    A federal judge in Georgia denied a motion by officials in Fulton County, Georgia, to return ballots and other materials from the 2020 election that were taken by the FBI in a court-authorized search earlier this year.

    U.S. District Judge Jean-Paul Boulee said Wednesday that attorneys representing Fulton County did not establish enough evidence to prove that the FBI affidavit at the center of the case was deficient in a way that had a “callous disregard” for the county’s rights.

    Boulee, however, said that the affidavit was “defective in some respects” by including misleading statements about the final ballot count in 2020 in the county, and that there were “troubling” omissions about ballot mechanisms in the documents.

    “While the Affidavit was certainly far from perfect, this is not a situation where an officer left out all the facts that might undermine probable cause or where an officer intentionally lied,” Boulee wrote, adding, “the Court cannot say that the Affidavit was so deficient that its shortcomings rise to the ‘high[] threshold’ of callous disregard.”

    Boulee’s decision comes more than two months after FBI agents executed a search warrant at a Fulton County elections office, seeking to take “all physical ballots” from 2020, as well as tapes from vote-tabulating machines, ballot images and voter rolls. Home to Atlanta, deep-blue Fulton County was crucial to former President Joe Biden’s narrow 2020 win in Georgia, and Mr. Trump and his allies have long alleged — without evidence — that the county was awash with fraud.

    In a 68-page ruling, Boulee acknowledged that “the seizure in this case was certainly not perfect,” and said “the events leading up to this case are, in a variety of ways, unprecedented.” But he wrote that he needs to apply the legal precedents around court-ordered seizures evenly.

    The judge rejected Fulton County’s argument that the FBI’s seizure of the ballots was a violation of the county’s 10th Amendment rights to administer elections. He also rejected an argument that the warrant was obtained “in bad faith” after the Justice Department faced pushback in a separate civil legal proceeding surrounding the documents.

    “Petitioners have not shown that their rights were callously disregarded either through supposed defects in the warrant or through the manner in which the warrant was executed,” Boulee wrote. He added that the county’s evidence of irreparable harm if the election materials are not returned was “unpersuasive.”

    Attorneys for Fulton County and spokespeople for the Justice Department did not immediately respond to requests for comment.

    Fulton County filed a lawsuit earlier this year asking for the seized materials to be returned and for an order instructing the government “to maintain, but not review, any copies of the seized materials until this matter is resolved.” It argued the search “callously disregards multiple Fourth Amendment rights” of the county and was a “gross intrusion” into the state’s role in elections.

    According to a controversial FBI affidavit at the center of the search, the bureau is investigating potential violations of two federal laws.

    One of those laws makes it a crime for elections officials to intimidate voters and to deprive them of a fair election by submitting fraudulent ballots or voter registration applications. The other law requires election officials to retain federal election records for 22 months.

    Abbe Lowell, an attorney representing the county, argued that the statute of limitations on both potential violations expired. Boulee, however, rejected that argument.

    While the election was more than five years ago, Boulee wrote, “the Court cannot ignore” witness testimony included in the affidavit that alleges ballot images in the county’s possession may have been modified as recently as 2024.

    At a contentious hearing in March, Lowell argued “there’s nothing” in an FBI affidavit backing the search warrant “to support that there’s an ongoing investigation that matters” in Fulton County. He did warn, however, that the ballots may be used “for some future crime that may not exist.”

    Lowell argued that “a number of things were omitted” from the affidavit at the heart of the search regarding the election and alleged misconduct by the county. A witness for Fulton County, elections expert Ryan Macias, testified that “information in the affidavit does not make sense.”

    Macias said there was “incoherent terminology” in the affidavit, and testified the agent and FBI “conflate certain things.” He told the court that the election “has already been looked at and investigated,” and the affidavit had just recycled debunked rumors from over six years ago.

    During the hearing, Boulee said of the Justice Department’s defense of the seizure of more than 630 boxes of election material, “that piece bothers me” a “rather considerable” amount.

    “How far does that affidavit have to go?” Boulee asked Justice Department attorney Tysen Duva, who led arguments for the federal government.

    Duva dismissed Lowell’s arguments as “woefully inadequate” and responded to Boulee’s questioning about flaws in the affidavit by saying, “this isn’t grading a paper.”

    “Are there places in the affidavit where the agent could have done better? Sure,” Duva said, adding he “may have missed a thing or two.”

    Duva also conceded the FBI’s seizure of the ballots may not lead to any charges.

    “If there is an indictment, that remains to be seen,” he said. “What may happen later? Maybe nothing.”

