    A federal judge on Monday blocked the Trump administration from revoking legal protections for Haitians enrolled in the Temporary Protected Status program, granting a last-minute reprieve to 350,000 immigrants who were set to lose their deportation protections on Tuesday.

    U.S. District Court Judge Ana Reyes indefinitely paused the planned termination of Haiti’s TPS program, explicitly barring the federal government from invalidating the legal status and work permits of active enrollees and from arresting and deporting them.

    In an opinion accompanying her order, Reyes issued a forceful rebuke of Homeland Security Secretary Kristi Noem’s decision to end the TPS policy for Haitians.

    Reyes concluded Noem’s decision was “arbitrary and capricious” and in violation of the Administrative Procedures Act, writing that it failed to fully consider “overwhelming evidence of present danger” in crisis-stricken Haiti, which remains plagued by political instability, gang violence and widespread poverty.

    Reyes also found Noem’s decision was “in part” rooted in “racial animus,” citing disparaging remarks that the secretary and President Trump have made about Haiti and immigrants.

    “Kristi Noem has a First Amendment right to call immigrants killers, leeches, entitlement junkies, and any other inapt name she wants,” Reyes wrote. “Secretary Noem, however, is constrained by both our Constitution and the APA to apply faithfully the facts to the law in implementing the TPS program. The record to-date shows she has yet to do that.”

    In a statement, Department of Homeland Security spokeswoman Tricia McLaughlin suggested the Trump administration would ask the Supreme Court to intervene in the case.

    “Supreme Court, here we come,” she said. “This is lawless activism that we will be vindicated on.”

    “Haiti’s TPS was granted following an earthquake that took place over 15 years ago, it was never intended to be a de facto amnesty program, yet that’s how previous administrations have used it for decades,” McLaughlin added.

    TPS was created by Congress in 1990. Since then, Democratic and Republican administrations have used the policy to provide temporary legal refuge to foreigners from countries facing armed conflict, an environmental disaster or another emergency that makes their return unsafe.

    The Trump administration has moved to dismantle most TPS programs, raising the specter of deportation for hundreds of thousands of immigrants from Afghanistan, Cameroon, Ethiopia, Honduras, Myanmar, Nepal, Nicaragua, Somalia, South Sudan, Syria and Venezuela.

    The Trump administration argues these programs attract illegal immigration and that they have been abused and extended for too long by Democratic administrations.

    Costa Ricans have elected conservative populist Laura Fernández as their next president, according to preliminary results, making her the latest right-leaning leader to win office in Latin America.

    With results from 96.8% of polling places counted, Fernández of the Sovereign People’s Party won 48.3% of the vote, the Supreme Electoral Tribunal reported.

    Her closest challenger, economist Álvaro Ramos of the National Liberation Party, trailed with 33.4%, the Associated Press reported.

    Ramos conceded the race on election night, with Fernández, 39, to begin her four-year term in May.

    She campaigned on continuing Chaves’ populist agenda, which reshaped Costa Rican politics by arguing against traditional parties and promising tougher action on crime.

    Fernández served as minister of national planning and later as minister of the presidency, giving her a central role in Chaves’ administration.

    The murder rate had increased by 50% over the last six years, according to reports.

    Fernández pledged a hard-line security strategy, including increased cooperation with the U.S. Drug Enforcement Administration and tougher measures against organized crime.

    She has also floated controversial proposals inspired by El Salvador’s President Nayib Bukele.

    This included construction of a special prison for gang leaders, the Associated Press reported.

    U.S. Secretary of State Marco Rubio congratulated Fernández in a statement Monday.

    “Under her leadership, we are confident Costa Rica will continue to advance shared priorities to include combating narco-trafficking, ending illegal immigration to the United States, promoting cybersecurity and secure telecommunications, and strengthening economic ties,” Rubio said.

    “I hope that we can immediately lower the flags of whichever political party and start working only in favor of the Costa Rican flag,” Fernández said after the result.

    “I believe the Costa Rican people expect nothing less of us,” she added.

    As the emphasis on implementing artificial intelligence across society grows, voters think the use of AI technology is happening too fast — and they have little confidence the federal government can regulate it properly.

    The latest Fox News poll finds 6 in 10 registered voters feel the use of artificial intelligence is moving too quickly in the United States, while another 3 in 10 feels it’s progressing at the right pace. Just 6% say it’s moving too slowly.

    Although most think the use of AI is going too fast, there are some differences along demographic lines: Women, White voters, those ages 65+, and Democrats are more likely to say things are moving too fast compared to men, nonwhite voters, those under age 30, and Republicans.

    In addition, 63% lack faith in the federal government’s ability to properly regulate AI, a view that has been largely consistent since 2023. Thirty-six percent have a great deal or some confidence in the government’s ability.

