    Sen. Bill Hagerty, R-Tenn., filed a formal complaint against Verizon on Monday after the carrier handed over his phone data to the Biden-era Department of Justice during its probe of President Donald Trump and the 2020 election – a move Republicans say violated the Constitution.

    Lawyers for Hagerty wrote in the complaint to the Federal Communications Commission, reviewed by Fox News Digital, that Verizon should publicly admit wrongdoing and discipline employees who were involved in complying with a subpoena for his phone data. Otherwise, the FCC should declare that Verizon violated federal law and assign an independent monitor to watch over the company, Hagerty’s lawyers wrote.

    “Such discipline by the FCC would send a clear message that companies cannot collude with politically motivated prosecutors to violate customers’ rights,” Hagerty’s lawyers wrote. “Verizon is not above the law.”

    The Tennessee Republican’s complaint detailed how Verizon complied with former special counsel Jack Smith’s team by giving the prosecutors a narrow set of Hagerty’s and several other GOP senators’ phone data as part of Smith’s investigation into President Donald Trump and the 2020 election.

    Verizon justified its actions in a letter to the Senate in the fall, saying the subpoenas appeared “facially valid” and only contained phone numbers. They did not identify the subscribers or include information about Smith’s investigation, Verizon said.

    The phone company said it did not notify the senators about the subpoenas because they were accompanied by court-authorized gag orders.

    Fox News Digital reached out to a Verizon spokesperson for comment on the FCC complaint.

    Republicans have widely condemned the subpoenas, saying they violated the Constitution’s speech or debate clause, which gives Congress members an added layer of protection when it comes to prosecutorial matters.

    Smith has repeatedly stood by them, saying he handled them according to DOJ policy at the time. The policy in question has since been changed to require prosecutors to notify the courts if requested gag orders pertain to Congress members. Previously, it did not include that requirement, leading the courts to authorize gag orders against the senators and deprive them of the ability to try to quash the subpoenas.

    Hagerty’s FCC complaint is the latest instance of a senator seeking recourse for the subpoenas. Sen. Lindsey Graham, R-S.C., who was also targeted in Smith’s probe, supported a controversial provision in the government spending bill last year that gave senators the ability to bring $500,000 civil lawsuits against the DOJ.

    The provision caused significant infighting because of the perception that it would allow senators to enrich themselves, and the House later voted 426-0 to repeal it.

    Hagerty’s complaint comes one day before Sen. Marsha Blackburn, R-Tenn., another of Smith’s targets, holds a Senate hearing called “Arctic Frost Accountability.” Witnesses set to testify include executives of Verizon and AT&T.

    US military forces boarded a sanctioned oil tanker in the Indian Ocean after tracking the ship from the Caribbean Sea, the Pentagon said Monday.

    The Pentagon’s statement on social media did not say whether the ship was connected to Venezuela, which faces US sanctions on its oil and has relied on a shadow fleet of falsely flagged tankers to smuggle crude into global supply chains.

    However, the Aquila II was one of at least 16 tankers that departed the Venezuelan coast last month after US forces captured then-President Nicolás Maduro, said Samir Madani, co-founder of TankerTrackers.com. He said his organization used satellite imagery and surface-level photos to document the ship’s movements.

    According to data transmitted from the ship on Monday, it is not currently laden with a cargo of crude oil.

    The Aquila II is a Panamanian-flagged tanker under US sanctions related to the shipment of illicit Russian oil. Owned by a company with a listed address in Hong Kong, ship tracking data shows it has spent much of the last year with its radio transponder turned off, a practice known as “running dark” commonly employed by smugglers to hide their location.

    US Southern Command, which oversees Latin America, said in an email that it had nothing to add to the Pentagon’s post on X. The post said the military “conducted a right-of-visit, maritime interdiction” on the ship.

    “The Aquila II was operating in defiance of President Trump’s established quarantine of sanctioned vessels in the Caribbean,” the Pentagon said. “It ran, and we followed.”

    The US did not say it had seized the ship, which the US has done previously with at least seven other sanctioned oil tankers linked to Venezuela.