    State officials in Georgia, including the Republican governor and secretary of state, have defended the integrity of the 2020 election for years, noting that three separate counts confirmed that Biden defeated Mr. Trump in the state. The results in Georgia were at the center of Mr. Trump’s efforts to overturn the election, and Fulton County, which includes Atlanta, is a key Democratic stronghold.

    The affidavit said the current investigation originated from a referral sent by Kurt Olsen, whom the FBI describes as a “Presidentially appointed Director of Election Security and Integrity.” In 2020, Olsen was an attorney who worked with Texas Attorney General Ken Paxton to urge the Supreme Court to overturn the election results.

    The Justice Department revealed more details about the origins of its criminal investigation in a May 1 court filing, after Boulee partially granted a motion by Fulton County officials to compel further information from the Justice Department.

    The government told the court that Olsen formally referred the investigation to the FBI “no later than” Jan. 5, the FBI opened an “assessment” the next day and an FBI official in Atlanta approved a full investigation about a week later. An investigative summary was converted into a search warrant affidavit beginning on Jan. 22.

    Lowell said at the March hearing that one of the witnesses cited by the government in the affidavit has a criminal record. He also brought up two incidents of court sanctions against Olsen and argued about half of the witnesses would be categorized as “election deniers.”

    In 2022, Olsen was subpoenaed by the House Jan. 6 Committee, which was investigating the aftermath of the 2020 election and the Jan. 6, 2021, attack on the U.S. Capitol. The subpoena alleged that Olsen “contacted various high-level officials at the Department of Justice” at the president’s direction to discuss filing challenges to the election results. The committee said Olsen had multiple phone calls with Mr. Trump on Jan. 6, 2021.

    Separately, earlier this month Fulton County Board of Registration and Elections officials asked a federal judge in Georgia to quash a grand jury subpoena from the Justice Department that seeks information on thousands of people who helped run the 2020 election in the county.

    The subpoena, issued in April, was issued by federal prosecutors in the Middle District of North Carolina. It seeks personal information — including names, addresses and phone numbers — for election workers and volunteers who worked the 2020 election in the county, with jobs ranging from people who drove the voting units to election volunteers and ballot reviewers.

    New job postings show the high-dollar bonuses are being offered through the DOJ Civil Division components that handle immigration lawsuits and investigations into transgender medical treatments, two of President Donald Trump’s most contentious priorities, and highlight New York City, Raleigh, San Francisco and Dallas.

    The hiring push comes as the Civil Division, the DOJ’s most expansive division led by Brett Shumate, continues the resource-intensive task of defending White House policies in court as it faces hundreds of lawsuits, while also drawing scrutiny for employee departures and reported recruiting challenges.

    The new recruitment strategy puts a spotlight on the pressure DOJ is facing to sustain its aggressive legal defense strategy, particularly in blue cities and states that it has accused of undermining federal authority, while also combating narratives that the department is struggling to retain staff.

    A DOJ official told Fox News Digital the hiring effort is not reflective of any internal strain but rather a way for the department to “look broader by enticing attorneys around the country who may not have considered” working for a D.C.-based federal agency.

    “The department is expanding resources across the country to combat lawless jurisdictions and nationwide injunctions, and there is a need to attract candidates from those new areas,” the official said, touting that Trump’s signature One Big Beautiful Bill Act gave the DOJ “millions of dollars to hire more attorneys specifically for those efforts.”

    The offers come as blue states, civil rights groups and Democrats flood courts across the country with lawsuits challenging Trump’s efforts to shrink and unify the executive branch, crack down on illegal immigration, implement tariffs and tighten policies surrounding election security and transgender people and more. Lower court judges have often stymied the administration’s work.

    The DOJ has chosen on rare occasions to raise the adverse rulings on an emergency basis with the conservative-leaning Supreme Court and won some two dozen cases — which represents a vast majority of the cases — when taking that route.

    The Civil Division, which is in charge of defending the civil lawsuits against the administration, has also been offering incentives to current lawyers, according to Bloomberg Law. The outlet said the division was offering new biweekly bonuses up to $220 through Thanksgiving because lawyers “keep fleeing” and because the division was “growing more desperate to stave off further departures of valuable legal minds” who are uncomfortable with Trump’s priorities.

    The DOJ official addressed concerns about an employee exodus in a statement to Fox News Digital, after The Financial Times also reported that more than a quarter of its nearly 13,000 lawyers have quit or been fired since the beginning of last year.

    The official attributed the departures, in part, to employees taking a “fork in the road” resignation option, which the Trump administration rolled out last year with the stated goal of reducing the size of government.

    “This has allowed DOJ to run more efficiently and hire new employees who wholeheartedly believe in the work they’re doing,” the official told Fox News Digital.