    The main demographic groups where more than half are confident in the government regulating AI include MAGA supporters (57%), Republican men (55%), and very conservatives (52%).

    Despite all the hype, a slim majority of voters (53%) say artificial intelligence has not made much difference in their life, while the remaining half splits between saying AI has personally helped them (26%) vs. harmed them (20%).

    Those most likely to feel artificial intelligence has helped them are subsets of men, including dads (46%) and men under age 45 (43%). Voters under age 30 also feel AI has more likely benefited them (45% helped, 28% harmed). Those most likely to feel harmed are nonwhite women (33%) and moms (29%).

    The development comes after a Fox News Digital report highlighted criticisms of the latest edition of the Federal Judicial Center’s (FJC) 1,600-page “Reference Manual on Scientific Evidence.” Critics said the traditionally apolitical reference guide is now rife with climate change–related ideological bias, citing extensive footnotes drawn from left-leaning and climate-alarmist sources.

    The Federal Judicial Center itself is the research and education agency of the federal judiciary, and its governing board is chaired by Chief Justice John Roberts.

    Nebraska Attorney General Mike Hilgers is leading the effort, writing to House Judiciary Committee Chairman Jim Jordan, R-Ohio, subcommittee Chairman Darrell Issa, R-Calif., and Senate Judiciary Committee Chairman Charles Grassley, R-Iowa, urging them to expand their improper-influence probe to include what they call an “inappropriate attempt to rig case outcomes in favor of one side.”

    The latest edition was published December 31 and includes a foreword by Justice Elena Kagan before delving into subject matter footnoted to environmental law expert Jessica Wentz, climatologist Michael Mann, and a slew of others involved in climate change research and advocacy.

    “Those same improper influence concerns apply to the Federal Judicial Center and its new ‘Reference Manual on Scientific Evidence’”, the attorney generals wrote in part.

    They noted that Kagan’s foreword said previous editions of the manual helped “bring about better and fairer legal decisions,” but argued her words would not echo the same in the latest edition.

    “Like [the] [Climate Judiciary Project that] the Committee is investigating, the new chapter presents a highly biased, agenda-driven view favoring radical interests pursuing lawsuits against producers and users of traditional forms of fossil fuel energy,” the attorneys general argued, citing the inclusion of findings from Jessica Wentz, a climate change advocate at Columbia University, among other names.

    They cited a court brief crafted by Wentz in opposition to the Willow drilling project in Alaska, where she was quoted as saying “the world needs to phase out fossil fuels as rapidly as possible in order to avert potentially catastrophic levels of global warming and climate change.”

    The prosecutors also pointed to the inclusion of work from an attorney who represented the city of Honolulu in cases against traditional energy firms.

    “Not surprisingly, given the strong biases of its authors, reviewers, and sources, the climate change chapter presents as settled the very methodologies that plaintiffs rely on to impose liability on fossil-fuel defendants,” the letter reads.

    “The chapter presents this science as authoritative without acknowledging contrary views or disclosing the many conflicts of the authors, reviewers, and sources. Ethics experts have noted that these issues raise serious ethics concerns.”

    In comments to Fox News Digital, Hilgers said the FJC’s new science manual should present complex evidence impartially, but instead “appears to embed the views of climate activists and diversity, equity, and inclusion ideologues into what is presented as neutral guidance.”

    “We’ve seen ridiculous legal warfare grow across the country — politically motivated groups, using our courts and liberal justices to push their climate agenda. That’s bad enough,” McCuskey told Fox News Digital, saying it is time to prevent the influence of ‘junk science.’”

    “We… must protect our judicial system and its impartiality,” he said.

    McCuskey also fired off a missive to the FJC itself, co-signed by Marshall, Uthmeier, Cox and others.

    He told the center’s director — Obama-appointed federal judge Robin Rosenberg of Florida — that the manual’s ubiquity must remain trusted.

    Dr. Peter Attia, longevity expert, apologizes for “indefensible” emails to Jeffrey Epstein

    Peter Attia, a doctor and author well known for his research on longevity, is apologizing for what he calls “embarrassing, tasteless, and indefensible” emails he exchanged with Jeffrey Epstein, after the messages came to light in the Justice Department’s latest release of files related to the Epstein case.

    He has not been accused of criminal wrongdoing. But Attia’s name appears in the records released by the Justice Department hundreds of times and his communications with Epstein are more extensive than previously known.

    Attia was recently named as a contributor to CBS News. CBS’ parent company, Paramount Skydance, had no comment.

    Among the messages, in 2016, Attia wrote to Epstein, “P***y is, indeed, low carb. Still awaiting results on gluten content, though.”

    After news reports about the emails, Attia posted on X a long apology and account of his relationship with Epstein. He denied any involvement in criminal activity, said he never flew on Epstein’s plane, never visited his island and never attended “any sex parties.”