    Since the US ouster of Maduro in a surprise nighttime raid on Jan. 3, the Trump administration has set out to control the production, refining and global distribution of Venezuela’s oil products. Officials in President Donald Trump’s Republican administration have made it clear they see seizing the tankers as a way to generate cash as they seek to rebuild Venezuela’s battered oil industry and restore its economy.

    DOJ asks to dismiss Steve Bannon’s criminal charges

    The Justice Department is seeking to toss out its criminal case against former Trump adviser Steve Bannon, who was jailed for declining to testify before the House Jan. 6 committee.

    U.S. Attorney for D.C. Jeanine Pirro wrote Monday that the “government has determined in its prosecutorial discretion that dismissal of this criminal case is in the interests of justice.” She asked a judge to dismiss the indictment against Bannon with prejudice, meaning it cannot be refiled. Pirro added that Bannon did not oppose the move.

    Bannon, a media personality and former White House chief strategist, was convicted of contempt of Congress after he declined to comply with a subpoena from the House Jan. 6 panel for testimony and documents. He spent about four months in prison in 2024.

    Lawmakers on the committee had subpoenaed Bannon as part of a sweeping investigation into the events leading up to the Jan. 6 riot, including the alleged push by President Trump and his allies to overturn the results of the election. Bannon was not formally a part of Mr. Trump’s team at the time, but he was a vocal supporter of the president’s efforts. In its subpoena, the committee pointed to Bannon’s remarks on Jan. 5, 2021, that “all hell is going to break loose tomorrow.”

    Bannon did not comply with the subpoena, telling the committee the information that lawmakers wanted was subject to executive privilege, a legal doctrine that allows presidents to withhold certain information. The House — which had a Democratic majority at the time — voted to recommend charging Bannon with contempt of Congress in 2021, and the Justice Department brought charges against him soon after that.

    Days before his mid-2022 jury trial, Bannon’s attorneys changed course and said he would be willing to testify, writing that “circumstances have now changed” and Mr. Trump had chosen to waive executive privilege. Bannon was still found guilty by a D.C.-based jury and sentenced to jail time.

    Despite finishing his prison sentence in October 2024, Bannon is still challenging his conviction, asking the Supreme Court to take up his case last year. Bannon has argued that he didn’t willfully defy the subpoena, and instead was following his lawyers’ advice to hold off on complying until executive privilege issues could be worked out. He has also cast his contempt case as politically motivated.

    On Monday, the Justice Department asked the Supreme Court to vacate an appellate ruling that upheld Bannon’s conviction and send the matter back to the district court.

    The Justice Department’s efforts to toss out Bannon’s case come amid another high-profile debate over contempt of Congress.

    Lawmakers on the House Oversight Committee voted to recommend holding Bill and Hillary Clinton in contempt last month after the former president and secretary of state refused to testify in an investigation into Jeffrey Epstein. Shortly before the full House was set to take up the issue, the Clintons said they were willing to appear for depositions. The oversight panel’s chair, Republican Rep. James Comer of Kentucky, said the pair had “caved.”

    For two hours inside a classified Congressional hearing last week, Republican and Democrat Senators grew increasingly exasperated as officials from the FBI, the National Security Agency and other agencies refused to say whether the Trump administration wants Congress to renew a powerful foreign surveillance law that is expiring soon, according to two people briefed on the hearing.

    That law, Section 702 of the Foreign Intelligence Surveillance Act, allows authorized US officials to gather phone calls and text messages of foreign targets, but can also scoop up the data of Americans in the process.

    That is a fact that irks some on the political left and right, but has yet to stop a renewal because of the widespread understanding that it’s a necessary national security tool.

    The recent lack of answers from the Trump administration, however, has left some lawmakers with deep concerns about the administration’s national security policy priorities, and whether President Donald Trump’s push for retribution against the national security establishment is taking precedence over a core national security program.