    Assistant Attorney General Shumate told Fox News Digital in a statement he was “always looking for talented and qualified attorneys to advance President Trump’s priorities and protect the American people.”

    “The Civil Division will continue to hire hardworking patriots from across the country and offer appreciation bonuses to our loyal attorneys who remain committed to our mission and upholding the rule of law,” Shumate said.

    Acting Attorney General Todd Blanche denied to CBS News that the Justice Department is engaging in a retribution campaign against President Trump’s adversaries, pushing back on criticism from former President Barack Obama — but he argued Mr. Trump has vast power to oversee the agency.

    The Justice Department — which Blanche has led since last month after serving as second-in-command — has faced months of scrutiny for bringing criminal charges against Trump foes, including former FBI Director James Comey and New York Attorney General Letitia James. Critics also argue the department, which has historically maintained an arms-length relationship with the White House, is losing its traditional reputation as an apolitical agency.

    In an interview with CBS News in Phoenix Wednesday, Blanche called allegations that his department is leading a retribution campaign “simply false,” saying prosecutors are “doing our jobs” and “making America safe again.”

    He said the latest Comey indictment, which accused the former FBI director of threatening the 47th president by posting a photo of seashells arranged to form the numbers “86 47,” was just one of the thousands of cases brought by the Justice Department every year. He insisted the case was spearheaded by “local prosecutors” and “local agents.”

    “I don’t even know their names,” Blanche said of the North Carolina-based federal prosecutors.

    Obama joined the chorus of critics on Tuesday, telling late-night host Stephen Colbert that he’s concerned about “the politicization of our justice system” and the risk that “whoever is in charge of the government starts using that to go after their political enemies.” His remarks did not mention Mr. Trump personally but appeared to be directed at the president.

    “The White House shouldn’t be able to direct the attorney general to go around prosecuting whoever the president wants to prosecute,” Obama said.

    In response to the former president’s comments, Blanche pulled out a pocket-sized copy of the Constitution and flipped to the part that lays out how the executive branch works.

    “Article Two says, ‘the executive power shall be vested in the President of the United States of America.’ It does not say that the Attorney General stands off to the side,” Blanche said.

    He noted that he is a member of Mr. Trump’s Cabinet, and argued the president has the right to lead the country “in all areas,” including on criminal justice.

    “To the extent that President Trump calls me and says that he thinks that we have a problem in this country, whether it’s the scourge of drugs, illegal immigration,” he said, “every American wants him to do that, and he should.”

    Comey and James were first indicted last fall on charges of lying to Congress and bank fraud, respectively, but their cases were tossed out on the grounds that the interim U.S. attorney who led the prosecutions was invalidly appointed. Shortly before those charges were brought, Mr. Trump penned a Truth Social post urging Blanche’s predecessor, Attorney General Pam Bondi, to look into Comey, James and a third longtime Trump foil, Democratic Sen. Adam Schiff.

    Asked whether the president is calling him and directing him to prosecute certain individuals, Blanche said he would not discuss his conversations with Mr. Trump.

    “But rest assured, he has much better, bigger and important things to do than to worry about me doing my job,” said Blanche. “And I wake up with a very clean conscience every morning. We are absolutely doing nothing but what we should be doing at the Department of Justice.”

    Blanche also called allegations from Democrats that Mr. Trump is prosecuting his opponents “extraordinarily rich.” He pointed to the raft of criminal charges that Mr. Trump faced before returning to office last year, brought by state prosecutors in New York and Georgia and a federal special counsel. Blanche served as Mr. Trump’s defense attorney in some of those cases.

    “So I welcome criticism. Let’s go. But if you’re sitting in a glass house, you ought not throw stones,” he said.

    WASHINGTON, May 6 (Reuters) – U.S. ​Commerce Secretary Howard Lutnick told members of a congressional committee in private testimony on Wednesday that ‌he couldn’t recall why he and his family had lunch on Jeffrey Epstein’s private island, members said.

    Lutnick, the former chief executive of Cantor Fitzgerald, had lunch with the convicted sex offender for two hours on the island in 2012, contradicting a past public statement ​about cutting ties with Epstein years earlier.

    In a podcast last year, Lutnick said he vowed to “never be ​in a room” with Epstein after the financier invited Lutnick and his wife around 2005 ⁠to tour his townhome where Epstein made a sexually suggestive comment about a massage table he had set up. ​Lutnick and Epstein were next-door neighbors on Manhattan’s Upper East Side.

    “We asked him over and over again, ‘Why did you ​go to the island?’” said Representative Suhas Subramanyam, a Virginia Democrat. “He says he doesn’t remember, that it’s inexplicable and he simply didn’t know how to answer the question.”