    The last correspondence between Attia and Epstein appears to have occurred in the spring of 2019, shortly before Epstein’s arrest in July and death on Aug. 10.

    He said he regretted “putting myself in a position where emails, some of them embarrassing, tasteless, and indefensible, are now public,” and went on to say, “I accept that reality and the humiliation that comes with it.”

    Attia said in his post that between 2014 and 2019, he met with Epstein “on approximately seven or eight occasions at his New York City home.” He said they met “regarding research studies and to meet others.”

    Included in the documents released Friday was an exchange from 2015 in which Attia had written a note — redacted by the Justice Department — that bore the subject line, “Got a fresh shipment.” Epstein responded, “me too,” with a photo that was also redacted. Attia responded, “Please tell (me) you found that picture on line … bastard.”

    “fraid not,” Epstein said.

    Attia wrote back that “the biggest problem with becoming friends with you” is that “[t]he life you lead is so outrageous, and yet I can’t tell a soul.”

    Attia claimed in his social media post that the “fresh shipment” referred to a redacted photograph of metformin, “a medication I had just received from the pharmacy for my own use.” (Attia used to take the drug for anti-aging reasons but said he stopped in 2018 because it had negative effects around exercise.)

    Epstein’s “me too” response included “a photograph of an adult woman,” Attia said.

    “I responded with crude, tasteless banter. Reading that exchange now is very embarrassing, and I will not defend it. I’m ashamed of myself for everything about this,” Attia said. “At the time, I understood this exchange as juvenile, not a reference to anything dark or harmful.”

    Epstein at that point had a record as a sex offender from a case in Florida where he’d accepted a 2008 plea deal to avoid federal charges. In 2019, he was arrested on federal sex trafficking charges. His death in his jail cell in August 2019 was ruled a suicide.

    Attia said he asked Epstein about his 2008 conviction in Florida and said Epstein “characterized it as prostitution-related charges.”

    “In 2018, I came to learn this was grossly minimized,” Attia said. But he also maintained, “I never witnessed illegal behavior and never saw anyone who appeared underage in his presence.”

    Attia is the founder of Outlive, an app that translates longevity science into personalized daily practice, and Early Medical, a medical practice that aims to help patients lengthen their healthy lifespan. He is the host of the podcast “The Peter Attia Drive” and author of “Outlive: The Science and Art of Longevity.”

    A Minnesota judge has wiped away an order he issued last month that required federal investigators to preserve evidence gathered at the scene of Alex Pretti’s fatal shooting by immigration officers.

    US District Judge Alex Tostrud said he was lifting the emergency order he issued the day of Pretti’s shooting that barred various federal investigatory offices from destroying or altering any evidence related to the incident because he had gotten assurances from federal officials that evidence would be properly maintained.

    The judge, an appointee of President Donald Trump, had imposed the requirement at the behest of the Minnesota Bureau of Criminal Apprehension and the Hennepin County Attorney’s Office after they raised concerns in court that their own investigative efforts into the incident could be undermined absent his intervention.

    “Though the record is not one-sided, the greater weight of the evidence shows Defendants are not likely to destroy or improperly alter evidence related to Mr. Pretti’s shooting during the life of this case, and other relevant considerations do not on balance favor a continuing preservation order,” Tostrud wrote in an 18-page decision.

    “The temporary restraining order’s terms are not meaningfully different from defendants’ preservation policies,” the judge wrote. “An ongoing preservation order – and the contempt power that accompanies it – would overlay, not just defendants’ preservation polices, but any investigative measures that might alter evidence.”

    The Minnesota Bureau of Criminal Apprehension told CNN that talks with federal investigators on sharing evidence in the case are ongoing, adding that they are “hopeful” an agreement can be reached. Thus far, however, the FBI and Homeland Security Invesdtigations have not shared information with local investigators.

    In his ruling, Tostrud went on to say that “examination and testing often leave evidence in a different condition after testing than it was before” and that such potential changes occurring under his now-dissolved order would have forced him to play what he described as an improper role in the government’s investigation into the shooting.

    “Legitimate concerns over whether those types of investigative measures comply with a preservation order might reasonably prompt defendants to seek judicial direction,” Tostrud wrote. “That, in turn, would inject the court into Defendants’ investigation, not just their evidence preservation.”

    The BCA had been iced out of an earlier federal probe into a different fatal shooting of a US citizen, Renee Good, by federal agents in Minnesota and the lawsuit before Tostrud represented a frenzied effort by the state investigators to ensure they’d later have access to the evidence for their own inspection.

    An FBI official swore in court papers last month that “evidence was packaged by trained evidence collectors” who wore the correct personal equipment and packaged the evidence in tamper-proof evidence tape. The evidence the FBI collected is in a secure evidence room with controlled access in the FBI’s Minneapolis Field Office.