    The hearing should have been a routine stop for US officials to urge Congress to renew the 2008 statute. Senior national security officials have for years said Section 702 is critical to thwarting terror attacks, stemming the flow of fentanyl into the US and stopping ransomware attacks on critical infrastructure.

    But Trump and his allies have long railed against FISA as a tool used to target his political campaigns and some of his political allies. And the FBI has admitted to misusing Section 702, including through the search for information on suspects in the January 6, 2021, US Capitol riot and people arrested at 2020 protests after the police killing of George Floyd.

    The FBI declined to comment for this story. The White House and the Office of the Director of National Intelligence didn’t respond to requests for comment.

    Section 702 has faced many obstacles to renewal before. It took the House of Representatives multiple tries to vote to reauthorize the statute in 2024 amid a fight over privacy measures.

    The recent Senate intelligence committee hearing showed Republicans urging the Trump administration to take a stance on the surveillance tool, the people briefed told CNN.

    Arkansas Sen. Tom Cotton, the Republican national security hawk who chairs the committee, pushed the agency representatives to take an official position, noting that for some members of Congress reauthorizing the law is a tough vote. Republican Sen. John Cornyn of Texas expressed frustration as he tried multiple ways to squeeze an answer from the officials testifying, but ultimately could not get an answer, according to the people briefed.

    “Chairman Cotton does not comment on closed SSCI hearings, but he always welcomes the administration’s views on any matter,” a Cotton spokesperson said in a statement.

    Sen. Mark Warner, the top Democrat on the committee, told CNN: “Section 702 has been upheld by successive administrations from both parties as a critical national security tool. With just two months until it expires, the absence of any position or strategy from this administration is nothing short of a dereliction of duty.”

    In their confirmation hearings, FBI Director Kash Patel and Director of National Intelligence Tulsi Gabbard expressed support for Section 702. (Gabbard’s previous opposition to the statute as a congresswoman risked imperiling her nomination with Republicans).

    Patel told lawmakers intelligence collected through FISA helped rescue American hostages overseas.

    “The issue for me is not with FISA and 702. The issue has been those that have been in government service and abused it in the past,” Patel said during his January 2025 confirmation hearing in response to questions from Cornyn. “So we must work with Congress to provide the protections necessary for American citizens.”

    Following FBI abuses of Section 702, the bureau tightened restrictions on searches of the database. Lawmakers like Cornyn have touted Section 702 reforms like increased penalties for FISA violations involving a US person.

    Still, the surveillance law remains a point of heated debate in Congress, where new bills to reform the statute could be introduced prior to its lapse in April.

    Section 702 is “by far the more important single operational statute in the national security area,” Glenn Gerstell, former general counsel of the NSA, told CNN.

    Gerstell said he was concerned that reforms to the statute may have gone too far in restricting officials’ ability to search the database.

    “Maybe we’ll miss something, perhaps some hint about a terrorist’s plans,” he said. “The Trump administration and Congress should take a good look at how well the recent reforms appear to have worked, make any tweaks necessary – and fully and permanently reauthorize the statute.”

    Feb 9 (Reuters) – A U.S. judge in New York on Monday temporarily put her ruling on hold forcing the Trump administration to lift a four-month-old freeze on federal funding for the $16 billion Hudson Tunnel Project connecting New York City and New Jersey.

    U.S. District Judge Jeannette Vargas on Friday had ordered the funding restored. The Justice Department had warned it would be required by 1 p.m Monday to disburse up to $200 million in funds for the project unless her order halted.

    Vargas said she would put her order on hold until Thursday 5 p.m. to give the Second Circuit U.S. Court of Appeals time to consider the government’s emergency request.

  • 参议院共和党人上周确认了六位唐纳德·特朗普总统的司法提名人,继续以快速节奏尽可能多地批准其候选人。


    虽然参议院共和党人正快速推进特朗普司法提名人的确认,但总统及其部分盟友希望废除参议院一项有着一个多世纪历史的传统,该传统为司法提名程序提供两党制衡机制。

    他们声称蓝 slips 传统正在阻碍共和党人确认候选人,并指责民主党人将这一程序作为人质。

    Senate Republicans confirmed half a dozen of President Donald Trump’s judicial nominees last week, continuing a quick pace to green-light as many of his picks as possible.