    Representative James Comer, the Kentucky Republican who chairs the House Oversight and Government Reform Committee, said Lutnick ​was transparent in his voluntary testimony. Comer said Lutnick told the panel Epstein found out his family and friends ​were vacationing in the Virgin Islands and invited them all to lunch.

    “The only thing that I’d seen that Lutnick did wrong was [he] ‌wasn’t ⁠100% truthful on the brief visit to the island with his family. He corrected that in his opening statement,” Comer told reporters. “If we find that there were any misstatements by Lutnick, it’s a felony to lie to Congress and he’ll be held accountable.”

    A massive batch of files released by the Justice Department in January included emails showing Lutnick had ​apparently visited Epstein’s private island ​for lunch in 2012. ⁠The emails also showed Lutnick invited Epstein to a November 2015 fundraiser at his financial firm for Democratic presidential candidate Hillary Clinton.

    Lutnick told lawmakers at a February 10 hearing that ​he and Epstein had only exchanged about 10 emails and met three times over ​14 years. His ⁠family had lunch with Epstein on the island, Lutnick said, because they were on a boat nearby.

    “I did not have any relationship with him,” Lutnick said of Epstein at the time. “I barely had anything to do with that person.”

    Epstein pleaded ⁠guilty in ​2008 to state prostitution charges, including soliciting an underage girl. He ​was sentenced to 13 months in jail and arrested again in 2019 on federal charges of sex trafficking of minors. His death that year ​in a Manhattan jail cell was ruled a suicide.

    A federal judge said Wednesday he would not order the Justice Department to return ballots from the 2020 presidential election it seized from Fulton County, Georgia, rejecting a request by county officials.

    Judge JP Boulee said the county had not met the high legal bar that would allow him to intervene, even as he acknowledged that “events leading up to this case are, in a variety of ways, unprecedented.”

    The order comes months after the FBI searched a Fulton County elections office in January and seized election materials. That search was based on a warrant application that leaned on allegations of election fraud that have long circulated in far-right circles. The county quickly filed a lawsuit to retrieve the documents.

    The FBI has been probing what the DOJ has described as irregularities in how Fulton County carried out the 2020 election, which President Donald Trump has falsely claimed was rigged.

    Fulton County officials have proposed in court filings the criminal investigation appears to be a “pretext to acquire records that this Administration was unable to quickly secure via the civil litigation process.”

    But the Justice Department has argued that theory is “nonsensical for multiple reasons” and that the county had not met the high bar required for ordering the seized materials be returned.

    The FBI moved seized the election materials just a few weeks after opening a criminal probe, an unusually fast pace for a case of its kind, experts previously told CNN.

    Meanwhile, the Fulton County Board of Registration and Elections is trying to block the Justice Department from gaining access to the personal information of thousands of 2020 election workers.

    An apparent suicide note written in 2019 by the late convicted sex offender Jeffrey Epstein was released Wednesday.

    A U.S. district judge ordered the release of the document at the request of The New York Times.

    The note had been submitted to the court in May 2021 as part of the criminal murder case for Nicholas Tartaglione, a former cellmate of Epstein. Tartaglione has previously claimed that the note was written by Epstein after a failed suicide attempt less than a month before his death.

    Tartaglione claimed in a podcast interview that he found the note in a book the morning after Epstein’s death, and he gave it to his lawyers, who included it in his appeal. The note was not mentioned in Bureau of Prisons records.

    CBS News has not independently verified the note. CBS News has reached out to the FBI and Justice Department for comment.

    The scrawled note appears to read: “They investigated me for month — found nothing!!! So 15 year old charges resulted.”

    The note also includes the phrases “time to say goodbye” and “No fun — not worth it!!”

    CBS News previously reported that on July 23, 2019, 18 days before he died, Epstein claimed that he was attacked by Tartaglione in the cell they shared. However, former Attorney General Bill Barr later testified before the House Oversight Committee that the July 23 incident was “viewed as an attempted suicide.”

    In 2008, Epstein pleaded guilty in Florida to state charges of soliciting prostitution in exchange for having a federal case against him dropped. He served 13 months in county jail and had to register as a sex offender.

    Then, in July 2019, a New York federal grand jury indicted him on child sex trafficking charges. On Aug. 10, 2019, Epstein was found dead in his cell at the Metropolitan Correctional Center in New York. His death was ruled a suicide.

    Epstein’s connection to the rich and powerful has come under renewed scrutiny amid the recent release by the Justice Department of millions of documents related to the investigation, some of which showed his links to prominent figures.
