple News app aggregates news stories from a range of digital publications to curate content tailored to consumers’ preferences.

Ferguson, who cited research from the Media Research Center, a right-leaning watchdog group, said that tech companies that feature news articles based on a publication’s “perceived ideological or political viewpoint” may violate the law. The FTC chief asked Apple to review its article curation and “take corrective action swiftly” if it is excluding conservative news sources.

Policies that exclude some news sources “stifle the free exchange of ideas, manipulate the public discourse and are inconsistent with American values,” Ferguson wrote.

Apple did not immediately respond to CBS News’ request for comment.

The FTC cited a report from the Media Research Center that analyzed more than 600 stories featured by Apple News in users’ feeds from Jan. 1 to Jan. 31. The analysis found that more than 400 of the stories Apple News featured came from outlets perceived to be left-leaning, and that news sources perceived to be right-leaning did not appear in users’ digital news feeds.

The Media Research Center says it relies on AllSides, a company that rates the perceived political bias of online publications, for determining a news source’s perspective.

1/1 Skip Ad Continue watching after the ad

Ferguson also argued that Apple may be violating its own terms and conditions of service if it doesn’t disclose to consumers practices that could “cause substantial injury that is neither reasonably avoidable nor outweighed by countervailing benefits to consumers or competition.”

Nevertheless, the FTC chief noted that the agency “is not the speech police.”

“[W]e do not have authority to require Apple or any other firm to take affirmative positions on any political issue, nor to curate news offerings consistent with one ideology or another,” Ferguson added.

But, he noted, the agency has a mandate from Congress to ensure that consumers are protected from “material misrepresentations and omissions, including when the product or service offered to consumers is a speech-related product.”