    While the Senate GOP is moving fast to confirm Trump’s judicial nominees, the president and some of his allies want to eviscerate an over-century-old tradition in the Senate that provides bipartisan guardrails to the judicial nomination process.

    They contend that the blue slip tradition is slowing down Republicans from being able to confirm picks, and that Democrats are holding the process hostage.

    “Nuking the blue slip would be a huge mistake,” Sen. Thom Tillis, R-N.C., told Fox News Digital.

    Tillis, like several other Republicans, has argued that the blue slips are a valuable tool of the minority, and that inevitably, the GOP would need to use the tradition to their advantage when Democrats regain control of the upper chamber.

    The Senate has confirmed 33 judges since the start of Trump’s second term, a figure that dwarfs the number of total judicial nominees, including U.S. attorneys, district and circuit court judges, moved through the upper chamber during his first go-round in the White House.

    During the first year of his first term, the Senate confirmed 19 Article III nominees, including Supreme Court Justice Neil Gorsuch.

    Though Republicans are far ahead of Trump’s first time clip, Democrats under former President Joe Biden still outpaced them in this metric. Biden clocked 42 total judicial nominees confirmed during the first year of his term.

    Whether the Senate can outpace Trump’s final total of 234 judicial nominees from his first term remains to be seen, but for now the blue slip appears to be safe.

    Still, Trump sounded off on the practice late last year in the Oval Office, arguing that the GOP should “get rid of blue slips, because, as a Republican President, I am unable to put anybody in office having to do with U.S. attorneys or having to do with judges.”

    Much of his frustration with the tradition, which has been around for over 100 years in the upper chamber, likely stemmed from the nominations of Alina Habba and Lindsey Halligan getting derailed by blue slips last year.

    He’s taken his frustrations out on Senate Judiciary Committee Chair Chuck Grassley, R-Iowa, a vocal proponent of the practice, and other Republicans that want to maintain the tradition.

    Notably, Grassley modified the tradition in 2017 to allow for circuit court judges to skirt the process, further boosting the number of judges Republicans were able to confirm under Trump despite Democratic objections.

    When asked if the Senate’s pace in confirming judicial nominees further affirmed that the blue slip was here to stay, Grassley told Fox News Digital, “It doesn’t need to be a present question.”

    “Because it’s a question of 110 years, and everybody in the Senate wants to maintain the blue slip,” Grassley said.

    Feb 9 (Reuters) – The U.S. Food and Drug Administration said a television advertisement for Novo Nordisk’s weight-loss pill is “false or misleading,” according to a letter dated February 5.

    The health regulator said the television spot misleadingly suggests that Wegovy, in its pill form, offers an advancement or improvement over other weight-loss drugs that belong to the class known as GLP-1s.

    “We confirm that Novo Nordisk received an ‘Untitled Letter’ from FDA concerning a television commercial for Wegovy pill, which has been running since launch — not the Super Bowl ad,” said Novo spokeswoman Ambre James-Brown.

    The agency said the Novo direct-to-consumer ad was in violation of the Federal Food, Drug, and Cosmetic Act, and asked the drugmaker to take immediate action to address any violations, which could include ceasing all ads containing misleading claims.

    “We take all regulatory feedback seriously and are in the process of responding to the FDA to address their concerns regarding the advertisement’s presentation,” James-Brown added.

    The FDA also said the claims “live lighter” and “a way forward” misleadingly imply additional weight loss compared to other currently approved GLP-1 treatments, when this has not been demonstrated.

    “Additionally, they misleadingly imply benefits beyond physical weight loss, such as emotional relief, reduced psychological burden, hope, or direction for patients’ lives, positioning the drug as a solution to broader life challenges rather than a treatment for a specific condition, when this has also not been demonstrated,” the agency said in the letter.

    The FDA also flagged the ad included certain presentations where the text on screen did not match the audio.
